
The lawyer of the head of the AFC “System” Vladimir Yevtushenkov said that his ward may be amnestied in honor of the 20th anniversary of the Constitution of the Russian Federation, but he has not yet planned to apply to the investigation with the statement.
According to this law, the initiative of amnestration can come from both the investigation and the protection of the defendant of the criminal case. The lawyer noted that the amnesty according to the law does not require guilty.
“There is no such condition as a guilt. The law indicates the consent of the application of an amnesty, but this does not mean that a person pleads to guilty. An elderly person tired of procedural ordeals can decide that I am tired, my health and my loved ones are more expensive, and consent to the use of an amnesty,” Interfax told businessman Alexander Gofstein. According to him, until the issue of amnesty has become relevant, but in the future he can turn to the investigation with such a request.
Today it became known that the former CEO of Bashneft, Ural Rakhimov, who was in Austria, testified in absentia in the case of Bashtack’s assets, including $ 500 million on a discount. "Ural Rakhimov gave written testimonies through his lawyer," the agency’s interlocutor said.
Witnesses indicate Yevtushenkov’s knowledge and involvement in the commission of a crime, they previously said in the Basmanny court. The ex-head of Bashneft, Ural Rakhimov, together with the entrepreneur Levon Ayrapetyan, developed a criminal plan for the theft of shares of enterprises of the Bashkiria FEC. And Yevtushenkov, according to the investigation, organized the legalization of property received by criminal means.
Meanwhile, AFK Sistema decided to file a lawsuit against the companies of the Urals Rakhimov, from which Bashneft shares were acquired in 2009.
AFK Sistema entered the capital of Bashneft in 2005, when it acquired for $ 600 million the blocking packages of Bashkir FEC enterprises from Bashkir Capital, the main owner of which was considered Ural Rakhimov, the son of the former president of Bashkiria, Murtazi Rakhimov. According to investigators, this company was sold AFK Sistema in 2009 by $ 500 million cheaper than a contract price. Instead of $ 2.5 billion, 2 billion was paid. The arrest was imposed by the Basmanny Court as part of the case initiated by the Investigative Committee of the illegality of the privatization of Bashtack companies.
In August, the Investigative Committee opened a new criminal case under Article 174 of the Criminal Code of the Russian Federation ("legalization") on the sale of shares of the Bashtack "System". In September, the First Deputy Prosecutor General Alexander Kilsman filed a lawsuit in the Moscow Arbitration Court to make Bashneft shares in favor of the state.
It should be noted that the chairman of the board of directors of the AFC System Vladimir Yevtushenkov since September 16 has been on house arrest. According to investigators, the businessman organized the sale of Bashkiria "Bashneft" at the FEC at a deliberately low price in 2009. As reported, the defendants in the criminal case on Bashneft are also the deputy head of the Board of Directors of the AFC System Alexander Goncharuk and the senior vice president of the company Sergey Drozdov. The criminal case was also instituted against the former head of the Bashneft of the Urals Rakhimov, the son of the first president of Bashkiria, Murtazi Rakhimov, as well as entrepreneur Levon Ayrapetyan. Ayrapetyan was detained in July this year.

Previously, the reasons for the satisfaction of the claim of the General Prosecutor's Office of the Russian Federation were not known.
On December 2, the Moscow Arbitration Court refused the petition of AFK Sistema to remove the arrest from the Bashneft shares, the Arbitration press service told TASS, abandoning additional comments. AFK asked to remove the arrest "in order to voluntarily enforce the court decision on the transfer of shares" Bashneft "to the state.
The investigation period in the Bashneft case was extended until April 28, 2015. What will happen next with "Bashneft" is unknown. 70 days after the court decision entered into force, the government will be able to appoint a general meeting of shareholders, which will be reinvented by the Board of Directors.
