
The Investigative Committee initiated the case of the "rehabilitation of Nazism" in Ukraine. This was announced by the official representative of the department Vladimir Markin. The case was opened under part 2 of article 244 (desecration of a structure devoted to the fight against fascism), which provides for up to five years of the colony, and part 3 of Article 354.1 of the Criminal Code (public desecration of symbols of military glory of Russia), the sanction of which is up to a year of service.
Article 354.1 is included in the Criminal Code in May 2014. It is entitled "Rehabilitation of Nazism"; Meanwhile, the Nazism is not mentioned in the disposition of part 3 of the article - we are talking about "the spread of the explicit disrespect for the society of information about the days of military glory and commemorative dates of Russia related to the protection of the Fatherland, as well as the desecration of symbols of the military glory of Russia, committed publicly."
In the case, a number of episodes dating from 2014. This is the destruction of the monument to 32 "soldiers-liberators" who died in the Second World War (January 6, the city of clayan, Lviv region), damage to the monument to the dead sailors and ships of the Black Sea shipping company (February 10, Odessa), the demolition of the monument to the Soviet "soldier-consumer" (February 22, Stry, Lviv region), and the depreciation of the victim’s memorial Holocaust (March 18 and 5, Novomoskovsk, Dnipropetrovsk Region), destruction of the monument to the dead soldiers of World War II (April 9, the city of Sukhoi Liman, Odessa region), desecration of the Memorial Menorah in Baby Yar (September 24) and damage to the memorial board to the Hero of the Soviet Union Peter Vasilevsky (October 7, Kharkov).
"These monuments are symbols of the military glory of Soviet soldiers in the fight against fascism, and since the Russian Federation is the successor of the USSR, the indicated illegal actions are directed against the interests of the Russian Federation," Markin noted. Then he referred to part 3 of Article 12 of the Criminal Code (the effect of the criminal law in relation to persons who committed a crime outside the borders of the Russian Federation), according to which the Code of Code applies to crimes committed abroad if they are directed against the interests of Russia. This official explained the initiation of the case.
Markin did not specify what the monuments to the victims of the Holocaust have the “military glory of Soviet soldiers”.
