
The Russian government approved a list of diseases, in the presence of which citizens cannot be placed in a special meter of the Ministry of Internal Affairs for serving administrative arrest. The document developed by the Ministry of Health is published on the government portal.
Disabled people and blind people were released from serving the arrest. It is also forbidden to arrest the endocrine systems suffering from diabetes or other diseases in severe form, impaired blood coagulation, oncological patients at the fourth stage, epileptics. Also an obstacle to serving the arrest is severe skin diseases and systemic lesions of connective tissue.
Any diseases, injuries and poisoning that require emergency medical care, including mental disorders, as well as contagious infectious diseases, do not allow you to send the arrested to the specialist.
Administrative arrest - a type of administrative punishment, imposed in court. It cannot be applied to pregnant women, women with children under the age of fourteen years, to people who have not reached the age of eighteen years of age, disabled people of the I and II groups, military personnel, citizens called up for military training.
Administrative arrest is provided for by a number of Code of Administrative Offenses. Participants in protest shares usually receive this punishment under Article 19.3 (disobedience to the legal order of a police officer). The maximum term of arrest is 15 days.
In 2009, the Constitutional Court indicated that the Code of Administrative Offenses should be applied in conjunction with the Convention for the Protection of Human Rights and Fundamental Freedoms , which, unlike Russian laws, contains an exhaustive list of grounds for detention, and in case of contradiction with Russian norms, has priority.
The Convention allows the use of administrative detention only "for reasonable suspicion" in an offense or to prevent it. At the same time, the KS allowed citizens even if the administrative proceedings were terminated in the case to appeal their detention, prove innocence and seek compensation within the framework of the civil process.
