Not for crimes

The Moscow City Court on Tuesday softened the verdict to the nationalist Maxim Martsinkevich (known by the nicknamed "Tesac") from 5 years in prison to 2 years and 10 months. The court also retrained the charges with Part 2 of Art. 282 of the Criminal Code on Part 1. Behind the bars, Martsinkevich has been located for more than a year. Convicted for posting extremist videos on the Web.

The solution can be considered the victory of the defense of "Tesak". The lawyer of Martsinkevich Alexei Mikhalchik asked to send the case for a new consideration, or change the qualifications of the prosecution, since there are no victims in the case. If the sentence is upheld, he asked to mitigate the punishment.

OVD-info understood the adventures of Tesak-on the one hand, one of the most ardent propagandists of violence among the ultra-right, on the other, on the bench of the defendants who looked almost political prisoner.

"Format18"

Martsinkevich - born in 1984. “Both mom and dad are engineers, grandparents engineers, one grandfather is even a scientist,” writes Tesac in the Autobiographical Book “Restructure”. One of the grandmothers, according to “Tesak”, “liberal, went to pickets in support of Khodorkovsky.” Martsinkevich himself also studied at the builder-builder, but was expelled from the university in the heat of the political struggle. He leads a healthy lifestyle, has been playing sports for many years. He was taken to the army, but commissed with a “white ticket” for Nazi antics.

In his youth, evolved from the Tolkienists to Nazi-Skins. “Tesak” participated in many fights, described his adventures on the Web. In addition to street violence, Martsinkevich is a veteran of propaganda Nazi projects.

Martsinkevich began in the People’s National Party (NNP) Alexander Ivanov-Sukharevsky (film director with a failed career), was in the leadership of the Youth Section of the NNP. The second half of the nineties and the first-the zero were replete with dwarf parties, who wanted to represent the interests of the Nazi-Brigatovs. The type of their leader is a middle -aged man with numerous complexes, who recognized himself as a “Russian Fuhrer”. Such "Hitlers" easily came across provocations of law enforcement officers and political strategists, and their parties fell apart under the load of criminal cases.

The NNP was the largest in this spectrum, had a network of regional branches and contacts with a pair of State Duma deputies. When in 2003 the election was hastily created by the “Motherland”, NNP members were used as a lower asset. Apparently, for certain promises to Ivanov-Sukharevsky, who were not going to fulfill-many ultra-right were thrown out of the list of "homeland" on the eve of the elections.

With this conflict, the associates of Sukharevsky associate a small explosion that occurred in October 2003 in the NNP office, located in the apartment on the ground floor in a high -rise building near the Belarusian station. As a result of the explosion, the party leader blind on one eye. By the middle of the zero NNP, it froze from futility and a squabble.

In 2005, Martsinkevich launched his own project - the creative association "Format18" with Hitler on the logo. “18” is an international nazy encryption denoting Adolf Hitler. At first, Alexander Potkin helped Martsinkevich with hosting and video equipment, but they soon quarreled.

Format18 had an active forum, several dozen users of which together played sports, talked, and held fees in nature. A number of characters from this company were later behind bars for racist crimes.

Martsinkevich writes in his book that he had met young men convicted of racist murders. They told him that they were killed, inspired by his videos. One of the cellmates of Martsinkevich even called him an imam: they say, “Tesak”, like Wahhabi imam, is propaganda, and then young people arrange murders and sit on life. And the “Tesak” does not repent of this at all. Martsinkevich writes that Format18 at the peak of popularity was the most promoted ultra -right portal in the world. We can talk about dozens of racist murders committed by young people who constantly visited the site of the Creative Association.

The main products of the Tesak studio were racist videos, savoring and promoting violence against Untermen. The videos were a frantic success among the target audience. Many stories of Martsinkevich were staged, or recorded small fights with his participation. But he was sent by their shootings and fans, and real beatings were captured on these videos, often clearly with severe bodily harm at the victims.

Martsinkevich concluded the union between “format18” and the National Socialist Society (NSO). At the end of the zero, the NSO members turned out to be defendants in cases of dozens of racist murders - apparently, this was one of the reasons for the police interest in Martsinkevich.

NSO and Format18 led a strange and aggressive campaign against competitors - Alexander Potkin and Dmitry Demushkin. Material texts on the Web, smearing the door of Demushkin’s apartment, spreading the porno-roller from one of Demushkin’s associates (and the former girl “Tesak”), etc. This activity strained the current leaders of the “Russians” movement. As it later became known from the correspondence of Alexei Navalny posted into the network, Alexander Potkin, who spoke with him, sought the landing of Tesak.

Martsinkevich also bothered the more influential people than Potkin: Tesaku managed to gather almost a thousand people to confront the liberal anti -fascist rally on Bolotnaya Square on November 4, 2006. He dispersed the Nazis riot police. And in the summer of 2007, Martsinkevich became the main network Piarwoman “Arrows of Russians and Caucasians on the Manezhka”, which ended with a mass fight at the Khiva-Gorod metro. In the summer of 2007, Tesak was arrested.

The first time

Courts over Martsinkevich are examples of incompetence of the Russian law enforcement system. They tried to receive testimonies about the subversive activities of Boris Berezovsky in Russia, without investigating the real crimes to which the Tesac could be involved. The police could not find anything about the law enforcement officers in which Marcinkevich participated before the creation of Format18.

None of the Format18 was attracted to criminal cases about the raider war for the house at 4 Skhodnensky dead end, 4 (about a dozen were opened). There, NSO and Format18 had an office and a gym provided by one of the parties to the conflict for a multi -storey building near the Tushinskaya metro station. Anatoly Cher, the director of the organization of assistance to the disabled, from whom the building was selected, repeatedly wrote statements to the police about the attacks made by the Nazis. Cher died in December 2011: leaving the bus, he received an impetus from the man leaving after him. Cher fell, hit the car standing nearby and died in the hospital. The man who pushed him was not found by the police.

Marcinkevich participated in the attack on the anti -fascist Ivan Khutorsky (later shot in the entrance of his house). He was injured, including a cut head wound. Khutorskaya wrote a statement to the police, but it disappeared into the Yakimanka police department.

Martsinkevich posted for propaganda purposes on the Web dozen video recordings of cruel beatings “Neslavyan”. Obviously, “Tesak” could be judged as an accomplice in all these acts. Beats were performed and starred on the video for extremist propaganda. Placing these videos, the “Tesak” became an accomplice in the crime. But law enforcement officers did not go this way, although they banned the “format18” as an extremist organization in 2010, when the “creative association” has not led any activity.

Martsinkevich served 3.5 years in two strange matters - about the scream "Zig Hale!" And Mother's insults on the debate in “Bilingu” (the statement to the police wrote Alexei Navalny, Ilya Yashin and Maria Gaidar, and, for example, Julia Latynina, who was present on these debates, refused to testify, considering it below her dignity) and the video about the “Russian Klux-Klana” with a hung hanging “Tajik drug dealer”. The video about KKK “Tesaku” ordered Ren-TV channel for money (ordering a video, television people could not help but understand that there was no CKK in Russia). Television men gave a video on the air and immediately wrote a statement with a request to check the video for extremism.

The enemy of protest

“Tesak” was released on December 31, 2010. Until December 2011, he was mainly engaged in the help of the ultra-right prisons, but with the beginning of the white-lane movement again became politically active.

Both among the Nazis and Antifa, they started talking about the fact that the “tesak” had high -ranking patrons. Indeed, the story with the “bilingual” looks doubtful: first, from the club in which there was a couple of hundred people, they could not put the brawle “Tesak” with a dozen associates, then they wrote a statement on them, according to which Marcinkevich received a prison term. The statement was written by Navalny, the new leader of the opposition. Martsinkevich had a tooth on Navalny, and, apparently, it was beneficial to some of the “curators”.

Martsinkevich and his friends at the end of 2011 and 2012 made minor hooligan provocations against “whiteworms”, launched trolling campaigns like Martsinkevich’s promotion in online voting for preferred speakers at protest rallies, tried to register him with a candidate for the opposition Coordination Council. Martsinkevich shot videos that, they say, “United Russia”, of course, “sucks”, but the “white -based” is no better.

Marcinkevich became a TV star. Then several anti -pedophilian initiatives appeared, using the correspondence with pedophiles on the Internet on behalf of the children to lure them for a meeting, but it was “pay for pedophilia” by Martsinkevich that became a leader among these projects. The shares used practically professional shooting equipment, the Marcinkevich reports began to be shown on federal television channels - well -known tough censorship - and in the mirror of Russian TV, he turned from a neo -Nazi into a “tough representative of civil society, a fighter with debauchery”.

The ultra -right businessman

Unwatted on TV, Tesak acquired a brutal-glamorous gloss, began to be shot in commercials for the Internet. I advertised a lot - from sports nutrition for bodybuilders to night delivery of alcohol. On the basis of trolling, the opposition made friends with Sergey Mavrodi, the creator of MMM. Tesak launched its own small pyramid on the Internet - Tesakmoney - and also advertised other pyramids. Shortly before the emergence of a new criminal case, he shot a series of videos with an appeal to help him become a Russian representative of the Finnish company Kyäni, operating on the principle of network marketing and selling dietary supplements. “Tesac” promised that with the help of Kyäni it will seriously increase the financing of ultra -right projects in Russia. This could cause the concern of law enforcement officers by Tesak.

At the same time, Tesak reduced the activity in the field of trolling of the opposition. Even when Alexei Navalny, his main target, became a candidate for Moscow mayor, Tesak only shot a couple of videos, and, as the head of the Moscow Organization of the Party of Progress Nikolai Lyaskin told the OVD-Info, only once tried to protest at the headquarters of Navalny once.

In the fall of 2013, a new criminal case was opened on Tesak, and Martsinkevich from the “fighter with pedophiles” again turned into a Nazi for TV. Although in 2012-2013, Martsinkevich did not abandon his views and at the same time “pedophile” created the National Socialist movement “Restructure”.

In addition to the versions that “Marcinkevich was lazy and stopped fighting the opposition”, as well as the interest in the financial activities of the “Tesak”, among the possible causes of the criminal case - that the “pedophilia” really caught a couple of middle -level officials in unpleasant situations, and their parties to the “tesak” were also not excluded. The stories that could tire the police.

Xenophobia again

In the case of the current criminal case against Tesak, the story repeated. The police did not take up his “pedophilia”, whose activities can obviously be a lot of questions - and again accused Tesak of promoting xenophobia.

OVD-Info will not give links to rollers for which the Tesak is convicted, but those who wish can find them-they are in the public domain. These are reviews for the films "Stalingrad" and "Near Football", as well as the video "throw a chuck". Reviews for films were made as part of a commercial project: one cinema hired Martsinkevich as a reviewer of the films shown in it.

There are Xenophobic calls in the videos, but how many of them were during the election struggle for the post of mayor of Moscow? And after the events in Biryulyovo? Even considering that this is the third criminal record of Martsinkevich according to the 282nd article, was it adequate for the sake of these videos to achieve his extradition from Cuba (where the “Tesac” was hidden) to Russia? Is the verdict in the 5th years of a maximum security colony for them? (Tesak received so much in August 2014 in the Kuntsevsky District Court).

The Center "Owl" does not attribute the Martsinkevich business to "unlawful anti -ethrrusism." In a conversation with the OVD-Info, the director of Owl, Alexander Verkhovsky noted that, of course, the verdict is as tough as possible, but possible. This position is clearly vulnerable.

“The examination of the videos was conducted by the Institute of Culturalists, which is not a state expert institution, which is a formal violation,” Matvey Zen’s lawyer Matvey Zen told the OVD-info.

“Experts Natalya Kryukova and Vitaly Batov are not experts in the right areas. Kryukova is a teacher, Batov is a psychologist. Not being professionals either in philology or in linguistics, they apply “innovative” methods of identifying the meaning that come down to this: “He said something against blacks, it means that this is incitement”. The examination, which was conducted in Marcinkevich, has a serial number 389 and was carried out on December 30. It is known that the numbers of examinations are updated once a year. It is completely clear that it is impossible to conduct more than 300 qualitative examinations in a year, ”the lawyer notes.

Experts Kryukova and Batov, indeed, are not the best reputation. For example, their activity is criticized by Alec Epstein, author of the book “Police of Thoughts”, a detailed study of “extremist” criminal cases.

Here is one of the examples of their expert activities in criminal cases against the National Bolsheviks to the zero: “And here are the conclusions, Natalya Kryukova and Vitaliy Batov, regarding the leaflet“ kill the slave ”:“ Graphically emphasized the word “kill!”, Which is read primarily from the graphic location of the exclamation mark primarily as a separate one. The rest of the text is not expressed [sic!] And is read only by particularly curious [sic!]. The background of the poster is the silhouettes of armed people in aggressive poses. Thus, the entire semantic load of the poster is in a call to violence (murder). ”

Even before Martsinkevich’s “Opala”, the signatures were called with the call to stop the pedophile, whose activists carried out reprisals of varying degrees of rigidity against homosexuals and people suspected of pedophilia. Law enforcement officers signed the appeal did not give intelligible answers whether the activities of Martsinkevich would be investigated.

PS at the end of October, Martsinkevich brought another criminal case - for one of his videos of numerous videos with humiliations of their heroes. It looks like belated and incomplete, but still an attempt to give a legal assessment of the creativity of “Tesak”.
