
The College of Criminal Cases of the Nizhny Novgorod Regional Court canceled the sentence to former OP-7 operatives in the capital of the region Alexei Sokolov and Vadim Volkov, who had previously received five years of general regime, for breaking the spine for the detainee Alexander Dmitriev. This was reported by the committee against torture, whose lawyer Dmitry Utukin represents the interests of the victim.
The case was returned to a new consideration to the Soviet district court of the regional center with a different composition of the court. Sokolov and Volkov were transferred from jail under house arrest.
On March 6, 2011, the police illegally detained Dmitriev in his own apartment on suspicion of theft and delivered to OP-7. In the department, he was also charged with part 1 of article 19.3 of the Code of Administrative Offenses (disobedience to the legal requirement of a policeman). However, the next day, the magistrate court of the Sovetsky district justified Dmitriev in this case.
Nevertheless, after the trial, Dmitriev was again brought to OP-7. Sokolov and wolves beat the detainee, and also subjected him to torture the “envelope” , which consists in the fact that the person, turning his hands behind his back, fetters them with handcuffs, tie his legs with a belt, and then stretch the rope through the arms and legs and tighten it to the limit. During the torture, Sokolov sat on the back of Dmitriev, which made him feel a sharp pain in the lower back.
After that, the detainee wrote a confession in the theft of building tools, allegedly perfect by him with his acquaintance. However, the acquaintance had Alibi. Then Sokolov and Volkov again brutally beat Dmitriev with his arms and legs, after which he rewrote the turnout, making himself already alone.
On the morning of March 8, Dmitriev was released home. He called an ambulance, and the doctors urgently hospitalized him. Doctors found a compression fracture of the body of the 1st lumbar vertebra, concussion, a concussion, a lumbar bruise, as well as abrasions on wrists. The victim has not yet recovered from the consequences of injuries - he is still limited to the ability to move.
On April 13, 2011, according to Dmitriev, a criminal case was opened. However, on October 6 of the same year, the investigator of the Soviet regional department of the Investigative Committee Andrei Rotkov closed the investigation "for the lack of an event of a crime." The testimonies of the victim’s, in unreliable, unlike the testimony of Sokolov and Volkov, claiming that Dmitriev had written a confession after a conversation with them, and then suddenly rushed to run, but stumbled on the stairs and fell.
Meanwhile, in April 2012, the story of Dmitrieva became the plot of the transfer of the TV Center channel. After that, the case was resumed and transferred to the regional department of the Investigative Committee of the investigator Evgeny Chocalo, who brought the investigation to the end. In October 2012, he went to court.
On January 23, 2014, the judge of the Soviet District Court Maria Lazareva sentenced Sokolova and Volkov to five years of the general regime under paragraphs “A” and “B” of part 3 of Article 286 of the Criminal Code (abuse of authority with the use of violence and special funds). The police were taken into custody in the courtroom.
“In general, our applicant is satisfied with the verdict,” the checkpoint noted.
However, Sokolov and Volkov appealed the verdict. As Utukin noted, during the consideration of the appeal, "not a single new evidence of innocence or convincing arguments were presented that the trial court in the sentence made some serious violations that could not be quickly eliminated." The reasons for the decision of the regional court are unknown, he added, because at the hearing on Wednesday, only the resolution of the appeal definition was announced, and a copy of this paper has not yet been issued to the lawyers of the checkpoint.
Utukin added that in Dmitriev, as a result of torture, acute heart failure developed, and the vessels of the legs almost do not function. “The Committee against torture provides him with medical assistance in the framework of our rehabilitation program for torture victims,” the lawyer remarked, “but it is obvious that the new trial will be a difficult test for him, which he may simply not survive.”
