Sergey Krivov: Without the right to correspondence

The misfortunes of Sergei Krivov, convicted in the “swamp business” for a longer period than the majority, and have been a myocardial infarction in the pre -trial detention center, continued in the colony: since August last year, he was deprived of the opportunity to receive and send letters.

The lawyer Irina Biryukova, representing the interests of Krivova, told the OVD-Info that since the arrival of the penal colony No. 5 of the Bryansk region in the second half of August last year, Krivov did not receive for several months and could not send any correspondence. Neither letters, nor statements to any instances, including complaints that letters do not come and do not leave. Biryukova Krivov said that such violations occurred in relation to other prisoners of the colony, but so that no correspondence would go at all - he did not hear about this anymore. Some letters were returned to him without explaining why they did not pass censorship, others did not return at all. “In general, he had no connection with the outside world,” the lawyer comments.

For the first time, Irina Biryukova and the head of the Legal Foundation Foundation Alexei Sokolov came to Krivov in a colony in October. They took all the statements and complaints from him and sent him to the authorities - to the Federal Penitentiary Service, to the prosecutor's office with a request to conduct an audit. Biryukova wrote a statement to the court on the consideration of a complaint about the inaction of the colony administration. By that time, the deadlines for consideration of applications sent by Krivov had already passed, but Biryukova specifically asked the court to restore the deadlines, since the statements were not delivered not due to the fault of Krivov.

To the surprise of the lawyer, Starodubsky District Court of the Bryansk Region did everything as Biryukova asked in the statement, and even more. As it turned out during the meeting on February 4, all terms of consideration of applications were restored, the applications were accepted for consideration, all the necessary documents were claimed from the colony. Including it turned out about the additional complaints of Krivov, about which the lawyer was not known at first. In particular, Krivov, while in a colony, worked, but a labor contract was not concluded with him and he was not paid yet. In addition, he submitted an application for translated to lightweight conditions of detention-curves have the right to do this, since he did not receive any penalties (comments for violations of the regime that could worsen his position in the colony and deprive him of the possibility of parole). However, he was not only not translated, but did not respond to the statement.

“The judge himself went to Krivov in the colony, met him, talked, took explanations from him, since he would not deliver him to the hearing, and the video conference in court is technically impossible,” says Biryukova. “We are in good shock from the actions of the judge.” The judge also agreed that Krivov’s interests in court represent, in addition to Biryukova, Alexei Sokolov also represented. “Usually, the courts do not agree, even if we ourselves ask about it: they say, since there is already one defender - no more,” says Biryukova.

The leadership of the colony asked the court to interrogate the witness - an operational employee. The meeting in this regard was postponed to February 18.

Currently, the issue with the departure and delivery of correspondence has been resolved, Krivov has already received more than 200 letters. The papers that he had previously could not send to the court, after the intervention of the lawyer, reached one day.

The check in the colony according to the statements of Biryukova from the prosecutor's office and the FSIN began. In this regard, as the lawyer says, Krivov had problems of a different kind - the leadership of the colony began to threaten him. Krivov was explained that now he may have penalties. “After they looked at why he was convicted, he was told: we can easily arrange a criminal case for an attack on an employee of the FSIN,” says Biryukova.

As she knew from Krivov, during the past prosecutorial inspections in the colony he was hidden from the inspectors, they did not allow representatives of the auditing departments to convey complaints. “Once - he told us himself - an employee of the regional department of the FSIN came and asks:“ Who has complaints? ” Kryva came out, says: “I have complaints, I would like to come to your personal appointment.” They say to him: “Well, now we’ll talk with everyone and meet you.” But no one called him, ”says the lawyer.

Members of the regional public observation commission for places of imprisonment came to Krivov, he handed them a complaint about threats from the leadership of the colony. According to Biryukova, now, “when they realized that he has support, that he has defenders, that he would not stop, no matter how threatened him,” “behind” Krivov. Nevertheless, what is happening with Krivov currently continues to raise questions in defense.

Fearing threats and possible provocations, Krivov wrote a statement to be placed in the so -called “safe place”. In the colony it is called abbreviated - BM, it is a camera located separately from the places where other prisoners are contained. Similarly, in September 2013, Nadezhda Tolokonnikov, who was in the IK-14 Mordovia, arrived . However, Tolokonnikova reminds Biryukova, in her safe place "there was a TV and everything in the world." All products were taken from Krivov, forbidden to drink tea and coffee (“they say: do not suppose, drink water”), did not give out a nightstand, left only sweets and cookies. In addition, he was dressed in some new robe, not the one that he had before. According to Biryukova, curves should be kept in a safe place on the same conditions that were contained before the translation there - it simply is not in the detachment, but sits separately from all. In the colony of Biryukova and Sokolov, they explained that since the BM is located on the territory of the penalty area, the curves should be there in the same conditions as prisoners placed in a schizo. “We said that this should not be,” says Biryukova. “We talked with the head of the colony himself, he assured us that Krivov would have a nightstand, and products, and tea coffee-in general, everything will be returned to him, he will be changed, everything will be fine.”

Despite these assurances and generally the attentive attitude of the leadership, protection is afraid of any provocations. At the same time, Biryukova notes that he looks good and he has no bodily harm.
