The deputy chairman of the Chertanovsky District Court of Moscow, Julia Chernikova, sentenced the leader of the defense League of Moscow Daniil Konstantinov to three years in a colony-settlement, but decided to apply an amnesty to him and release in the courtroom. Chernikova re -qualified Konstantinov, finding him guilty not in part 1 of Article 105 of the Criminal Code (murder), but under paragraph "A" of part 1 of Article 213 (hooliganism with the use of weapons). The maximum sanction for this crime is five years of colony.

The guilt of the murder of 24-year-old Alexei Temnikov considered the guilt of the judge unproven. Applications of the prosecution that the defendant had stabbed Temnikov with a knife, did not find confirmation, Chernikova noted. According to her approval, it was only established that Konstantinov beat Temnikov, causing his light bodily injuries, and also spat on his jacket and threatened him with a knife.

The undeniable Alibi Politzeck, who was at the time of the crime at the other end of the city, was ignored, saying that she was evaluating the testimony of witnesses to the defense critically.

“This is the maximum that could be done,” Constantinov, Constantinova Denis Zatsepin, commented on the result of the trial. The same opinion was expressed by the father of the convict, politician Ilya Konstantinov. “There are no acquittal sentences - this is the maximum that the court did,” he remarked.

Konstantinov was in prison since March 22, 2012. The prosecution claimed that on December 3, 2011 near the metro station of Akademika Yangel, he hit Temnikov with a knife several times. In fact, Konstantinov at this very time celebrated his mother’s birthday in the restaurant, which is confirmed by testimony.

Konstantinov did not plead guilty. In the factory of the case, he accused the TSPE operatives, explaining that in this way they took revenge on his refusal to cooperate.

The key witness of the prosecution was 23-year-old repeatedly convicted by Alexei Sofronov. In 2012, having given the testimony necessary for the investigation, he was twice accused of a series of thefts with a hack, but both times received conditional terms. In July 2014, speaking at the process of Konstantinov, Sofronov was confused in the testimony .

The case of Konstantinov was listened to the Chertanovsky District Court. The first process was held in June - December 2013. At that time, the prosecutor also demanded 10 years in a maximum regime for Politzek, but Judge Galina Turkinareturned the case for the investigation . The basis for such a decision, she called the shortcomings in the indictment. The new process of Konstantinov began on May 27 .

At the beginning of this week , Politzek’s lawyers appealed to the Strasbourg court with a complaint about the maintenance of their client in jail for two and a half years. “We indicate in the complaint that according to the legislation of Russia and international standards, such a period of detention for the preliminary investigation should be determined by exceptional circumstances or special complexity of the investigation,” said one of the defenders, Damir Gainutdinov. “There is no other in the case of Konstantinov.”
