The FSB officers took a Dagestan student from Moscow and delivered to the Stavropol pre-trial detention center: he became a suspect in the case of recruiting fighters to Syria. A few days later, the doctors removed the pen, which was fully included in his skull. Traces of torture were found among other defendants in the case.

Arrest in Moscow

On the morning of Friday, November 21, the fifth year student of the Stavropol State Medical Academy Magomed Aliyev, together with his older sister, went to work: 21-year-old young people were interested to observe colleagues from the capital. He came to Moscow just a week ago to treat his health, explains the student’s relative: “He had kidney stones, ate anything, because of which fainting began to occur recently.” Leaving the Porovo metro station, Aliyevs headed to Metallurgov Street, where the dental clinic is located. Before the entrance stood a large man in headphones and a fastened jacket. When Aliyevs came closer, he blocked their way.

“Suddenly, absolutely silently, he swung his right hand and hit his brother, then grabbed him and knocked him on the asphalt. I did not understand what was happening, I tried to grab him by the jacket, pulled off my hat and fell when I felt a blow to my left shoulder. Then other men ran up, his brother twisted, and one of them took me by the elbow and says: “The police,” the Aminat recalls. People in civilian clothes, who introduced themselves to the operatives, but did not name their surnames and did not show certificates, plunged Magomed into the Blue minibus Ford. The Aminat was asked to give a hat to the man who attacked her brother and put him in another car.

The driver introduced himself as an “operarian Alexander” and explained that they were going to Aliyeva’s apartment for a search. On the way, the Aminat managed to call her wife Kiram, who at that moment was at home and met the security forces: in all, according to him, eight cars arrived. One of the men who were waiting in front of the entrance explained to Aliyeva that he was an investigator of the Stavropol Office of the FSB, and he needs to spend a search in their apartment in order to look at her brother's things. However, the investigator did not have a court decision on the search, so the Aminat rose into the apartment and locked it from the inside.

Kiram called a acquaintance as a lawyer and remained waiting on the street. Several operatives probably left for the decision, the rest - the investigator in the same car and three more men in a minibus - remained to wait. “I tried to take a picture of the car because it was with ordinary numbers and without a police design, they flew out of there, forced to wipe it. I immediately did it, after which they asked to give a passport. One at the same time grabbed a combat gun, the other a stun gun. I realized that you should not resist. At that time I was really scared. At this time, my sister’s son drove up, they also took his passport from him, and then we began to ask questions rather rudely: “When did you come from Dagestan? Is there registration? Were they brought to justice earlier? ”Kiram recalls.

The lawyer, Arthur Gereyev, who arrived soon, also could not convince the operatives to show official certificates. Almost simultaneously with him, a district police officer appeared in front of the entrance. According to Kiram, he asked him to allow a search without a court order, but with a recording on a video camera and a decision of the witnesses. The Aminat at that time phoned “02” and talked about the abduction of her brother. When the PPS employees drew up a protocol on a crime report, only the same car that was trying to photograph Keram remained before the entrance. However, he left by 17 o’clock. On the same day, the investigator of the Stavropol Department of the FSB - as it turned out, his last name Uvarov - drew up a protocol on the detention of the suspect. “The basis of the detention was the fact that eyewitnesses pointed to Aliyev as a person who committed a crime,” the document said at the disposal of the Mediazones. During the search, Magomed seized the club card "Sportmaster", the Sberbank card and 5,600 rubles. According to the protocol, after the detention of Aliyev, he was sent to the IVS of the Stavropol Department of the Ministry of Internal Affairs.

A search in the apartment did not take place the next day. Although the document says that his mother and sister were notified of the location of Magomed on the first day, to find out where the student was located, relatives managed only after the weekend, November 24. The other sister of the detained Jamil, living in Stavropol, told lawyer Olga Kamilova about the situation. From the local department of the FSB, she learned that Aliyev was already in the Stavropol pre-trial detention center-1.

As it turned out, he was arrested the day before, on Sunday - until January 13, 2015. Kamilova managed to visit his client in the insulator only on Tuesday. “It was on the beatings of the beatings, for example, a hematoma on the left eye. I also became aware that mental pressure methods were applied to it. It is obvious that unlimited methods of conducting the investigation were applied to it. His mental state said that he was very scared, ”she says. Seeing Magomed, the lawyer wrote a statement addressed to the head of the pre-trial detention center-1 on the need to conduct a psychological and medical examination of the detainee, but she still has not received an answer.

Propaganda of terrorism and

The case, among the defendants whose 21-year-old Aliyev turned out to be, was opened on November 15 on the basis of the report of the Stavropol Office of the FSB, compiled a day earlier. According to the document, last spring, Aliyev, seven more people and “other unidentified persons, acting from religious motives, with the aim of promoting the ideas of Wahhabism and the declension of persons to join illegal armed groups in the Syrian Arab Republic, united into a united group - the so -called Jamaat.” According to the text of the decision, the participants of Jamaat appointed 29-year-old Shamil Umakhanov.

As stated in the document, in December last year, Umakhanov, Aliyev and two more suspects, being supporters of Wahhabism, “having taken intent to promote terrorist activity”, “through persuasion, calls for religious unity, solidarity and unity”, “inclined” two men at the age of 23 and 22 years to participate in the armed group in Syria.

Both gave their consent, and, according to the FSB, in mid -December they left for the Middle East, where they joined the detachments of Jamaat Abu Hanifa, named after the founder of one of the four Sunni jurisdictions - Hanafite Mazhab. The chairman of the Islamic Committee Heydar Jemal about the existence of this Jamaat is not known. In an interview with Mediazona, he noted that in the Stavropol Territory, special services work more actively than in many other Russian regions.

But, judging by the records on Islamist forums, Jamaat with this name really exists and is one of the many groups within the Islamic State, the author of the investigation on the “apparatus” website on the propaganda of ISIS in VKontakte journalist Vitaly Vasilchenko told Mediazone. He explained that the leader of Jamaat is called Emir Abu Hanif, nicknamed Ozbakastani, which most likely indicates his Uzbek roots. Probably, on October 3, the leader of this Jamaat died during the battles for the Kurdish city of Kobani on the border of Syria and Turkey: then the United States was first used by Aviuaudars.

Basically, in Jamaat Abu Hanifa, you can meet immigrants from Russian -speaking countries - Russia, Turkey, Georgia, Uzbekistan, Tajikistan. It is difficult to accurately determine the number of this group, but it is obvious that Abu Hanif is not the most noticeable figure among Islamists. In jihadist forums, he is called one of the most severe representatives of takfirism - the most radical and orthodox direction in Islam, based on accusations of other Muslims of non -compliance with Sharia, Vasilchenko explains. Arabic-language forum users often mention that Abu Hanif accused Abu Bakra al-Baghdadi of insufficient faith. From this we can conclude that his jamaat includes radically fanatical Islamists, Vasilchenko summarizes.

In June 2014, four defendants in the case, “continuing to realize their criminal intent,” gathered in the same apartment and convinced two more people to Syria, the document says. According to investigators, they also gave their consent, already four days later they went to the Arab Republic and joined the Jamaat Abu Hanifa. The actions of Umakhanov, Aliyev and two more defendants in the case, the investigator of the FSB, according to the decision, qualified under Part 1 of Art. 205.1 of the Criminal Code of the Russian Federation (declension, recruitment or other involvement of a person in terrorist activities or in participation in illegal armed formation), they face up to 10 years in prison. The criminal prosecution of men who allegedly agreed to leave for Syria is not said in the decision. Probably, the case in their relation is in separate production. At the same time, the Aminat confirms: two friends of Magomed Aliyev really left for Syria or Turkey. However, her brother, she says, "was very surprised by this decision and could not understand why they were doing this."

At the same time, the defendants in the case, including Aliyev, are accused of a more difficult article of the Criminal Code than other combatants in Syria. So recently in Kabardino-Balkaria a verdict was sentenced under the article Mercenary to Murat Nagoev . He received four years in a general regime colony. The maximum punishment under this article is eight years of imprisonment.

According to lawyer Kamilova, Magomed Aliyev is still in the status of the suspect. At the same time, the decision on the election of a preventive measure states that if he was not charged within 10 days, the arrest must be canceled.

In a coma with handcuffs

Aliyev is the only person involved in this case that did not give a confession. According to his sister Jamily, the student of the University of Stavropol was supposed to be presented on Friday, November 28, but the day before, from the pre -trial detention center he was in intensive care, where he fell into a coma. “A foreign body has in my head: the handle was stuck through the eyes so that it is practically not visible. She completely entered the eyeball and after the operation the doctors said that the brain was damaged, but this handle did not reach the cerebellum. Tomography shows that, in addition, he was beaten on the head. For six hours he was undergoing an operation: they opened the skull, pulled out the pen, ”says the Aminat. After the operation, the young man was connected to the apparatus of artificial ventilation of the lungs, he still did not come to consciousness. On December 3, doctors tried to get him out of a coma, but Magomed had a temperature of up to 40 degrees and the doctors had to cancel the operation. According to the Aminat, the forecasts of doctors are disappointing: "There may be deep disability, brain edema, meningitis and a fatal outcome in the future."

The Aminat claims that after delivery to the intensive care unit of traumatology of the Stavropol Hospital No. 4, Siloviki-employees of the Ministry of Internal Affairs or the FSB-tried to transfer Magomed to the sanitary unit of the SIZO-1, but the doctors flatly refused to get the necessary medical care there. Although more than a week has passed since the tragedy, police officers are still on duty at Aliyev’s house, who do not let anyone inside, except for medical staff. Despite the unconscious state, Magomed is handcuffed to the hospital bed.

According to the head of the press service of the Stavropol Directorate of the FSIN Svetlana Klinchaeva, Aliyev suffered a uvechye for himself while trying to commit suicide. The interlocutor "Mediazons" claims that this is recorded on the video installed in the content chamber, but it can only be obtained by the official request within the time period established by law. Magomed lawyers have not yet been able to do this. A similar version is voiced by the head of the SIZO-1. “It was a self -mutilation: Aliyev stuck a pen for himself, without hooking the vital organs. He received the rest of the injuries, the bruises of the internal bodies during the detention, he allegedly resisted, ”Nikolai Borisenko, chairman of the Stavropol Public Supervisory Commission (PMC), retells his words. He and other representatives of the Stavropol Commission did not visit Aliyev either in the pre -trial detention center or in the hospital: according to the public leader, he had not yet received mandates of the PMC members.

Doctors do not come to contact, states Jamil Aliyev: from the hospital, the relatives of the victim managed to get only a picture of a computer tomogram. “Probably, they are afraid - around a bunch of police officers, the decision to initiate the case has not yet been canceled, besides, it is investigating its FSB,” she suggests. There is also no answer to the application with the requirement to institute criminal proceedings under the article on causing serious bodily harm yet: the ten -day period established by law has not yet expired. Kamilov’s lawyer is trying to cancel the decision on the election of Aliyev’s measures to be detained in the form of detention, however, a meeting of the cassation instance, scheduled for December 3, was eventually postponed for an indefinite period.

“The case was simply removed from consideration. The judge did not even go into the hall, they already told me in the corridor that it was being deposited. He motivated that Aliyev was not delivered. When I said about the resuscitation, he replied that they did not come to them the documents that he was not in a pre -trial detention center and could not take part in the video conference, so the meeting was simply postponed. I wanted not only to file an appeal, I filed a petition to cancel the decision on the extent of the suppression, since the term of ten days has expired and it is subject to cancellation, but I was forced to go to the district court. The appellate court simply did not consider anything, violating all the norms. Why is this happening? Yes, because they do not care about everything, which is why it happens, ”she complains.

Accomplices

The surnames of all four defendants in the case are in the current list of terrorists and extremists. According to the relatives of Magomed Aliyev, before he was detained on this list. Aliyev and two more defendants in the case of declination to participate in the battles in Syria are young students of the Stavropol Medical University. According to Jamily Aliyeva, they were detained in early November - one on the way to the university, the other in the university itself. Soon students have given a confession. At the university itself, they refused to comment on their arrests. Only Shamil Umakhanov did not study in Stavropol-the 29-year-old imam from the North Ossetian Mozdok, whom the FSB calls the “leader of Jamaat” in Egypt, did not study in Egypt.

According to Brother Umakhanov, who wished not to give his name, Shamil was detained on November 15 in his house 320 kilometers from Stavropol. According to a relative, about 40 operatives arrived to detain the Dagestan. “He was calm at home, already in the evening, he put his little son to sleep, he lay down nearby. His wife was already asleep, she was in the seventh month of pregnancy. Suddenly, a lot of cars in the yard appeared, as if some particularly dangerous criminal, burst, took him right away. The wife was told that they would return it after half an hour, but, of course, they did not come. Then they called and said that he was in Stavropol, ”says the interlocutor of Mediazones. Accusation on the same part 1 of Art. 205.1 of the Criminal Code was presented to Umakhanov on November 20. A few days earlier, in the absence of a lawyer, he signed a confession: according to his brother arrested, they coincide with a decree on the charges.

The Stavropol lawyer Adelina Golovko, whom the relatives of Imam hired to protect him, managed to visit Shamil in the Stavropol Disadine-1. “He had bodily harm. How they are mined, it is impossible to say with confidence, but it comes to mind, of course, the most terrible option. He has a hematoma on his head, that is, they beat with some heavy object, several teeth are broken off. Obviously, he could not do such damage to himself. I could not achieve how he received these damage due to his psychological state, ”she says carefully.

“He had burns on his knees, fingers, nipples, just on his chest. The lower lip was strongly broken, the teeth were knocked out. In general, physically and morally in a broken position, is not like a person. He talked with a lawyer, but he was pressure, and therefore he did not say that he was tortured, although this is already obvious. He signed all the confession, ”his brother adds. The day after the conversation with the Mediazone, Lawyer Golovko will refuse to represent the interests of Umakhanov, referring to health problems.

Explain what exactly Umakhanov is accused of, his brother and lawyer succeeds with difficulty. Golovko believes that the Stavropol Directorate of the FSB called him the leader of Jamaat solely because of his biography. «Я думаю, именно его сделали главарем следователи, потому что он получал образование в Египте и потому что он был имамом, то есть имел какие-то более глубокие знания о канонах ислама, исключительно по данным признакам он был выбран. В деле не говорится о каких-то конкретных действиях по его планам и руководству организацией, этого ничего нет», — поясняет адвокат. Брат имама добавляет, что обвинение полностью строится на показаниях двоих студентов, арестованных в Ставрополе раньше, чем Шамиль.

Умаханов состоял со студентами из Ставрополя в приятельских отношениях, рассказывает собеседник «Медиазоны». «Он постоянно ездил на какие-то строительные работы, чаще всего заказы поступали из Ставрополя. Там они и познакомились, довольно давно. Задержали его в пятницу, а в понедельник он как раз должен был туда поехать: ему здесь один знакомый позвонил, сказал, что есть работа. Но опередили», — объясняет он. По словам брата Умаханова, Шамиль знал об аресте его ставропольских приятелей, но «спокойно себя вел» и не предполагал, что последует задержание.

Адвокат Камилова говорит, что дело Алиева лишь одно из многих, для раскрытия которых применяются недозволенные методы ведения следствия. «Здесь кругом нарушения. Честно, у меня даже руки опускаются. В Ставрополе закон не работает. И мы барахтаемся, как слепые котята, в этом болоте. Никого это не интересует, ни суды апелляционной инстанции, ни кассационной, каждый выполняет свою функцию постольку-поскольку», — жалуется она. Эту тенденцию Камилова связывает с чрезмерно активной работой регионального управления ФСБ.
