EXMO Publishing House wants to block three pirate sites forever

The Eksmo Publishing House filed a lawsuit in the Moscow City Court in defense of its copyrights to three sites-online libraries Flibusta.net and Litmir.net and a torrent tracker Rutracker.org. According to RBC, the head of the legal department of the publishing house Maxim Ryabyko told about this.

If the court in legal disputes twice sides the publisher, this will lead to the eternal blocking of all three portals. The ability to send pirate sites to the eternal ban appeared among the copyright holders with the entry into force of the expanded version of the anti -pirate law.

The publishing house sent three separate claims for each site. The dispute with “Flibustust” began due to the books of the writer Ray Bradbury “451 degrees Fahrenheit”, “Dandelion Wine”, “Martian Chronicles” and “Golden Apples of the Sun” published on the website.

The publisher opposed Vasily Golovachev “Return“ Stopkrim ”,“ Trien ”,“ War Haarp ”,“ Absolute Player ”,“ The Fugitive ”,“ Rutracker.org ”. And from Rutracker.org,“ Eksmo ”demanded the links to the books of four authors - Gai Yulia Golovachev, Alexanda Orlov and Alexei Kalugina.

Updated anti -pirate legislation is valid since May 1, 2015. From this moment on, the law spread from films and television series also to books, music, software. Since May, Eksmo lawyers began to protect the rights to literary works belonging to the publisher. So far, Eksmo filed only the first claims.

Until now, the publishing house has managed to achieve the removal of specific content from the sites and temporarily blocking individual books on them through the Moscow City Court. This procedure is spelled out in the law: first, the plaintiff appeals due to a specific object and asks to impose preliminary interim measures - block this content. Such measures are applied to pirate sites until the copyright holder filed a lawsuit on the merits (this is allocated 15 days from the date of the Mosgorsud decision on interim measures) or refuse his claims.

The Moscow City Court satisfied the claims, and Roskomnadzor began blocking content for all three complaints.

Meanwhile, “Eksmo” did not satisfy these actions, so now the publishing house is fostering in resources in order to “obligate to stop creating a threat of violation and exclude the possibility of re -placing content without the consent of Eksmo, Ryabyko said.
