The ECHR communicated the complaint about the administrative detention in the Bolotnaya

The ECHR Comminized the complaint of civil activist Yevgeny Frumkin against illegal administrative detention on Bolotnaya Square during the rally after the Million Million on May 6, 2012. It is reported by the "Memorial", which, along with the European Human Rights Protection in London, represents the interests of the applicant. Questions to the Russian authorities were sent on August 28; Representatives of Frumkin received a corresponding notification on September 5.

In particular, the following questions are asked Russia: “What was the procedure for coordinating and ensuring security before the rally, during and after it?”, “Why was the demonstration stopped?”, “If this was related to serious violations, are the reasons for these violations, their nature and the scale?”, “Was the decision to stop and disperse the rally substantiated?”

In addition, the ECHR is interested in whether the investigation of events on May 6 was carried out. In case of a positive answer to this question, the court expects the relevant documents from the Russian authorities, including video materials.

The answer, as well as comments on the complaint, Russia must submit to Strasbourg no later than January 15, 2015.

Frumkin was detained in Bolotnaya along with hundreds of other demonstrators. On May 7, 2012, the magistrate of the 396th section of the metropolitan district of Yakimanka Gleb Sibirev arrested the activist for 15 days in part 1 of Article 19.3 of the Code of Administrative Offenses (disobedience to the legal request of the police officer). On May 11, the judge of the Zamoskvoretsky district court of Moscow Natalia Susina left this decision in force .

In his complaint to Strasbourg, Frumkin accused Russia of violating articles 11 (freedom of assembly and peace associations), 6 (the right to a fair trial), 13 (the right to an effective means of legal protection) and 3 (prohibition of torture) of the European Convention.

The ECHR has united the case on Frumkin’s complaint with cases opened by similar appeals of seven applicants, including Alexei Navalny.
