The lawyer "Agora" comments on the statements of activists and leaders of "Anti -Maidan"

Activists of the new Anti-Maidan public movement, founded by the former Afghan warriors, Cossacks and bikers, intend to fight the “orange threat” in Russia. To do this, the “anti -Maidanists” promise to go to all protest rallies, and if necessary, and fight opponents. On January 15, activists were waiting for the supporters of Alexei Navalny on Manezhnaya Square in Moscow, and on January 16 they attacked oppositionists in one of the capital's cafes. The lawyer of the Agora human rights organization, Damir Gainutdinov, commented on the "Medusa" of the statements of leaders and participants in the movement.

Activists are ready to use violence

Lawyer Damir Gainutdinov : “The statements of the Anti -Maidan movement must evaluate competent state bodies. I see, at first glance, statements about the readiness to commit crimes against the life and health of citizens. Intentions are expressed by criminal and administrative offenses. Statements about the readiness to commit such crimes should serve as a reason for law enforcement agencies to take measures to prevent crime. There is Article 12 of the Law “On Police”, which obliges the police to identify the conditions contributing to the commission of crimes, and persons who intend to commit crimes. The police, at least, should conduct preventive conversations with them. ”

Activists intend to interfere with unauthorized shares

One of the leaders of Anti -Maidan, Senator Dmitry Sablin : “We will orient the law enforcement agencies on those provocateurs who, in their own words or actions, will push people to the riots. In some cases, if we see that someone takes a fire or tries to burn a tire-we ourselves will grab people from the crowd and transfer them to the law enforcement forces. It is better not to go to provocations against us. We will stand shoulder to shoulder. Since in our organization mostly officers, we can. We will not retreat or run away. ”

Damir Gainutdinov : “You can see the signs of the excitement of social hostility and hatred and, accordingly, extremist activity. Here all the cards are in the hands of the prosecutor's office. According to the law on countering extremist activity, measures should be taken about the prevention of extremism, persons and public organizations that are engaged in extremism. There are Articles 280 and 282 of the Criminal Code that establish responsibility for this. The meaning of all such norms is to prevent the confrontation between citizens using violence. The police, the Investigative Committee, and the prosecutor's office must act. If such statements are distributed on the Internet, then Roskmonadzor should act - stop chasing journalists, and engage in their direct responsibilities: to stop the distribution of extremist appeals, block sites, demand to delete prohibited information.

Taking people at a rally is an obstacle to the realization of the constitutional right to participate in a peaceful meeting. If they go to an unauthorized rally (as it was on Manezhnaya on January 15 - approx. Medusa) , then become participants in an unauthorized action. Even if random passers -by are recognized as participants in the rally and are subject to administrative responsibility, then these comrades are one hundred percent. ”

Activists threaten death

Alexander “Surgeon” Zaldostanov: “The only thing that will force them [opposition activists] to abandon their plans is fear. They are ready to betray and kill sponsors for money, but they are not ready to die for money! ”

Damir Gainutdinov: “In this case, the idea was clearly expressed that a group of citizens is ready to apply violence against other groups of citizens. What else could be a reason for law enforcement agencies to intervene?

A criminal case on a call to murder can be made if the threat is addressed to a particular person. The threat to kill everyone who goes to the square is not a threat of murder in the sense of the Criminal Code. This appeal - to the unlimited circle of persons, in this case, participants in opposition rallies - is related to extremist activities. This is an article 280 (the maximum term is six years of imprisonment). By the way, the law on toughening liability on it was recently signed by President Vladimir Putin. Perhaps it is worth implementing it in this regard. ”
