Roskomnadzor intends to prosecute only those cases of public display of Nazi paraphernalia or symbols when it was carried out for the purpose of propaganda. The statement, published on April 15 on the department's website, says that a legal and linguistic examination of the law on extremism came to the conclusion that the demonstration of prohibited symbols without the purpose of propaganda is not a manifestation of extremism. This applies in particular to historical research.
The conclusion was prepared by order of Roskomnadzor by employees of the Department of Forensic Examinations of the Moscow State Law Academy named after O. E. Kutafin.
The SOVA Center, which monitors the misuse of anti-extremist legislation, supported the explanations of Roskomnadzor, but emphasized that this is not enough to “clarify the actions of the authorities as a whole” and amendments to the legislation are needed. Among other things, the SOVA reminded that the wording of a similar administrative article differs from the text of the law on extremism: the Code of Administrative Offenses requires only one sign - propaganda, or public display of prohibited symbols.
