In response to the draft law prepared by the Government, which allows employees of the penitentiary system to use physical force and special means in case of disobedience of a prisoner to his legal requirements, to suppress group violations of public order by prisoners, as well as to suppress any violations of the detention regime, the human rights community has prepared a package of anti-torture amendments. Recall that in its draft law , the Government proposes to significantly expand the powers of the FSIN officers to use force, for example, after the adoption of these amendments, it will be possible to use force even for minor violations, such as smoking in the wrong place or refusing to do exercises, while for educational purposes it will be allowed to use stun guns.
In response to the tightening of sanctions against prisoners, human rights activists come forward with their own initiative to draft such a law. For example, they propose to oblige the heads of correctional colonies to report to the local prosecutor's office and representatives of public monitoring commissions (POCs) "on every instance of the use of physical force and special means." For the use of any violence “not dangerous to the life or health of the convict, or the threat of violence against him”, human rights activists propose to punish with imprisonment for up to five years. If we are talking about risks to human health or life - from seven to twelve years in prison.
In a separate paragraph, human rights activists stipulate a ban on stun guns, since prisoners today are not diagnosed for the presence of cardiovascular diseases, according to the founder of the social network gulagu.net Vladimir Osechkin, "the use of stun guns to people with a sick heart will inevitably lead to death."
Among the anti-torture measures, there is also a proposal to introduce criminal penalties for the heads of the correctional colony and operatives for concealing the facts of beating prisoners and creating the so-called sections of discipline and order, as well as for monetary extortions from the prison contingent.
According to Osechkin, human rights activists sent a letter to the State Duma with a request not to adopt the law in this form and to start with holding a round table with the participation of public figures and members of the PMC.
