
The ECHR granted the request of the committee against torture, obliging Russia to take measures to protect the life and health of the under investigation M., which is abandoned in a room operating in the investigative insulator (PFRSI), IK-14 of the Nizhny Novgorod Region in the village of Sukhobyvodnoye Semenovsky District. This was reported on the website of the checkpoint.
In addition, in its decision, the Strasbourg court demanded that Russia immediately conduct an examination by M. doctors independent of the FSIN authorities to find out the circumstances of the injuries, which are discussed in the statement of human rights activists.
Along with this, the ECHR urgently communicated the complaint. By July 18, Russia is obliged to answer a number of questions, confirming its answers by official documents. In particular, the judges are interested in why M. was transferred from the pre-trial detention center-1 in Nizhny Novgorod to the PFRSI IK-14, what was the state of health of the defendant at the time of the transfer, where it was maintained by M. and how much the PFRSI was isolated from the rest of the colony, and whether it was under investigation after arrival in IK-14 access to doctors and lawyer.
In addition, the ECHR struck Russia copies of all materials of the audit carried out upon the fact of receiving injuries, or a criminal case, if it is nevertheless initiated by the results of the audit.
Since the complaint states that the under investigation was subjected to rape, the Strasbourg court in accordance with rule 47 of its regulations ordered Russia to classify the name and other data on the personality of M.
“In this case, the applicant’s situation is more than serious and, in my opinion, will remain like that even when transferring him to another correctional institution,” said Olga Sadovskaya, deputy chairman of the checkpoint. The human rights activist added that M. is charged with a crime not related to the use of violence. In this regard, she concluded, the under investigation can be transferred under house arrest.
M. was transferred from Nizhny Novgorod to Sukhobyzwavodnoy on April 10. As the investigator of the Ministry of Internal Affairs, who was engaged in his case, told the defendant who was under investigation of human rights activists that he was confessing to IK-14 in everything.
The prisoners of the colonies, cooperating with the administration, were cruelly beaten by M. many times, and also raped him with a rubber club "PR-73", which is used by the security forces. As a result of the torture, the defendant wrote "a confession" and refused the services of his lawyers.
Nevertheless, M. reported on the torture that he was subjected to, an official of the apparatus of the regional ombudsman and human rights activists. For this, the convicts once again beat and raped him.
The situation changed after the intervention of the Nizhny Novgorod PMC. The lawyer, Evgenia Gubin, found the defendant - and the checkpoint appealed to the Strasbourg court with a complaint, petitioning the interim measures to protect the life and health of the applicant.
Meanwhile, the Nizhny Novgorod public published a petition to the Prosecutor General Yuri Chaika, the Chairman of the TCR, Alexander Bastrykin and Director of the Federal Penitentiary Service of Gennady Kornienko, with the demands to stop torture in the IK-14, to remove the human rights violations in the colony.
