
The leader of the neo -Nazi organization Restrukt Maxim Martsinkevich (Tesak), accused of extremism, refused to admit guilt. This is reported by Kasparov.ru.
On Wednesday, in the Kuntsevsky district court, the consideration of the Martsinkevich case began on the merits. The prosecutor read out the indictment, after which the judge asked Tesak whether it was clear what he was accused of. “It’s not completely clear the accusation,” the defendant objected. “Naturally, I do not admit guilt.”
The composition of the 282nd article of the Criminal Code, imputed by Martsinkevich, suggests the presence of victims. In this regard, the defendant asked the prosecutor who exactly and what he threatened. The prosecutor, however, answered, citing an examination conducted by the investigation that the threat of violence expressed by Tesak belonged to an indefinite group of persons.
Preliminary hearings in the Martsinkevich case were held on July 24 . On them, the term of detention of the accused in jail was at the request of the prosecutor for six months. The defense sought the release of Tesak on bail or transferring under house arrest, but the judge refused to mitigate the nationalist's measure of restraint.
According to paragraph "A" of part 2 of Article 282 of the Criminal Code (excitement of hatred or enmity with the threat of violence), Martsinkevich threatens up to five years in the colony. The reason for the initiation of the case was three videos published by a nationalist on social networks in September 2013.
Meanwhile, the defense of Tesak disputes the conclusions of linguistic experts , which underlie the charges. It characterizes these conclusions as subjective and unreasonably tough in relation to the nationalist. In particular, the lawyers noted on the video Comment by Tesak to the film "near-football" was considered extremist only because the nationalist paid the main attention to the conflict of the protagonist of the tape with Azerbaijanis. The video with an approving review of the film "Stalingrad" attracted the attention of experts, since in this video the Tesak is dressed in a T -shirt with the inscription "88", which is sustainably associated with a Nazi greeting. In addition, the extremist was recognized as a shortly abandoned phrase of Martsinkevich that when watching the film, he "was ill for another team."
The case against Tesak was opened at the end of November 2013. On December 13, the Kuntsevsky District Court of Moscow arrested the nationalist in absentia . Martsinkevich himself at this time was in Cuba. In an interview with Lifenews, he stated that he was not planning to return to his homeland, even if his criminal prosecution is stopped. The case against him, Tesak called revenge for the fight against pedophiles. He agreed to voluntarily appear to the court only if the Institute of the Jurisdorship would be introduced for business under the 282nd article of the Criminal Code.
On January 17, 2014 , Martsinkevich was detained by the Cuban police in one of the hotels of Havana in fact immediately after the relevant request from the Russian Bureau of Interpol. On January 27, he was delivered to Moscow, and two days later the charge was charged.
On March 28, Tesac announced a hunger strike in protest against the investigation refusal to introduce an independent examination to the case and conduct a second expert study. He starved 67 days - until June 5, - having lost 43 kilograms of weight during this time.
