The ECHR accepted for consideration the complaint of Daniil Konstantinov about the length of the detention period. Konstantinov was charged with murder and was in custody from March 22, 2012 to October 16, 2014, when the court reclassified the charge as hooliganism, sentenced Konstantinov to three years in prison and granted amnesty. According to Konstantinov's lawyer Damir Gainutdinov, quoted by RAPSI, his client's case is unique in that he spent a very long time in custody pending trial. Konstantinov's case was considered in court twice, and the first hearing ended with the court in December 2013 deciding to return the case to the prosecutor's office. Konstantinov remained in custody, and the second hearing did not begin until May 2014. The complaint states that paragraph 3 of Article 5 of the European Convention on Human Rights (the right to a trial within a reasonable time) has been violated. Earlier, Konstantinov's defense filed a complaint against the arrest with the ECHR.
