The press center of the Ministry of Internal Affairs said: the decision to make police officers by the deals "was perceived by employees with understanding." It is clear that in such conditions, law enforcement agencies, by virtue of their nature, are guided by the principle of "the bore God protects"
Of course, the police ban to leave the country violates the basic law - the Constitution of the Russian Federation. The second article of the Constitution says that human rights and freedoms are the highest value. The state is obliged to recognize, comply and protect these rights, and the right to freedom of movement is just one of these rights. Of course, the Constitution agrees that human rights can limit federal laws, but only to the extent that it is necessary in order to protect the basics of the constitutional system, as well as morality, health, rights and legitimate interests of others, ensuring the defense of the country and the security of the state.
If the authors of the Law “On Police” would clearly prescribe in it that if a complication of the global situation, police officers have no right to travel outside the country, then everything would be legal and no questions would have any questions! However, there are no similar restrictions in the law “On the Police”, which means that no prohibitions on the police are distributed. Unless those employees who have access to state secret, but there the ban on leaving is directly registered in the Federal Law “On State Secret” - this norm does not apply to all police officers.

Even if the department issued some normative act, order, instruction, written indication, no matter what this document was called, he cannot limit the rights of employees in any way. Only federal law! It is not difficult to find out whether a similar ban exists in writing - any citizen can send a request to the Ministry of Internal Affairs and find out on what grounds an order has been issued, which prohibits the police to travel around the world. According to the answer, it will be seen - what kind of paper it is, and then you can try to challenge it in court and, if necessary, reach a constitutional court.
Another thing is that the internal affairs officers do not really want to sue the authorities. There are reasons for this. Firstly, the employees of the internal affairs bodies recently equalized in rights with ordinary citizens-earlier rather severe restrictions were extended to them, sometimes they had to take special permission to take on departure, so so far they were simply not used to the freedom that the legislation gives them and consider this ban to be logical and reasonable. Secondly, police officers are simply afraid to argue with the authorities. The Ministry of the Interior is a very peculiar structure with a strict internal discipline, almost like an army. In our country, there has not yet been a judicial precedent when someone was trying to appeal restrictions in this part. And, we must think, it will not appear soon.
