A second case has been opened against Tatyana Kotlyar, a human rights activist, a member of the Migration and Law Network of the Memorial Human Rights Center, a deputy of the Obninsk City Assembly, due to the fact that she registers in her apartment migrants who are participants in the State Program for Assistance to the Voluntary Resettlement of Compatriots Abroad. As a movement site, fictitious registration of a citizen of the Russian Federation at the place of stay or place of residence in a residential area and fictitious registration of a foreign citizen or stateless person at the place of residence in a residential area; fictitious registration of a foreign citizen or stateless person at the place of stay in a residential premises
because “Civic Assistance” states , if in the first case there were at least formal grounds for investigation, then the second case was initiated illegally: Kotlyar is charged with crimes under Articles 322.2 and 322.3 of the Criminal Code (f), while the registration in which she is accused, took place before the inclusion of these articles in the Criminal Code. According to the investigation materials in the first case, Kotlyar submitted an application to the city department of the Federal Migration Service for the registration of three foreign citizens without the intention of providing them with living quarters for their stay; she was not the host party with foreign citizens actually live or work, she did not provide her apartment for living to the above three persons, foreigners, in turn, did not move into the apartment and did not live in it. In this case, they tried to send the human rights activist for a psychiatric examination, but then the corresponding decision was canceled.
Kotlyar states that there is no place for those coming to the Kaluga region under the federal program to register, so she is forced to register them in her own apartment. She believes that criminal prosecution is pressure on her as a civil activist and human rights defender.
