
In the case of hiding the flag of the Federal Republic of Germany on the garage of the Kaliningrad UFSB, the victim suddenly changed. This was reported to the "Franes" by lawyer Dmitry Dinze, representing the interests of one of the accused in the case, activist of the Committee of Public Self -defense Mikhail Feldman. Hearing on the case go to the Central District Court of Kaliningrad; Judge Aleksey Kolnyakov is conducting the process.
During the investigation, the victims in the case recognized the department of the organization of war veterans, labor, the armed forces and law enforcement agencies in the Leningrad district of the regional center. The representative of the department was someone Sergey Athos. Meanwhile, a representative of this organization in the Moscow district of the city appeared at a meeting on Monday - 93 -year -old Boris Glibin, who, unlike Athos, is indeed a veteran of World War II.
At the same time, the change of the victim was not recorded in the case.
Glybin explained that he was authorized by the board to appear in court. At the same time, he was not familiar with the case file. Dinze filed a motion for a break to study the case by a veteran. Menikov satisfied the petition.
Further, during the interrogation, the blocks of many questions gave unchanged answers. In particular, he found it difficult to answer what kind of moral and political guidelines were torn by the action of the defendants. When asked whether he experienced moral suffering in connection with hanging the flag, Glibin replied: "If every case to worry, you will go crazy." When the veteran was asked what punishment he would consider fair for the accused, he replied that he was leaving a decision on this score at the discretion of the court.
At the same time, when the Glybin read out the testimony of Athos, he said that he was fully supported. The veteran also said that he did not consider it possible to hang out flags without coordination with officials. Glibin called his attitude to modern Germany, explaining that its foreign policy is below any criticism, since this country does not support Russia ( fragments of the interrogation of Boris Glybin ).
Hearing on the merits of the case began on March 16 . All three participants in the action-44-year-old Feldman, 27-year-old Oleg Savvin and 24-year-old Dmitry Fonarev-are charged with part 2 of Article 213 of the Criminal Code (hooliganism based on political hatred or enmity, committed by a group of persons by prior conspiracy), which provides for the seven years of the colony. In addition, Feldman is also charged with part 1 of Article 222 of the Criminal Code (illegal turnover of explosives), the sanction of which is up to four years.
According to the accusation, the Feldman hung the flag on the UFSB garage, which Savvin and Fonarev raised his hands on the clutch. Meanwhile, Fonarev in court stated that it was he, and not Feldman hung the flag.
The 222nd article Feldman was imputed for the fact that he allegedly acquired and stored 357 grams of industrial explosives PVV-7. It is stated that, going to the action, he also put explosives in his backpack.
The action with the flag was posting was held early on the morning of March 11, 2014. On the same day, at different times, Feldman, Fonarev and Savvin were detained. All three were sent under administrative arrest on charges of petty hooliganism. The protocols claimed that they "cursed". Subsequently, the arrests were extended by far -fetched accusations.
All three were released only in early April. However, on April 21, Fonarev was again detained - already in a criminal case. Feldman and Savvin were also detained later. On April 28, the court sent the detainees to the pre -trial detention center.
On December 2, the ECHR registered Fieldman's complaint filed in mid -October. Russia, approved in the complaint, violated in relation to the arrested Article 5 (the right to freedom and personal integrity) and 10 (freedom of expression) of the European Convention.
The prosecutor's office approved the indictment in the case only from the third time .
