Blocking Kasparov.ru is recognized as legal

The judge of the Khamovnichesky District Court of Moscow German Bugynin recognized the legitimate blocking of the online newspapers Kasparov.ru, undertaken by Roskomnadzor at the request of the Prosecutor General’s Office. This was reported by the publication itself. The lawsuit of the newspaper against supervisory departments was rejected.

During the meeting, the representative of Roskomnadzor explained that on March 13, they sent a notice to the publication blocking operators, and later - clarifying with an indication of the network address and the page with “prohibited” information.

Lawyer of the Agora Association Damir Gainutdinov, representing the interests of the newspaper, noticed, however, that the document represented by Roskomnadzor does not have justification of the blocking, as well as links to specific pages containing “prohibited” information. “These requirements are illegal,” Gainutdinov concluded.

The prosecutor, in turn, insisted that the publication was known about the causes of the measure. As Gainutdinov specified the “faces”, the site was blocked due to illustration to the news notes “ ” Ukrainian state property will be nationalized in Crimea . ”This illustration supposedly calls on the residents of Crimea to participate in mass inconsistent actions.

At the same time, representatives of the defendant claimed that the lock founder Harry Kasparov to disseminate information did not violate the law, since users have access to publication publications through the mirrors of the main site and in social networks. Meanwhile, at the disposal of the Prosecutor General’s Office, it was required to block not only the main site, but also the mirrors.

The representative of Roskomnadzor also stated that to relieve blocking from the resource, it is enough to remove the illustration and report this to the department. The official of the Prosecutor General confirmed this. Meanwhile, noted Gainutdinov, the head of Roskomnadzor, Alexander Zharov, in a recent interview with Vedomosti, claimed that restoration of access to the site is possible only after a separate decision of the Prosecutor General.

On August 12, hearings will be held in the Tver District Court of Moscow on a similar statement of the "Daily Journal". The plaintiffs in this case are the authors of the publication - Georgy Satarov, Nikolai Svanidze and Viktor Shenderovich.

"Daily Journal", like Kasparov.ru, was blocked on March 13. Then the authorities closed access to the "faces" and the blog of Alexei Navalny. On April 11, the Lublin District Court of Moscow recognized the blocking of the Blog of Navalny legal. On May 6, the same decision was made by the Tagansky district court of the capital in the lawsuit of the "faces" .

On June 9, the Tver District Court rejected the lawyer of the leader of the Pirate Party of Russia Pavel Raydov to block all four resources. Judge Ilmira Mustafina indicated that the decisions of the Prosecutor General and Roskomnadzor do not violate the rights of reason to free access to information.

On June 23, the Novo-Savinovsky District Court of Kazan rejected the claim of the reader of the "faces" Bulat Mukhamedzhanov, filed in connection with the blocking of the publication.
