
Judge of the Lefortovo District Court of Moscow Elena Kaneva extended the Crimean prisoner Alexander Kolchenko, the term of detention in the Lefortovo pre -trial detention center until May 16. This was reported by the correspondent of "faces" from the courtroom. The senior investigator for particularly important cases of the Investigative Department of the FSB Major of Justice Artem Burdin, the leading Politzeck case, petitioned for the extension of the arrest. The previous term of the arrest of the Crimean prisoner expired on April 16.
One of the arguments in favor of the further maintenance of Kolchenko in the pre -trial detention center Burdin called the fact of an activist’s trip to Kyiv to Euromaidan. The lawyer of Politzek Svetlana Sidorkina cited as counterarguments the positive characteristics of her client, and also referred to the fact that the investigation was already completed. However, the judge took the side of the investigation.
On the eve of Kanev - also at the request of Burdin - extended the arrest to another Crimean prisoner , Oleg Sentsov.
On March 31, Kolchenkowas a final charge . As before, only one episode is charged with an activist - participation in the arson of the Simferopol city headquarters of United Russia on April 18, 2014. This episode is qualified under part 2 of Article 205.4 (participation in the terrorist community) and paragraph "A" of part 2 of Article 205 of the Russian Criminal Code (a terrorist attack committed by an organized group). The sanction on the first of these accusations is up to 10 years in the colony, and the second - up to 20 years.
Kolchenko himself does not plead guilty. Confirming his participation in the arson of the EP headquarters, as a result of which the window of the building was burned, he protests against the qualifications of these actions on the "terrorist" articles of the Criminal Code. In addition, he denies involvement in the Sentsov campaign, whom the FSB is trying to present the leader of the "Derevoy Sector" sabotage group.
In turn, Sidorkina doubts the legitimacy of the qualification of one episode in two articles at once.
Along with Kolchenko and Sentsov in the case, there were initially two more defendants - Gennady Afanasyev and Alexei Chirniy. However, they made a deal with the investigation, having stipulated Sentsov, and their affairs were allocated into separate production. On December 17, 2014, the Moscow City Court, having examined the Afanasyev case in a special order, sentenced him to seven years of maximum security. The case of Chirniya was recently sent to the prosecutor to approve the indictment.
Kolchenko insists that he is a citizen of Ukraine. Meanwhile, the FSB claims that he has Russian citizenship. Sidorkina applied to the illegitimate Kyiv district court of Simferopol with a lawsuit to recognize her client by a Ukrainian citizen. However, on January 28, 2015,the lawsuit was rejected . The lawyer proved in court that Kolchenko did not file an application for admission to Russian citizenship, while the defendant - the Federal Migration Service of the Republic of Crimea - argued that such a statement was received from an activist.
Earlier on Thursday, it became known that Kolchenko filed a complaint with the ECHR against the forced assignment of Russian citizenship. The activist noted that Russia violated Article 8 (the right to respect for private and family life) of the European Convention, while earlier the Strasbourg court repeatedly indicated that the right to receive or maintain certain citizenship is one of the convention guaranteed by the Convention.
According to the new norm of the Code of Criminal Procedure of the case on the "terrorist" articles of the Criminal Code of the Criminal Code, only two district military courts: Moscow in the capital and North Caucasus in Rostov-on-Don. As Sidorkina suggests, the process of Crimean prisoners will take place in Rostov.
