The magistrate court collected in favor of the subscriber of the NTV-Plus satellite television operator compensation for non-pecuniary damage for the fact that the operator without warning turned off the broadcast of the Rain TV channel.
It is reported by "Right.ru."
On January 29, NTV-Plus, due to a survey of blockade Leningrad, stopped broadcasting “rain” without warning his subscribers about it. One of them was Marina Golovinkina, who in 1999 concluded a subscriber agreement with NTV-Plus for providing access to satellite television.
On February 2, Golovinkina sent a claim to the operator with a request to immediately restore the broadcasting of the rain. The claim remained unanswered, and then Golovinkin went to defend her rights to the magistrate court. She asked the court to oblige NTV-Plus to provide her with access to the Rain television channel, as well as recover from the company a loss of 92 rubles and compensation for non-pecuniary damage in the amount of 25,000 rubles.
The magistrate Ivan Gorneev partially satisfied the lawsuit: he recovered from NTV-Plus in favor of Golovinkina’s compensation for non-pecuniary damage in the amount of 1200 rubles, 600 rubles of a fine and expenses incurred in the amount of 8,000 rubles.
In the actions of the operator expressed in the termination of the broadcast of the Rain TV channel, the judge did not see a violation, but he considered that NTV-Plus had to notify the subscriber about the changes in the package.
NTV-Plus filed an appeal that the Tushino district court was considering on Tuesday, July 1, on Tuesday. As a result, the decision of the justice of the peace was upheld, and the appeal of NTV-Plus is not satisfied.
