The Railway City Court of the Moscow Region recognized the conditions for the detention of civil activist Ildar Dadin in the capital's OP Basmannaya on the night of December 5 to 6, 2014. This was reported by the Public Verdict Foundation, whose lawyer Nikolai Zboroshenko represents the interests of the activist.
As stated in the decision adopted by the results of the consideration of a civil lawsuit, Article 3 of the European Convention (prohibition of torture) was violated in relation to Dadin. The court took into account that the area of the chamber in which Dadina was placed was less laid for one person, he was not provided with an individual sleeping place, food and bedding issued to the activist was “inadequate quality”, and the light in the cell did not turn off for the night.
At the same time, the court terminated the production of the same lawsuit regarding the complaint about violation of Article 5 of the European Convention (the right to freedom and personal integrity). As stated in the resolution, this requirement is subject to permission in the order of criminal rather than civil proceedings.
Consideration of a similar claim filed in connection with the content of Dadin in OP Yakimanka from November 21 to 22, 2014, was postponed on June 25 to interrogate witnesses declared by the activist. On the same day, the hearing was transferred according to another statement by Dadin - about the conditions of its maintenance in the building of the Zamoskvoretsky district court of the capital, its transportation in the "glass" and the use of handcuffs. The reason for the transfer was that representatives of the Office of the Judicial Department in Moscow did not receive a notice of the meeting scheduled on June 16.
In an interview with the Mediazona, Zboroshenko refrained from the answer to the question of whether there would be an application for the opening of a criminal case against employees of OP Basmannaya on the basis of a decision made on Tuesday. “We will wait for the decision to enter into force,” the lawyer noted.
On the evening of December 5, Dadin took part in an inconsistent procession along Myasnitskaya Street . Eight activists with a banner "Kyiv - tomorrow Moscow" blocked the street, lit fireers and moved towards Lubyanskaya Square, where the FSB is located. Five demonstrators, including Dadin, were detained and delivered to the Basmann. There they spent the night in two chambers with a size of 2 × 1.5 and 3 × 1.5 meters. The next day the activists were released.
At the end of January 2015, Dadin turned to the “Public Verdict” for legal assistance in connection with illegal detentions, inhuman conditions of maintenance in the police department, as well as torture that he was subjected to in August 2014 in OP Khamovniki .
Then, at the end of January, the case was opened against the activist under Article 212.1 of the Criminal Code (repeated violations at rallies). Dadin threatens up to 5 years in a colony. He is placed under house arrest .
