Issuance of management licenses began in the Samara region

The first results of work on licensing management companies (MCs) in the region have become known. The commission reviewed 70 applications, 64 companies received licenses, and six management companies were denied documents for various reasons. These are four companies from Samara and two from Tolyatti. Another Samara organization withdrew its application for a permit at its own request. According to the chairman of the commission, Viktor Chasovskikh, companies that were denied a license can either try to challenge such a decision in court, or re-apply to the commission to obtain a license.

Yesterday the first meeting of the commission for licensing business activities for managing apartment buildings in the Samara region took place. As the chairman of the commission, Viktor Chasovskikh, told Kommersant, during the meeting 70 applications from the region’s management companies were considered, of which 64 companies received licenses, six were denied the issuance of a document, and the consideration of another 12 applications was postponed to next Friday. Among those who did not receive a license are four Samara companies - LLC "UK Vasko" (managed 1049 houses), LLC "Gazenergomontazh" (260 houses), two LLC "UK TVN" of the same name (19 houses) and two companies from Togliatti - LLC Residential Complex "Vesna" and LLC "ZhEK-2".

In addition, on Thursday Samara LLC Alternativa announced that it would not undergo the licensing procedure. The company manages 1,881 apartment buildings of the 6th and 7th improvement categories (dilapidated and dilapidated residential buildings). The management of Alternative considered that maintaining such a fund was “economically inexpedient.” It is planned that the houses managed by Alternative LLC will be transferred to the municipal management company by June 1, 2015. The latter is being created in Samara in order to “insure” the city in case a number of management companies are unable to obtain a license.

Today in the Samara region there are more than 22 thousand apartment buildings, managed by 269 management companies, 241 housing cooperatives and 1303 homeowners' associations.

Let us recall that in June 2014 the State Duma adopted a law on licensing management organizations. According to the document, by May 1, 2015, all legal entities engaged in the management of apartment buildings will be required to obtain licenses. The issued license will allow the management company to operate only in one region. The housing inspection authority, through the court, will be able to revoke the permit for repeated violations of house management rules and failure to comply with instructions. For activities without a license or violations of work, management companies will be punished with fines of up to 500 thousand rubles. The implementation of the new law is entrusted to regional authorities. In the Samara region, licenses will be issued by the state housing supervision body, to ensure the activities of which a permanent licensing commission has been created.

It was not possible to get comments from Samara management companies that did not receive a license yesterday. Viktor Chasovskikh told Kommersant that LLC Management Company Vasko was denied a license due to incomplete disclosure of information. “The company received a negative conclusion from the State Housing Inspectorate. The same situation is with the Togliatti ZhEK-2 and “Vesna”, as well as LLC UK “TVN”. The second company, TVN, did not receive a license for another reason. All her documents were in order, but the commission members voted against issuing a license because they considered this company a “clone.” I believe that this is not entirely correct, but this is the decision of the commission,” said Mr. Chasovskikh. The Gazenergomontazh company has all its documents in compliance with the requirements of the law, but the commission refused to issue a license to it due to a large number of complaints from residents. “If this company goes to court, it will probably challenge this decision. The second option for all these companies is to reapply to the commission to obtain a license,” explained Viktor Chasovskikh, adding that in this case, specialists and company management will not have to retake certification exams (if they have already been passed. - Kommersant) - the certificate is valid within five years.

Mikhail Matveev, in an interview with Kommersant, noted that in accordance with the law, the commission does not have the right to refuse to issue a license to a management company if its activities meet formal requirements. “At the same time, no one can force a commission member to vote for or against. But if a situation arises that, according to some criminal code, members of the commission vote against it, even if it formally meets all the requirements, then it can appeal this decision in court and, most likely, will win,” said Mr. Matveev, emphasizing that the law on licensing criminal codes built in such a way that it is easy to obtain a license, but difficult to maintain. “After all, immediately after receiving a license, the management company can be checked for compliance with licensing requirements, including compliance with the requirements of the contract with residents,” explained Mikhail Matveev.

According to the secretary of the licensing commission, Viktor Davidenko, companies that have not received a license are required to manage the houses until a successor is chosen. “It will be determined either by residents by voting, or by the municipality through an open competition,” explained Mr. Davidenko. The competition must be held within 30 days from the date of notification of the refusal to issue a license, Mr. Chasovskikh added.
