The ex-owner of the bankrupt “my bank” Gleb Fetisov translated the amount sufficient to pay with all the bank creditors, to the account specially opened by the deposit insurance agency. The last tranche - more than 6 billion rubles - arrived on the last day of the allotted time, February 4. A few days before, according to Kommersant , more than 7 billion rubles were transferred.
In the DIA they confirmed the fact of receiving money and reported that they intend to pay with all the creditors and depositors of My Bank in the near future. According to the data given on the DIA website, the amount of the established debt of my bank to creditors was 14.3 billion rubles. Almost three thousand citizens and approximately 400 legal entities will now be able to completely return their money.
The case that the owner of the bankrupt bank contribute his own funds for full settlement with creditors, has never been in the history of the DIA as a bankruptcy trustee.
According to the publication, some of the eminent creditors of the "My Bank" were already able to return their funds. In particular, the film director Nikita Mikhalkov signed a assignment agreement with a certain “investment and financial consultations” LLC, transferring all his rights to the bank for ruble, foreign currency and impersonal metal accounts for a total amount of almost 200 million rubles.
The same LLC and the famous Russian volleyball player Ekaterina Gamova, as well as her husband, the film operator and producer Mikhail Mukasey, transferred her requirements for the bank.
Fetisov, in respect of whom a criminal case has been instituted on theft and withdrawal of assets from my bank, has already declared readiness to pay off creditors and depositors. He explained his desire with the need to maintain a business reputation.
The preliminary investigation of the criminal case against Gleb Fetisov, meanwhile, was completed, he did not go to freedom. After getting acquainted with the case file, his fate will have to decide the court. It is possible that the charges against the ex-banker totaling 1.9 billion rubles can be expanded: in addition to the case of the banker himself, the basic case of fraud in "My Bank" continues to be investigated. In this case, unidentified persons who stole billions of rubles from the bank are still undergoing.
A complete retribution with the creditors of my bank and the termination of its bankruptcy are not the basis for closing the criminal case, because the theft and withdrawal of assets from the bank that the investigation insists has not disappeared, lawyers indicate.
“However, the retribution with all creditors and full compensation for damage will be taken into account by the court when sentencing in a criminal case and can be softened quite much, theoretically up to a conditional term, but everything will depend on how the court reacts,” says Tatyana Protsenko, chairman of the Moscow Bar Association.
