The Memorial human rights center recognized the activists of Oleg Savvin, Mikhail Feldman and Dmitry Fonarev, according to the NGO website. Since the end of April, they are detained in Kaliningrad on charges of hooliganism.
"From the hooligan motives, as part of a group of persons, by prior conspiracy, were placed on the building of the FSB of Russia in the Kaliningrad Region on the building of the FSB of Russia ... The German flag as a symbol of the need to withdraw the Kaliningrad region from the Russian Federation and join the European Union, thereby grossly violated public order," the court’s decision on the election of restraint measures.
"From the point of view of the PC" Memorial ", activists are political prisoners, since imprisonment was applied exclusively because of their political beliefs, due to the non -violent implementation of the freedom of expression of opinions, in the absence of an event or the composition of the offense and in violation of the right to a fair trial," the human rights organization said.
The Memorial believes that the motive of political hatred is attributed to the accused unreasonably, and in their actions there is no corpus delicti. "Article 213 of the Criminal Code (hooliganism), due to the uncertainty of formulations, has recently been a universal tool for politically motivated criminal prosecution in situations where it is not possible to find any other reason, and can actually be applied to any action," the report said.
The persecution of the foreign flag is especially unreasonable against the backdrop of public support by the Russian authorities of armed speeches under the Russian flag in Ukraine, human rights activists say.
The memorial requires the immediate release of Savvin, Fieldman and Fonarev, as well as the termination of their criminal prosecution.
Feldman himself reported that on March 11 he passed by the FSB building, saw that the unknown people had hung the FRG flag, and decided to take a picture. Almost immediately, he was detained by people in civilian clothes, whom he recognized as employees of the Kaliningrad Center "E". Savvina and Fonarev was detained on the same day near the Kaliningrad station. All of them, according to the protocol, "cursed". Feldman was administratively arrested for 10 days, his comrades - 15. In the future, they were extended by administrative arrest of far -fetched charges. In early April, they were released. However, on April 21, Fonarev was again detained, already in a criminal case. Feldman and Savvin were detained later. On April 28, the court arrested them.
On May 2, the Foreign Ministry of Ukraine expressed surprise about the arrest of Savvin, Fieldman and Fonarev. Kyiv accused Moscow of using double standards.
"It is surprising that at the same time, such actions of separatists in the east of Ukraine, also carried out with the use of weapons, the seizure of administrative buildings and hostages, are encouraged in every possible way by official Russian power. Moreover, the Russian side also cynically requires the release of individual separatists, detained not only for raising a foreign administrative buildings, but for organizing violent buildings. shares aimed at the split of the country and the accession of its individual parts to a foreign state.
