Now bloggers will have to check the reliability of the information posted on their pages, not publish information about the personal life of citizens, pornographic and extremist materials, indicate age -related restrictions for users, fulfill the conditions for election campaigning and not using the mat. Those who did not indicate when registering their LiveJournal FULL NAME and email address will be required to provide these data on the request of Roskomnadzor. For violation of all these rules - a fine (for individuals - from 10 to 30 thousand rubles, for legal entities - from 50 to 300 thousand) or suspension of activity for a month.
Perhaps the bloggers would have been outraged if they had acquired the rights that the media possessed along with his duties. However, the authors of the bill - the chairman of the State Duma Committee on Information Policy, Alexei Mitrofanov (in June of this year, deprived of deputy inviolability on suspicion of receiving a bribe) and members of the LDPR faction Andrei Lugovoi and Vadim Money - considered this to be too.
“There are no methods that will consider the number of users who have visited the page,” the popular blogger Anton Nosik lists the claims to the new law. - The plans of Roskomnadzor do not create a general register of bloggers. That is, if you write about the cats (or about what you want), have at least a million visitors - no one will touch you. You will not even need to register in the registry. Only those who received a special notice will have to do this. And we all understand what bloggers will receive it. If the law was indeed aimed at protecting consumer rights, it would be performed differently. And the most interesting thing is that even before the law entered into force, they explained to us that it would not act for everyone. Only against someone.
In his blog at Livejournal, Anton Nosik already wrote that he was not going to register in the registry: “My right to express my opinion on the Internet on the Internet is recorded in article 29 of the current Constitution of the Russian Federation, and no preliminary licensing for owners of the right to open a company is said there.” In addition, he noted that his LJ is physically located in America, and all relations with Livejournal Inc. They are regulated only by the laws of the state of California. This law “does not apply to California in the same way, the laws of the Korean People's Democratic Republic or the Kingdom of Saudi Arabia do not apply to Russia,” the nose said on his blog.
- If the blogger refuses to fulfill this law, entire sites, not specific pages, will be blocked. That is, in fact, this law is directed not so much against bloggers as against sites, such as Livejournal, Twitter, Facebook, ”the nose emphasized in the commentary“ New ”.
How exactly the number of visits to the page will be monitored is not entirely clear, because the blogger receives statistics about the number of views of his LiveJournal, but it is visible only to him and the site on which his page is located.
“The state will not have any other choice, except for the sending of official requests to the relevant company (whether Twitter, Livejournal and others),” said Alexei Afanasyev , an expert in the field of IT technologies . - If the company ignores this request, sanctions, including blocking and blacklisting, can be applied against it. But in general, the equalization of bloggers to the media is wrong. Indeed, in fact, your recording on the wall is like a drawing on a fence or an ad in the subway. And now, now each adsler of ads to consider the media? And if you think about the long -term consequences of this law and the Law on Personal Data, which enters into force since 2016, it will become obvious that they will hit large companies and modern technologies. After all, no one will want to invest projects in a country where such severe restrictions operate.
In addition, according to Afanasyev, the fulfillment of the law has not been thought out.
“It is very important which counters will be used during the calculation of the number of visitors to the site,” he explains. - There are completely simple counters who calculate how many times people have entered this site. But they often do not identify the uniqueness of visitors, who are sometimes replaced by robots. Therefore, it is still unclear which meters the state will pay attention to. Of course, this should be thought out in advance. However, today the authorities do not only have the technical mechanisms of the implementation of the law, but also, for example, approved requests that they will send to Internet companies in case of claims.
The deputies themselves will fall under the law - many lead their LiveJournal or actively write in social networks. Deputy Chairman of the State Duma Committee Vladimir Burmatov , for example, has more than a hundred thousand subscribers on Twitter.
“If a“ letter of happiness ”comes to me from Roskomnadzor, I just calmly register in this registry,” said Burmatov, “I have my blogs as so.” Since the main theme of my materials is anti -corruption investigations, they are often sued me. But I have not lost a single case yet, because I very carefully check the information that I publish. So for me personally, the law will not change anything.
Opposition politicians who lead their blogs are much more categorically expressed to the new law and are sure that it is directed against them.
“This law proves the suppression of the authorities of any manifestation of dissent,” says Ilya Yashin, a member of the RPR-Parnas . - This is just a challenge to people who do not want to go in the same system with the state and listen to propaganda. Instead of fighting the causes of protests, the authorities are fighting protesters. I believe that bloggers will find loopholes to circumvent this law. After all, people from Belarus and China express their opinion on the Internet ...
Most bloggers agree: people who do not write about politics will not affect this law. This is also confident in Sergey Dolya , the author of the blog in Livejournal under the name "Page of Virtual Travelers." In a new commentary, he noted:
- One of the goals of the law is to force people who write on political topics to carefully check their information. And all the materials that I publish consist of information created only by me: of photographs and short stories. Therefore, I am sure that this law will not affect me, since the state is interested in slightly different topics.
It should be recalled that the law was adopted, despite the rather strong resistance in the State Duma.
“A blogger is an individual, a private person who communicates with his friends,” said Mikhail Emelyanov, deputy chairman of the Just Russia faction after the second reading. - And this is impossible to deal with the wrong information that bloggers distribute. For this, there are laws that apply to individuals.
Many public and political figures are evidenced by this contradiction, emphasizing that, introducing such laws, it is impossible to regulate the flow of information that private individuals have the right to express in the Internet space.
