
A bill proving to the State Duma providing for parole (UDO) from administrative punishment in the form of deprivation of a driver’s license. The document prepared by Senator Vladimir Fedorov provides for the introduction of a new article to the Code of Administrative Offenses of the Russian Federation - "4.9. Conventional exemption from administrative punishment in the form of deprivation of special law or disqualification." As in the case of criminal offenses, it is necessary that at least half of the term to pass and during this time the offender show approximate behavior.
According to Carscope , Fedorov offers to return the rights to the driver ahead of schedule, "if the court is recognized that, taking into account the approximate behavior and medical report (in case of deprivation of the right to drive vehicles in a drunk state), he does not need to further deprive this special law or disqualification."
In addition, the bill also provides for the cancellation of the theoretical exam necessary for the return of the rights of mandatory retake, if the term of deprivation is up to a year.
If the driver, to whom the rights have been returned ahead of schedule, will again commit a violation that provides for deprivation of rights, the court will cancel UDO. And the term of the new punishment will be calculated only after the expiration of the full term of the previous deprivation.
In the explanatory note to the document, Fedorov refers to the existence of the Institute of Conventional Liberation in Russian legislation, which is provided for criminal offenses, but does not work for less serious administrative violations. He also recalls Soviet experience: in the Code of the RSFSR on administrative offenses there was Article 297, which provided for a reduction in the deadline for deprivation of rights in the event of a “conscientious attitude to work and exemplary behavior” of the offender.
If the law is approved, then changes can enter into force on January 1, 2015.
