The Moscow City Court considered Ildar Dadin's appeal against the decision of the Tverskoy District Court to sentence Dadin to 15 days of arrest under Article 19.3 of the Code of Administrative Offenses (disobedience to a legal demand of a police officer) for participating in the rally on Manezhnaya Square.
“01/15/15” According to Sergei, who represented the interests of Ildar Dadin in the second instance, the court heard testimony from defense witnesses who described in detail the detention of Dadin, who, at the time of capture by police, was trying to rescue a man who had been captured by representatives of the Anti-Maidan movement. In addition to the factual side of the case, the defense also appealed a procedural violation, which concerned the fact that in the arrest order Judge Moskalenko did not indicate the period from which the administrative arrest was calculated, which sent Dadin to a special detention center. Then the court, correcting this error, illegally, in its opinion, made all amendments to the already announced resolution, which is impossible by law, since such a change does not apply to minor amendments, the introduction of which to the resolution is permitted by the Code of Administrative Offenses.
OVD-InfoSharov-Delone was not initially accepted because of Sharova-Delone. As a result, the Moscow City Court decided to leave the decision of the Tverskoy court unchanged; one of the arguments of the court was that “the testimony of defense witnesses contradicts the objective testimony of the police and is therefore called into question.” Regarding the procedural point, the court established from what day to count the day of arrest - from the day of detention and drawing up a protocol on the administrative offense, January 15.
On January 15-15, Ildar Dadin was taken to the Meshchansky police station by police officers on Manezhnaya Square along with twelve other activists, where he was separated from the rest of the detainees. At the police department, the bus was immediately met by about 10 police officers, who dragged Dadin out first by force, despite the fact that he said that he would go himself. The police department charged him with two articles at once - 19.3 (disobedience to a lawful demand of a police officer) and 20.2 (violation of the rules for holding public events), after which he was left to spend the night in the police. The next day after a 15-day sentence under Article 19.3 and a decision to impose a fine of 20 thousand rubles on Ildar Dadin and Alla Frolova, representing his interests in court, for violating the second part of Article 17.3 of the Code of Administrative Offenses (failure to comply with a lawful order of a bailiff). At the same time, Dadin said that immediately after the meeting, the bailiff took him to a separate room and began to choke him, knocking him to the floor several times. Alla Frolova tried to enter the room, but the bailiffs pushed her away and did not let her into the room, despite the official power of attorney.
