According to an almost four-page explanatory note to the document, the basis for such a proposal was the results of an audit of the Control and Accounts Chamber of the activities of the State Unitary Enterprise "Petersburg Metro", where multi-billion-dollar violations were identified for the period from 2011 to 2013.

M. Mokretsov in Smolny is responsible for resolving issues of state property accounting, management and disposal, inventory and monitoring of land, land management in the city. As M. Reznik notes, in 2013, when the audit was carried out, the vice-governor was directly responsible for the implementation of property relations in the city, including control over the activities of state unitary enterprises.

As a result of the inaction of the Vice-Governor of St. Petersburg to control the activities of KUGI in terms of mandatory instructions and issuing mandatory management decisions, in violation of the requirements of the city charter, the budget of St. Petersburg, according to the PSC, suffered significant damage, the explanatory note says.

“Taking into account the above, as well as in order to prevent further unscrupulous and unreasonable inaction of members of the government of St. Petersburg to control the activities of the State Unitary Enterprise “Petersburg Metro”, I consider it necessary to express no confidence in the Vice-Governor of St. Petersburg M.P. Mokretsov,” concludes the deputy .

Let us note that, according to the city charter, deputies have the right to express no confidence in government officials in whose appointment they took part. This is what M. Reznik tried to do last December. But then the legal department of the city parliament came to the conclusion that since Vice-Governor M. Mokretsov is not the head of the executive body of St. Petersburg (for example, a committee), then no confidence can be expressed in him. As a result, the legal department considered that the presented draft resolution contradicted the norms of the current legislation.

The author of the resolution, in turn, notes that when making such a decision, the Legislative Assembly’s lawyers did not take into account the position of the Constitutional Court, expressed back in 2003. Then, the people's representative recalls, the right of the legislative body of state power of a constituent entity of the Russian Federation to express no confidence in members of the highest executive body of power of a constituent entity of the Russian Federation, including those who are not the head of the executive bodies of the constituent entity of the Russian Federation (as not implying the mandatory resignation of these officials) was recognized as consistent with the Constitution of the Russian Federation. .

“The conclusion of the legal department says that we cannot express no confidence in any of the vice-governors, with the exception of Govorunov, since he is the head of the executive body, and the other vice-governors do not head any structures,” M. Reznik noted. - I think this needs to be dealt with. But it is possible to submit a document for discussion without a positive opinion from the legal department. I believe that our legal administration is mistaken even from the point of view of common sense - if we approve vice-governors, then we have the right to express no confidence in them, especially since this does not imply resignation.”

As the author of the initiative, M. Reznik, explained in a conversation with an RBC St. Petersburg correspondent, the document will not be considered at the next meeting, since now it is more urgent to appeal to the speaker of the city parliament, Vyacheslav Makarov, to invite Vice-Governor Igor Albin to the next meeting, since the city is more concerned about this .

“But we will deal with Mokretsov’s incident from a legal point of view,” assured M. Reznik. “I believe that this issue needs to be resolved in the near future, since the Albin bloc of committees are already making statements about a shortfall of 5 billion rubles and a lack of money for street cleaning, and this is also a matter of financial and economic policy and priorities.”

According to the representative of the Yabloko party, Alexander Kobrinsky, such a document is exclusively political in nature. “An expression of no confidence in Mokretsov is an exclusively political thing,” the deputy told RBC St. Petersburg. “It’s surprising why it was him, because at the time of the main violations there was no Mokretsov yet and then, it is quite obvious that he is not the main pain point of the city,” added A.
