In May 2010, a resident of Ufa, Tatyana Ivanova, contacted the Bashkir office of the Committee Against Torture, who spoke about the murder of her husband Albert Mukhametzakirov, allegedly committed by police officer Vladislav Simukhin.

Human rights activists conducted a public investigation, during which they established that policeman Vladislav Simukhin, while intoxicated, on May 1, 2010, received a service weapon for duty - a Makarov pistol. However, the policeman never went on duty, drank vodka again and went to Ufa, taking with him a pistol and his personal uniform. In Ufa he continued to drink.

“The next day, at about 1:40 pm, a policeman, being fairly drunk, approached a car whose driver was Albert Mukhametzakirov - they agreed that Albert would take the policeman to the Demsky district of Ufa. Once in the car, Simukhin paid the fare. But on the way, an quarrel occurred between the driver and the passenger (alcohol undoubtedly played a role), during which the law enforcement officer shot Mukhametzakirov in the head, after which he fled the scene of the crime. The driver died from his injury,” the human rights activists said in a statement.

On May 7, 2010, Vladislav Simukhin surrendered and wrote a confession. On May 14, 2010, he was charged. In court, Simukhin argued that he committed the crime through negligence, but found him guilty of murder (Part 1 of Article 105 of the Criminal Code) and sentenced him to 10 years in prison in a high-security correctional colony.

On October 1, 2012, the Leninsky District Court of Ufa ruled to award Tatyana Ivanova moral damages in the amount of 800 thousand rubles, but on March 14, 2013, the Supreme Court of the Republic of Bashkortostan issued an unexpected appeal ruling, which rejected the plaintiff’s claims.

“The panel of judges then, apparently, decided to save budget money and considered that the state was not responsible for a murder committed by a police officer armed with a service weapon. Not agreeing with this reasoning, the lawyers of the Committee against Torture, representing Ivanova’s interests, nevertheless decided to file claims against the Federal State Institution “Department of Private Security of the Ministry of Internal Affairs for the Republic of Bashkortostan”. If shooting a pistol is an activity that poses an increased danger to others, then the owner of this source - the regional department of private security - should be responsible for the damage,” the Committee against Torture believes.

As a result, on September 26, 2013, the Kirovsky District Court of Ufa only partially satisfied the claims of Tatyana Ivanova, collecting 500 thousand rubles from the defendant against the stated amount of 1 million rubles. On December 3, 2013, the Supreme Court of the Republic of Belarus upheld this decision. After the verdict came into force, human rights activists filed similar claims in court in the interests of other victims - two children of Albert Mukhametzakirov. On May 6, 2014, the Kirovsky District Court of Ufa satisfied these demands in full, awarding each of the children of the murdered man five hundred thousand rubles.
