
The ECHR Comminized the complaint of paralyzed Vladimir Topokhin, due to illness released from the conclusion, to the torture conditions of the detention in the Moscow pre-trial detention center "Sailor Silence" and IK-1 general regime in Kostroma. This was reported by an open news agency with reference to lawyer Irina Khrunova, who represents the interests of the applicant in Strasbourg.
In his complaint, Tophin accused Russia of violating Article 3 (prohibition of torture) and 5 (the right to freedom and personal integrity) of the European Convention in his regard.
The Strasbourg court asked the Russian authorities five questions. First: what measures were taken by the administrations of the "sailor of silence" and IK-1 to alleviate the suffering of the patient? Second: who helped Topikhin in his daily needs, such as eating, cleaning, toilet? Third: was everything done by the state to provide the applicant with the necessary medical care? Fourth: Was the state of health of the patient with the conditions of detention in the colony compatible? Fifth: Was the conditions for the transportation of Topekhin from Moscow to Kostroma Article 3 of the European Convention corresponded?
Topekhin was arrested in July 2013 under part 4 of Article 159 of the Criminal Code (fraud on an especially large scale). Shortly before the arrest, he crashed by car, having received a traumatic brain injury, as well as damage to the spine and internal organs. In the metropolitan pre-trial detention center-2, Butyrka, the patient's condition was seriously worsened. The lower body and arm were taken from him.
In November 2013, Topokhin was transferred to the hospital of "Sailor's silence." There, thanks to the care, his condition improved slightly. However, then it was placed in the common camera of the SIZO-1. The patient was taken several times for examination to the 20th City Bollard, and each time the doctors did not find grounds for his release.
On January 13, 2014, at a visiting meeting at the Sailor Silence, the judge of the Tver District Court of Moscow Tatyana Nevarova sentenced Topokhina to six years of general regime. On February 20, the Moscow City Court, having examined the appeal of lawyer Svetlana Sidorkina, reduced the convicted time to four years .
In May, the administration of the Kostroma IK-1 appealed to the Sverdlovsk District Court of the Regional Center with a petition for the liberation of Topokhin . After the patient arrived in the colony, the FSINITS conducted his medical examination, which established that the diagnosis of Topokhin was mentioned in the list of diseases, the presence of which is the basis for exemption from serving the sentence.
On July 3, Judge Alla Kudryashova satisfied the petition of the FSINITS . However, the prosecutor's office appealed this decision.
Nevertheless, the Kostroma regional court on August 26 left Kudryashova’s decision in force , and Topokhin was released.
