Mosgorsud reduced the term of detention of Daniil Konstantinov

The Moscow City Court reduced the term for the extension of the arrest of the leader of the defense League of Moscow Daniil Konstantinov from six months to three months - until August 16, Rapsei reports . He is in custody of a fabricated charges of murder.

Thus, the Moscow City Court recognized the extension of the preventive measure for six months and changed the decision made by the Chertanovsky court of the capital. At the same time, the court refused the defense to the demand to transfer Konstantinov under house arrest.

The Chertanovsky court did not have the right to renew Konstantinov for six months, said the lawyer of the accused Denis Zsaapin. According to the law, this can only be done once, in the future the arrest can be extended exclusively for three months. The fact that the case is listened a second time does not matter, the lawyer emphasized.

Konstantinov himself said that he was in custody for more than two years. He is prolonged by the conclusion without any real grounds, although all evidence in the case has already been investigated.

Konstantinov is under arrest from March 22, 2012. The case against him was opened under part 1 of Article 105 of the Criminal Code (murder), which provides for up to 15 years in the colony. At the same time, the political prisoner has an indisputable alibi: at the time of the murder, he celebrated his mother’s birthday in a restaurant at the other end of the city, which is confirmed by testimony.

In the factory of the case, Konstantinov accused the TSPE operatives, explaining that in this way they took revenge on his refusal to cooperate.

The case of Konstantinov is listening to the Chertanovsky District Court again. The first process was held in June - December 2013. The prosecutor demanded 10 years of strict regime for the Police, but Judge Galina Turkinareturned the case for the investigation . The basis for such a decision, she called the shortcomings in the indictment.

The new process began on May 27 . It was then that the arrest of Konstantinov was extended. After the announcement of the indictment, the defendant once again stated that he did not plead guilty .
