Russian lawyers are really different than their European and American colleagues understand the law. To the question of what the right is, most of them quickly and without hesitation will answer that the right is the totality of the rules authorized by the state, the violation or failure of which entails the application of legal responsibility. But few will clarify that there is still a whole set of requirements for the content and form of these rules, to how they are formulated, how they are accepted and - most importantly - how they work.
This is due to the fact that in Russia, starting from the last decades of the XIX century to the 20s of the XX century, a positive theory of law was actively developed. Then these were new ideas that had Western European roots, and legal positivism was a world trend.
Over the past one and a half centuries, views on the state and law in the world have changed a lot in favor of the natural legal approach, where in addition to the right created by the state, there is still a “natural law” that has more power than positive, and includes ideas about justice and general good and social institutions that protect free exchanges and allowed to suppress aggressive violence. In Russia, on the contrary, there was a conservation of positivist views on the law. Because the authoritarian Soviet power was beneficial to the right to the right, and Soviet scientists, rejecting hostile "bourgeois" studies, continued to study the postulates of the positivist theory of law. As a result, the only scientific content of law was the study of laws, and jurisprudence was replaced by legistics.
By inheritance from the USSR, the tradition of legal positivism of the sample of a hundred years ago passed to modern Russia as a dominant direction in science. The dominant, but, fortunately, not the only one. Because in this Russian science there is a lot of modern and interesting. But in general, mass Russian science and school, preparing specialists for the judicial and law enforcement system, do not consider the law as a complex socio-political science with a huge number of subtle internal interconnections and interdependencies.
Contradicting itself to itself, mass Russian jurisprudence declares that life is a substantial source of law, but at the same time considers formal sources the only and reliable sources. Unlike the British, who have long no use the word “right” in its purest form. In their legal discourse, it is called “Law and Morality” (law and morality).

Russia's accession in 1998 to the European Convention “On the Protection of Human Rights and Fundamental Freedoms” at once introduced a huge number of new concepts that were not characteristic of it before. The most difficult thing for Russian perception was the term “supremacy of law”. They tried to translate him literally, and ... the "supremacy of the law" turned out. Because the phrase “Rule of Law”, which in English denotes the rule of law, is not translated into Russian in the same way - both as the supremacy of law and as the rule of law. But in English, LAW means rather not the form and the text of the normative legal act adopted by the parliament, but a certain special legal order, which is distinguished by the highest meaning, which does not quite correspond to the Russian word “law” from a formal point of view. The word “Law” is generally not authentic to the word “right” in his Russian understanding, and it is impossible to translate it as “law”.
As a result, the English Rule of Law and his Russian translation are completely different philosophical concepts. Because the rule of law, in addition to strict compliance with the law, legal force and hierarchy of regulatory acts primarily means the rule of meanings, and in Russia is interpreted as the rule of the letter of the law. In the report of the Venice Commission “On the Supreme of Law”, the difference between the concepts of “supremacy of law” and “supremacy of the law” pays special attention. “In the recent past,” it says, “the essence of the rule of law in some countries was distorted to the point that it has become equivalent to such concepts as“ Rule by Law ”, or“ Rule by the Law ”, or even“ Law by Rules ”(“ Law by Rules ”. Such forms of interpretation make it possible to justify the authoritarian actions of governments and do not reflect the true meaning of the concept of “supremacy of law”.

An even greater confusion in the Russian interpretation of the principle of the rule of law introduced the term “legal state” enshrined in the Russian Constitution, which is the continental alternative of the Anglo-Saxon “rule of law” of the conceptsstaat (legal state) and the rule of law are distinguished by two points: 1) the Anglo-American tradition does not believe that law may be reduced to logical a system controlled only by a constitutional court; 2) She does not believe that the rights to a citizen are granted by the state. It did not work out and could not work out. Because all the definitions of Russian textbooks in which the state is a form of organization of society are outdated. They are incorrect in relation to any modern state, and are doubly incorrect for the characterization of the rule of law. After all, the rule of law may not be determined by itself, but through its relationship with civil society, without which it cannot exist. Like civil society, it cannot develop on full scale if the state is not legal.
That is, some interpretations are outdated, others did not work out, but they did not agree on others. But these are not just definitions-this is a completely different political and legal model of relations between the state and society, on which legal consciousness and legal behavior are based. It turns out that Russia lives in a different legal dimension than most modern states. A subtle lawyer, the forty-fourth US President Barack Hussein Obama in one phrase managed to express the essence of the problem that once broke out of a purely scientific discussion and in a particular situation led to a strict disagreement. Speaking of the same thing, we invest in what we are talking about, a completely different meaning, and therefore do not understand each other.
... Lawyers in Russia are also different from their foreign colleagues. Of course, not all. In my country there are many highly professional independent experts in the field of law. But they, as a rule, are suspended from the adoption of state-sized decisions. Because within 20 years the state selected for itself such legal contractors who were convenient for him. The rest in one way or another were gradually taken beyond the scope of state legal activity. As a result, two legal communities were formed, which speak completely different languages and operate with different legal constructions. One community is officials “from jurisprudence”, judges and parliamentarians, members of election commissions and law enforcement officers. Another - lawyers, human rights activists and part of independent scientists.
At the international symposium “Doctrines of the Law State and the Supreme of Law in the Modern World”, which was held in the Constitutional Court of Russia in October 2013, the President of the American Association of Lawyers James Silkinat called four universal requirements necessary for the functioning of a system that ensures the implementation of the principle of the rule of law. Namely:
The state apparatus, its officials and official representatives are subject to law.
Normative legal acts are clear and certain, officially published, meet the requirements of stability and justice and are aimed at ensuring and protecting fundamental rights, including the protection of personality and property.
The process of accepting, fulfilling and ensuring the operation of regulatory legal acts is open, fair and rational.
Justice is carried out by competent, high -moraine and independent assessors or neutral side, which are in the state in sufficient quantities, have adequate resources and reflect the structure of the society to which they serve.
These principles seem simple and understandable to Mr. Silkinat. But it is difficult for him to realize that for most Russian state lawyers they need additional explanations.
For example, judges need to be taught that if during the judicial investigation the evidence of the prosecution turned out to be insufficient, or did not find their confirmation, or if the defense brought evidence that confront doubts, and these evidence were not refuted by anyone, then they are obliged to be guided by the constitutional principle that the uncertain doubts about the guilt of the accused are interpreted in favor of the accused (part 3. Article 49).

The Russian judge knows that any acquittal of it will be called into question, repeatedly verified and appealed. Therefore, it manipulates the procedural norms and limits of the judicial discretion to make the safest solution for itself. So that this is not, the Russian judge at least needs additional guarantees that any of its decision, based on the law, will be safe for its status. And, on the contrary, he should be sure that he will be responsible for the obviously unlawful decision and that this “know” will be the subject of honest public proof.
For Mr. Silkinat, a situation is impossible when the chairman of the court demands from each judge every day to report to him about the affairs in production. Especially about those "where the parties are state authorities and officials." Even in the most terrible dream, he cannot dream that the chairman of the qualification collegium of judges will declare in court that the judge cannot be independent, because he is part of see: “I am a federal judge, not a saleswoman” // New Gazeta, No. 95 of December 22, 2008. judicial system.
In Russia, a similar situation is a common practice that creates conditions for the impossibility of applying almost all the requirements called Mr. Silkinat. For example, during election campaigns, election commissions refuse to satisfy complaints about violations of the electoral legislation and invite applicants to go to court. And in the courts they either refuse to introduce evidence and conduct examinations, or make decisions without any reason. After that, election commissions say that the court has not found any violations, and approve the results of dishonest and unjust elections.
As a result, due to the vicious of the selection system, a consistent decrease in the competence of the representative bodies occurs. The parliament formed in this way, in turn, manipulates the procedures when adopting laws. Three readings of the law can pass in one day without a mandatory sending of a bill to the subjects of the right of legislative initiative. There are cases when the entry into force of the law is determined earlier than possible and is dedicated to a special date, if necessary for the implementation of a particular political goal, for example, Law No. 65-FZ (introducing special responsibility for conducting public events), the State Duma approved without public discussion within two months, accepting it in the third reading on the eve of the declared protest rally on an unprecedented work of the chamber of the chamber Night meeting .. The law was approved by the Federation Council for the next day, which again is absolutely impossible from the point of view of the procedure ..
In such a procedure, it is impossible to ensure clarity, certainty, stability and justice of regulatory legal acts as an indispensable condition for the implementation of the principle of the rule of law. Therefore, naturally, the most unemployed norm of the Constitution of Russia is the ban on the publication of laws that cancel or detract from the rights and freedoms of man and citizen (part 2 of article 55).
The President of the Federal Chamber of Lawyers of Russia, Yevgeny Semenyako, claims: “If in Europe the authorities of the European Union, its standards and principles are in Europe, then in Russia the last stronghold of the protection of the Constitution is the Constitutional Court.” And the judge of the Constitutional Court, Professor Nikolai Bondar, is sure that the Constitutional Court is the co -author of the Russian doctrine of the Supreme Law. He is sure that it is on the basis of the decisions of the Constitutional Court that the understanding of this doctrine and the balance between power, freedom and property are ensured. For a number of years, the chairman of the Constitutional Court, for a number of years, was a member of the European (Venetian) commission for democracy through law and left it only because at the meetings of the commission he "increasingly had to speak out about the content of legal norms, which then fall into consideration of the court, and this is prohibited by law." Maybe at least this court in Russia does not work according to the general template? To answer this question, it is enough to analyze the actions of the Constitutional Court in the situation that caused such a sharp reaction of the international community: in Russian-Ukrainian relations, which were extremely aggravated after the accession to Russia of the Republic of Crimea and the city of Sevastopol.
Analyzing the Crimean situation in 2014, I have to make a reservation - it is difficult to blame me for Krymophobia. For the past twenty years, I have been lectures on the status of territories gravitating towards Russia. Including the status of the Republic of Crimea. All these years, being the head of the scientific expert group in these territories, wrote and said that Crimea requires more flexibility from the Ukrainian authorities and perseverance from Russian politicians.
Back in 1992, the Supreme Council of Russia considered it necessary to resolve the issue of Crimea through interstate negotiations of Russia and Ukraine with the participation of Crimea , see: Decree of the Supreme Council of the Russian Federation “On the legal assessment of decisions of the highest bodies of the RSFSR to change the status of Crimea adopted in 1954” dated May 21, 1992 No. 2809-1. ". In connection with the holding of June 25, 1995, the State Referendum, the State Duma proposed see: Decree of the State Duma of May 17, 1995 in connection with the appeal of the Republic of Crimea No. 771-1 of the State Duma. "The government of the Russian Federation to take the necessary steps to activate the negotiation process with Ukraine."

Why suddenly now? After all, the referendum in the Crimea is not the first time. They were silent for 22 years, and then they attached it in 23 days? Why only Crimea? Indeed, back in September 2006, a similar referendum was held in the Transnistrian Moldavian Republic, at which 97.1 % of voters voted for joining Russia. As a result, the annexation of Crimea threatened the entire European policy after the 1945 Yalta Conference, created a dangerous precedent of state self -proclaiming, already applied in eastern Ukraine, and painfully hit the economy of Russia.
To answer all these “why”, it is enough to quote the opinion of a graduate of the faculty of international relations of St. Petersburg State University and MGIMO, the famous Russian journalist Ksenia Sobchak: “The truth is that the Russian foreign policy in Ukraine was deafeningly, and instead of diplomatic decisions, political looting went in favor. One could even forget about “morality” - it is always less in the policy of any state than calculation. But after all, the economic consequences that we will all experience in the coming years will be tangible to every Russian. As a result, it turns out that our state made an unprecedented political act condemned by the international community even without benefit, but with damage to its economy. Crimea was supposed to become part of Russia ... But this historical injustice had to be decided by years of negotiations with Ukraine, building relations, diplomatic trading. And not to steal a candelabr from a burning neighboring house, even if this candelabr was donated by you. ”
But, alas, in fact, everything that happened absolutely fits into the context of the general legal Russian paradigm. It is the accession of Crimea to Russia that is a classic example of a violation of the principle of the rule of law by interpretation of meanings and manipulation procedures.
The Constitutional Court played a special role in this story. Fulfilling one of the central actions provided for by the law in the adoption of part of a foreign state in its composition, an audit for compliance with the Constitution that has not entered into force, he at least eight times violated his own procedures and interpreted the provisions of the law.
So what happened? In order to understand this, you need to restore the chronicle of events.
According to information agencies, on the night of February 26-27, 2014, a group of unknown persons seized the building of the Supreme Council and the Council of Ministers of the Autonomous Republic of Crimea (hereinafter - the ARC). Russian flags were raised above the buildings. On February 27, a land message between Crimea and mainland Ukraine was stopped. On the same day, the Supreme Council of the ARC announced a referendum on the status of autonomy and the expansion of its powers. Voting was scheduled for May 25, 2014. Then another question brought to the referendum did not contain provisions on violation of the territorial integrity of Ukraine. The aim of the referendum was “the improvement of the status of the ARC so that the rights of autonomy are guaranteed for any changes in the central government or the Constitution of Ukraine”.
On March 1, Russian President Vladimir Putin requested from the Federation Council the right to use a limited military contingent outside the Russian Federation and received a carte blanche to introduce troops into Ukraine to “normalize a socio-political situation in this country”. On the same day, the referendum date in Crimea was postponed to March 30, 2014 ..
On March 4, President Putin said that Russia is not considering the option of joining Crimea to Russia. “Only citizens themselves,” he said, “in the face of freedom of will, they can and should determine their future.”
On March 6, the ARC authorities and the city of Sevastopol announced a change in the wording of the referendum issue and the transfer of voting on March 16. The referendum was held on the appointed day. According to officially published data, 96.77 % of the number of participating in the referendum voted for the reunification of Crimea with Russia.
On March 17 , relying on the results of the referendum, the Supreme Council of the ARC proclaimed Crimea by an independent sovereign state - the Republic of Crimea, in which the city of Sevastopol has a special status.
On March 17, President Putin signed a decree on the recognition of the Republic of Crimea as a sovereign and independent state. At the same time, the Republic of Crimea appealed to Russia with a proposal for its adoption to the Russian Federation as a new constituent entity of the Russian Federation with the status of the republic. The Parliament of Crimea in an accelerated manner prepared a draft interstate agreement on joining the Russian Federation.
On March 18, Putin began the procedure for the adoption of Crimea in Russia. He notified the government and chambers of the parliament on the proposals of the State Council of Crimea and the Legislative Assembly of the city of Sevastopol about the adoption of new entities to the Russian Federation and the formation of new entities. Then he approved and signed an interstate agreement on the adoption of Crimea and Sevastopol to Russia, according to which new subjects - the Republic of Crimea and the city of federal significance Sevastopol are formed as part of the Russian Federation. On the same day, Putin sent a request to the Constitutional Court of Russia to verify the signed agreement for its compliance with the Constitution. The request was accepted for consideration immediately, without holding a public hearing.
On the morning of March 19, the Constitutional Court recognized the agreement on the accession of Crimea by the relevant Constitution of Russia.
On March 19, President Putin introduced an agreement on ratification to the State Duma, together with the relevant draft laws, the draft Federal Constitutional Law on the creation of new constituent entities of the Russian Federation and the draft law on amendment to Article 65 of the Constitution of Russia.
On March 20, the State Duma ratified the contract.
March 21, the Federation Council ratified the contract. Putin signed laws on the accession of Crimea and Sevastopol to Russia. The contract entered into force.
On March 21, the Crimean Federal District was formed as part of Russia and a plenipotentiary representative of the President of the Russian Federation in Crimea was appointed.
At first glance from the point of view of the Federal Constitutional Law “On the procedure for adopting in the Russian Federation and the formation in its composition, the new constituent entity of the Russian Federation” (hereinafter referred to as the Law “On Acceptance”) the procedure was followed. Indeed, a foreign state can be adopted as a new subject by their mutual agreement in accordance with an international treaty. The Republic of Crimea declared itself such a state. Russia recognized this state. An international treaty was concluded. The Constitutional Court checked him for compliance with the constitution. The parliament ratified this agreement with the simultaneous adoption of the relevant law and the automatic introduction of the name of new entities to the Constitution. It would seem that everything is smooth.
But here is the moment of verification of the contract between the Russian Federation and the Republic of Crimea on the adoption of new entities to the Russian Federation of the Republic of Crimea and the formation of new entities (hereinafter referred to as the Agreement) by the Constitutional Court raises issues. Because it is the central legally significant effect of the entire procedure. In accordance with Part 2 of Article 91 of the Law “On Acceptance”, “the International Treaty is not subject to enforcement and application, that is, cannot be ratified, approved and cannot enter into force for the Russian Federation in other ways if the constitutional court establishes its inconsistency with the constitution”.
Yes, of course, the Constitutional Court of Russia was in a difficult situation. Only one night was assigned to his decision. He was faced with a choice - to stay within the framework of the legal field or to follow the situation. Therefore, the decision of the Constitutional Court, made by him on the night of March 18 to March 19, 2014, in itself deserves special attention.
Great doubt causes the legality of the court adopting a request for an audit of the contract and the possibility of considering this case in general. Article 36 of the Federal Constitutional Law “On the Constitutional Court of the Russian Federation” (hereinafter referred to as the Law “On the Constitutional Court”) provides for only one basis for the consideration of the case, which “is the discovered uncertainty on the issue of whether the Constitution of the Russian Federation has not complies with the international agreement”. Article 89, which is called the “permissibility of the request”, implies the possibility of checking the international treaty only if such an agreement is subject to ratification (part 1), and “the applicant considers it not subject to the introduction and application in the Russian Federation due to its non-compliance of the Constitution of the Russian Federation” (part 2). But no uncertainty in the contract was found by anyone. The President, who applied to the Constitutional Court, did not consider the contract unconstitutional. Therefore, the request itself was unacceptable and the Constitutional Court could not accept it for consideration.
The cause of the conflict is understandable. The federal constitutional laws “On the Constitutional Court” and “On acceptance” were adopted with a big difference in time (1994 and 2001), and the deputies simply forgot to adapt one to another. The Constitutional Court itself, being a full -fledged subject of the right of legislative initiative on the “issues of own management”, also “overslept” the situation of the conflict conflict of two constitutional laws. But the procedure is a procedure. And the court had to “get out” from the current situation, right in the decision. Almost two pages of his text (paragraph 1) are devoted to the substantiation of why the court nevertheless went to violate the law and began to consider this case. He honestly admitted that the request was not said about the unconstitutionality of the contract that, contrary to the procedure, when evaluating the contract, there was no arguing party and that the court did not discover the “complete procedural identity” of this situation with other cases of optional constitutional control. ” As a result, the court concluded that the verification of the contract is only “an integral part of the legal composition of the state-power decision”, and therefore-the obligation of the court. That is, if it is impossible, but I really want to, then you can.
The Constitutional Court conducted an audit of the contract without complying with the requirements of articles 41 and 49 of the Law “On the Constitutional Court”. We must pay tribute to the court - in his decision he honestly admitted that when verifying the contract, the mandatory procedure for considering cases stipulated by law was violated. He stated that “he was obliged to consider the case on the merits, without resorting in this case, taking into account the specifics of the present case, to the procedures for the preliminary study of the judge of the Constitutional Court and holding hearings in the case.” And if the consideration of the case without a hearing in principle is possible (Article 47.1), then without a preliminary careful study of the issue, the law does not allow this to do this. But, as already mentioned, to make a decision the court was given only one night. What a preliminary study and appointment of a judge-layer there. Although, in the conditions of time, the court could well take advantage of part 2 of Article 42 of the Law “On the Constitutional Court”, which gives him the opportunity to apply to the relevant authorities and officials with a proposal to suspend the process of entering into force the contested international treaty of the Russian Federation until the consideration of the case is completed. Could, but did not use. For what? After all, everything has already been decided "taking into account the specifics of the present case."
The Law “On the Constitutional Court” (Article 86 and 90) establishes the mandatory limits of verification of the international treaty of the Russian Federation for its compliance with the Constitution that has not entered into force. The law says that the court is obliged to verify the contract 1) according to the content of the norms; 2) in form; 3) in the procedure for signing, conclusion, acceptance, publication or enforcement. In addition, the law requires that the Constitutional Court decide on the case, “evaluating both the literal meaning of the act under consideration and the meaning attached to it by the official and other interpretation or the prevailing law enforcement practice, as well as based on its place in the system of legal acts” (part 2 of Article 74).
Analyzing the court ruling of March 19, 2014 from the perspective of these mandatory requirements, we can confidently conclude that the court was self -pounding from checking the contract for a number of mandatory parameters.
The Constitutional Court was self -confused from assessing the contract on the content of its norms on the subject of their compliance with the basics of the constitutional system of Russia. The text of the contract says that the Russian Federation concludes an agreement “in accordance with generally recognized principles and norms of international law, as well as realizing the close relationship of other basic principles of international law, in particular, in the Charter of the United Nations and the Helsinki Complementary Act of the Conference on Security and Cooperation in Europe, with the principle of respect and observance of human rights and freedoms ...”. Should the court verify the truth of this provision? Undoubtedly, he had to. But I did not check.
But it is precisely the Helsinki Final Act of the SBSU of 1975, on which the entire European security system is based and to which the contract refers, clearly enshrines that the states that signed it (including Russia as a successor to the USSR), must respect the territorial integrity and insanity of each other's borders and in no way not to undermine them. And the memorandum of maintaining peace and stability in the CIS of 1995 says that members of the Commonwealth undertake not to support separatist movements on each other, as well as separatist regimes, if any; do not establish political, economic and other connections with them; prevent the use of the territories and communications of the CIS member states; Do not provide them with economic, financial, military and other assistance. “Nothing should be interpreted as authorizing or encouraging any actions that would lead to the dismemberment or partial or complete violation of the territorial integrity or political unity of sovereign and independent states that observe the principle of equality and self -determination of peoples,” explains the principles of the territorial integrity and rights of the peoples to self -determination, fixed in the UNCO of the UN. Declaration of the General Assembly "On the principles of international law" of 1970. That is, these are precisely the same documents in the context of which the content agreement was to be checked, because they are current international legal obligations of Russia.
As a result, having abandoned the analysis of the content of the contract on the merits, the court did not check it for compliance with parts 2 and 4 of Article 15 of the Constitution. This article states that "generally recognized principles and norms of international law and international treaties of the Russian Federation are an integral part of its legal system." The Constitutional Court itself has repeatedly confirmed this in its decisions: “In accordance with the principles of the rule of law enshrined in the Constitution of the Russian Federation, the authorities in their activities are connected by both internal and international law. The universally recognized principles and norms of international law and international treaties are in accordance with Article 15 (part 4) of the Constitution of the Russian Federation an integral part of its legal system and should be in good faith. ”
It follows that if the international agreement that has not entered into force contradicts other previously concluded and not denounced by the time of verification by international obligations taken by Russia, then the verification of such an agreement for compliance with these obligations is mandatory. Более того, Конституционный суд не мог игнорировать неизбежные последствия ратификации Договора — принятие внутренних законов России, которые будут вполне соответствовать «проверенному» договору, но окажутся в антагонистическом противоречии с договорами иными.
Но, оказывается, не для ситуации с Крымом. В своем постановлении суд честно признается: «Поскольку в силу части третьей статьи 3 Федерального конституционного закона «О Конституционном Суде Российской Федерации» Конституционный Суд Российской Федерации решает исключительно вопросы права, он не оценивает политическую целесообразность заключения международного договора». То есть в одних случаях международное право — это важнейшая правовая основа конституционного строя России, а в других — правовая целесообразность. Так элегантно, путем умышленной подмены суд смог обойти сложную конъюнктурную ситуацию.
Конституционный суд самоустранился от оценки Договора по форме. В своем постановлении суд умышленно исключил из предмета проверки Договора «анализ документов, на которые такой договор ссылается в качестве своей основы». Понятно, что в данной ситуации для суда это был единственный выход, поскольку если бы эти документы были исследованы, суд вряд ли смог бы признать Договор соответствующим Конституции.
Во-первых, Договор основан на Декларации о независимости Республики Крым, главной правовой позицией которой является апелляция к решению международного суда ООН по Косово. В Декларации так прямо и сказано: «принимая во внимание подтверждение международным судом ООН в отношении Косово от 22 июля 2010 года того факта, что одностороннее провозглашение независимости частью государства не нарушает какие-либо нормы международного права… мы принимаем решение». Но такая апелляция абсолютно недобросовестна. Во-первых, потому, что Международный суд правомочен давать всего лишь рекомендательное мнение по поступившему запросу. Вердикт Международного суда ООН так и называется — Консультативное заключение международного суда по Косово. И хотя многие сегодня представляют этот документ едва ли не как международную санкцию на сецессию, но тогда — 22 июля 2010 года — судебная инстанция ООН вообще не обсуждала законность или незаконность этнополитической сецессии или права наций на самоопределение как принцип. К этому моменту 69 из 192 стран — членов ООН признали Косово в качестве независимого государства. Но при этом независимость Косово до сих пор не признается ООН в целом. Потому что два постоянных члена Совета Безопасности (Россия и Китай) выступают категорически против одностороннего самоопределения бывшего автономного края в составе Сербии. Даже Европа не имеет консенсуса относительно признания бывшего автономного края Сербии в качестве независимого образования (пять стран — членов ЕС: Испания, Греция, Румыния, Кипр и Словакия — не признали Косово). Заметьте — именно Россия категорически не признает решения международного суда по Косово! Но именно это решение и лежит в основе всех документов о присоединении к России Крыма. И Конституционный суд не может этого не знать.
Так элегантно, путем умышленной подмены суд смог обойти сложную конъюнктурную ситуацию.
Конституционный суд самоустранился от оценки Договора по порядку его подписания. Судом проверялись только полномочия российской стороны, которые и так были очевидны. Суд констатировал, что Договор «подписан Президентом Российской Федерации, который наделен полномочием определять в соответствии с Конституцией Российской Федерации и федеральными законами основные направления внутренней и внешней политики государства». «Исходя из этого подписание рассматриваемого Договора Президентом Российской Федерации соответствует Конституции Российской Федерации». Более не исследовалось ничего. А ведь предмет для такого исследования был.
Со стороны Крыма Договор был подписан главой правительства Крыма Сергеем Аксеновым, спикером крымского парламента Владимиром Константиновым и главой (мэром) города Севастополя Алексеем Чалым. Однако статус города Севастополя в составе Украины вообще не предполагал наличия выборного мэра. Так называемый «народный» мэр — гражданин России Алексей Чалый — был избран жителями на митинге. То есть на момент его избрания пост мэра не был предусмотрен Конституцией Украины. А если бы даже и был, то данное лицо в любом случае не могло быть на этот пост избрано по причине наличия у него гражданства иностранного государства.
Не меньше вопросов возникает к процедуре избрания председателем правительства Крыма Сергея Аксенова. Когда 27 февраля 2014 года здание Верховного совета Крыма было захвачено отрядом неизвестных вооруженных лиц в камуфляжной форме, захватившие пустили внутрь группу депутатов, предварительно отобрав у них средства мобильной связи. Но Конституция Украины (статья 136) предусматривает обязательное согласование кандидатуры председателя правительства Крыма с президентом Украины. По словам спикера Верховного совета Крыма В.А. Константинова, ему звонил В.Ф. Янукович, которого парламентарии считали президентом Украины, и устно согласовал кандидатуру Аксенова. How? По отобранному телефону?
В итоге депутаты избрали Аксенова премьером нового правительства (постановление № 1656-6/14). Правда, видеофиксация заседания не велась, журналисты на него допущены не были. Согласно официальному заявлению пресс-службы Верховного совета за это решение проголосовали 53 депутата. По данным ZN.UA, изначально в зале действительно находились 53 депутата, но некоторые из них покинули заседание. Более того, при рассмотрении вопроса об отставке прежнего премьера А.В. Могилева и о назначении на этот пост С.В. Аксенова разгорелся скандал, и группа депутатов отказалась принимать участие в голосовании. Депутат С. В. Куницын отмечает, что в момент голосования в зале находилось всего 47 человек при кворуме в 51. По сообщениям некоторых депутатов, среди «проголосовавших» обнаружились фамилии не только не голосовавших, но и фамилии отсутствовавших.
Возникает вопрос: если полномочия двух из трех подписантов столь сомнительны, мог ли Конституционный суд признать Договор соответствующим Конституции по порядку подписания? Иначе получается, что проверка по форме подписания касалась не вопросов права, а свелась к проблеме правильности чернил, которыми Договор был подписан.
При проверке конституционности Договора по порядку его введения в действие Конституционный суд применил правовую интерпретацию во имя достижения заранее определенной цели. В Договоре (статья 10) сказано, что он «временно применяется с даты подписания и вступает в силу с даты ратификации», а Республика Крым считается принятой в состав Российской Федерации с даты подписания Договора (пункт 1 статьи 1). Суд признал эти положения соответствующими Конституции и попытался предельно подробно это обосновать (п. 3 постановления). В его обосновании фигурирует и Венская конвенция о праве международных договоров, допускающая такую возможность, и ссылка на собственную правовую позицию . Вроде бы все убедительно и правильно. Только почему-то нет упоминания части 2 статьи 65 Конституции России, отсылающей суд в данном конкретном случае к специальному конституционному закону, которым он должен руководствоваться при оценке Договора.
А Закон как раз устанавливает жесткое правило именно для такого вида международных договоров, как договоры о принятии иностранного государства в состав России в качестве ее субъекта. В нем (часть 2 статьи 91 Закона «О принятии») однозначно определено: «международный договор не подлежит введению в действие и применению, то есть не может быть ратифицирован, утвержден и не может вступить в силу для Российской Федерации иным образом, если Конституционным Судом установлено его несоответствие Конституции». То есть до решения суда такой договор применяться не может. И суд это прекрасно понимал. Настолько хорошо понимал, что даже не использовал свою любимую формулу о том, что рассматривает исключительно вопросы права, которую обычно применяет в скользких политических ситуациях. Суд прямо заявил: «То, что Республика Крым считается принятой в Российскую Федерацию с даты подписания Договора, носит характер принципиального политического волеизъявления».
Еще в 1995 году при проверке конституционности указов президента Ельцина по использованию вооруженных сил в Чечне Конституционный суд заявил, что государственная целостность является «одной из основ конституционного строя Российской Федерации». Что «Конституция Российской Федерации не предусматривает возможности одностороннего решения вопроса об изменении статуса субъекта Российской Федерации и о его выходе из состава Российской Федерации». А раз так, то в силу принципов добросовестности и последовательности Россия обязана была уважать и право Украины на территориальную целостность.
Эта правовая позиция никем не была оспорена и не подверглась корректировке самим судом. А значит, была обязательна для исполнения. Статья 6 Закона «О Конституционном Суде» гласит: «Решения Конституционного Суда Российской Федерации обязательны на всей территории Российской Федерации для всех представительных, исполнительных и судебных органов государственной власти, органов местного самоуправления, предприятий, учреждений, организаций, должностных лиц, граждан и их объединений».
Это, пожалуй, один из самых важных вопросов: откуда в Договоре о присоединении Республики Крым взялся город Севастополь и каковы правовые основания его присоединения к России?
Как мы помним, в состав России в качестве нового субъекта могло быть принято иностранное государство. И если Автономная Республика Крым имела достаточное количество государственных признаков, чтобы самоопределиться, самопровозгласиться и быть признанной в качестве независимой иностранным государством , то город Севастополь сделать этого не мог никаким образом. Потому что он не входил ни в Крымскую область на момент разрушения СССР, ни в Автономную Республику Крым на момент проведения общекрымского референдума.
Указом Президиума Верховного совета РСФСР от 29 октября 1948 года №761/2 Севастополь был выведен из состава Крымской области и стал городом республиканского подчинения. Постановлением Президиума Верховного совета РСФСР от 5 февраля 1954 года «О передаче Крымской области из состава РСФСР в состав Украинской ССР» передавалась Крымская область, а не Крымский полуостров. Севастополь к этому моменту уже шесть лет как не находился в ее составе. Передача Севастополя Украине состоялась в результате заключения 19 ноября 1990 года двустороннего договора между Украиной и Россией, в котором стороны отказывались от взаимных территориальных притязаний. Впоследствии данный принцип был закреплен в договорах и соглашениях между государствами СНГ. Об особом статусе города Севастополя в составе АРК говорилось лишь в тексте Конституции Республики Крым 1992 года, вопрос о возврате к которой не получил большинства на общекрымском референдуме 16 марта 2014 года.
То есть на момент подписания Договора Севастополь не являлся иностранным государством и не мог быть принят в состав России по тем же правилам, что и Республика Крым. Для таких случаев в Законе «О принятии» (часть 2 статьи 4) предусмотрена совсем другая процедура: «Принятие в Российскую Федерацию в качестве нового субъекта части иностранного государства осуществляется по взаимному согласию Российской Федерации и данного иностранного государства в соответствии с международным (межгосударственным) договором, заключенным Российской Федерацией с данным иностранным государством».
Здесь, как и в случае с доратификационным временным применением Договора, Конституционный суд должен был руководствоваться прямой конституционной отсылкой: «Принятие в Российскую Федерацию и образование в ее составе нового субъекта осуществляется в порядке, установленном федеральным конституционным законом» (часть 2 статьи 65 Конституции). Чтобы установить соответствие Договора Конституции, суд был обязан проверить его на соответствие Закону «О принятии». But did not do it. А если бы сделал? Может быть, тогда по-другому пошла бы история? Когда наши внутренние законы нарушаются только по отношению к нам самим, это еще полбеды. Но в данном случае ситуация иная — нарушение внутреннего законодательства нанесло ущерб людям и государствам за пределами страны. И сделал это своими руками один из высших судов России.
Сейчас много говорят и пишут о том, что причина противостояния России с ее вчерашними международными партнерами коренится в поразившем мир цивилизационном разломе, в котором Россия выносится за рамки системы европейских достижений и ценностей. Цивилизационно-историческая типология — теория, безусловно, красивая. Звучит она гордо и убедительно. Настораживает только ее тупиковая простота, поскольку с ее помощью можно без труда обосновать практически любые поведенческие странности.
Фатальная «загнанность» в цивилизационные модели искусственна. Она — всего лишь удобный пропагандистский прием для обоснования отказа от развития или для сокрытия истинной причины такого отказа. Не случайно разговоры о цивилизиционной особости России зазвучали с новой силой именно тогда, когда в ее гражданском обществе естественным путем начал осуществляться переход к европейской модели развития. Когда граждане начали понимать, что государство — это не сакральная сущность, данная им свыше, а всего лишь содержащийся на их собственные налоговые отчисления аппарат для выполнения определенных ими же общественно значимых функций. Потому что пока государство продолжает быть субъектом, осуществляющим полномочия верховного собственника, гражданское общество как контролер и участник принятия государственно-властных решений будет встречать его отчаянное сопротивление.
Проблема вовсе не в разнице цивилизаций. Как только в России начал меняться общественный запрос к государству и взгляд населения на его природу, назначение и место в обществе, это стало представлять реальную угрозу для власти. А поскольку такие изменения появились в результате комплекса конкурентных факторов (конкуренции бытия, конкуренции смыслов, конкуренции информации и глобализации), закономерной защитной реакцией государства стала борьба с этими самыми факторам. Первые удары были нанесены по СМИ, интернету и образованию — по школьным программам и учебникам. Чтобы устранить конкуренцию информации и конкуренцию смыслов. А потом под видом ответа на международные санкции взялись за конкуренцию бытия — за ограничение международного обмена, усложнение выезда граждан за пределы страны и за удаление с полок магазинов образцов, свидетельствующих о серьезных конкурентных преимуществах их производителей.
Но кое-что от цивилизационной проблемы здесь все-таки есть. Только речь идет не о разных типах цивилизаций, а о разнице между цивилизацией и варварством. Потому что в современном мире водораздел между ними проходит по отношению людей к праву. В условиях, когда государство становится все больше и больше услугой, качество которой оценивает общество, именно право становится той всеобщей цивилизационной ценностью, о сохранении и развитии которой заботятся все вместе. Это не просто перечень правил, а основанный на международной морали мирного сосуществования набор стандартов, о котором общества и государства договорились. Они возвели эти стандарты в закон, обеспечили специальными процедурами, и каждый со своей стороны обязался их соблюдать под контролем и во взаимодействии друг с другом.
Парадокс, но точнее всего эту мысль выразил именно председатель Конституционного суда России Валерий Зорькин. В своей статье «Цивилизация права» он написал: «И большинство человечества договорилось о следующем. Проводим честные выборы. Принимаем в качестве лидера того, кому доверяет большинство. Ограничиваем этого лидера рамками закона. И живем до следующих выборов. Человечеству, уставшему от двух мировых войн, напуганному перспективой третьей мировой войны, возжелавшему элементарного покоя и радостей частной мирной жизни, показалось, что можно добиться стабильности на основе такого простейшего общественного договора. Так в итоге была построена — на основе огромных жертв, методом кровавых проб и страшных ошибок — цивилизация права».
That's right. Россия тоже попыталась пойти по такому пути. Но практически сразу на нем появились две формализованные правом оговорки, которые обусловили неизбежный поворот в сторону — «как бы» честные выборы и невозможность ограничения законом лидера. И ничего не вышло. Потому что право — это сбалансированная многомерная система. В ней нет мелочей, которыми можно безболезненно пренебречь или пожертвовать без угрозы для существования системы в целом.
Стоит только добавить, что в своей оценке действий России госпожа Меркель немного ошиблась в датах. Несвязанность властителей своими же законами — это не «закон джунглей образца XIX—XX веков». Обоснование такой несвязанности приводилось еще в IV веке до н.э. в китайской книге «Шан цзюнь шу» («Книга правителя области Шан»). И председателю Конституционного суда России — специалисту по истории политических и правовых учений профессору Валерию Зорькину это, безусловно, хорошо известно. «Если право погибает, то мир окажется у края бездны», — написал он. Во многом благодаря возглавляемому им суду мы уже там оказались. Неспособность давать оценку, исходя из верности духу права, духу цивилизации, на этом праве построенной, — это варварство. А варварство лечится. Не мгновенно, но лечится. Pretty simple. Образованием и культурой.
