Judge Rybkin of the Zheleznodorozhny City Court of the Moscow Region on June 15 found the conditions of detention of activist Ildar Dadin in the Basmanny police station after his arrest at a rally on December 5, 2014, to violate Article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, which prohibits torture, inhuman or degrading treatment or punishment. This was reported to OVD-Info by Public Verdict lawyer Nikolai Zboroshenko, who represents Dadin’s interests. The decision has not yet entered into force: the police can appeal it within a month.
The complaint about the conditions of detention stated that Dadin and other detainees at the protest, left at the police department until the morning, were kept in cells measuring two by one and a half and three by one and a half meters without individual sleeping places; instead of the hot meals required by law, they were given only instant dry food. the rations were of poor quality and the overhead lights were on all night.
The complaint was filed in accordance with Chapter 25 of the Civil Procedure Code, which is devoted to appealing against the actions or inactions of officials and authorities. The burden of proof is placed on the body whose actions are being disputed, explains Zboroshenko. The complaint was filed at Dadin’s place of residence, and not at the police station, since, according to the defense, there is less chance of winning such a case in Moscow courts.
“Public Verdict” simultaneously appealed several cases of violations of the conditions of detention in Moscow police stations for participants in political actions, including Dadin personally. Thus, the consideration of similar complaints about conditions in the Yakimanka and Zamoskvorechye police departments continues in the Zheleznodorozhny Court (the next hearing on them is scheduled for June 25), another complaint is awaiting consideration in the Presnensky District Court of Moscow. The complaint about the conditions at the Meshchansky police station, already considered in the Zheleznodorozhny Court, was rejected. In general, these cases are very similar to one another, Zboroshenko notes. In addition to the above aspects, in a number of cases the lack of bedding (or “virtually paper” bed linen), the inability to easily obtain water, the lack of unhindered access to toilets and access to fresh air are mentioned.
Another complaint by Dadin is atypical: it concerns a violation of conditions of detention not at the police department, but at the Zamoskvoretsky District Court, where the detainee remained for two days in a guard room. In addition to the fact of detention in court, the use of handcuffs, lack of food, as well as transportation in the so-called “glass” - a cell in special transport with an area of half a meter by half a meter and a meter and a half in height are noted.
