The case of Ilya Romanov. Court chronicle: Sixteenth day

In a meeting on July 10, in the case of the Nizhny Novgorod anarchist Ilya Romanov, who is charged with preparation for a terrorist act, attempted public calls for terrorist activities, illegal production, storage, transportation and wearing of ammunition, and the departure collegium of the Moscow District Military Court interrogated as a witness to the NPO “United Russia” Andrei Andrei Soloviev.

Previously, this witness was an investigator of the department for the investigation of crimes in the Nizhny Novgorod district of the SU SUD in Nizhny Novgorod. It was he who carried out the initial and additional inspection of the scene of the incident at night and thoroughbred on October 26, 2013 after the incident occurred in the trigger in the hands of the defendant of a home -made pyrotechnic device, as a result of which the anarchist was amputated by the left brush.

At the hearing, it turned out that the senior investigator of the Federal Security Service of the UFSB Kurkin twice interrogated this witness: the first time on March 4, 2015, and the second time later, while the protocol of the second interrogation was not drawn up - Solovyov gave some oral explanations that were not processed in any way.

At the trial, Soloviev said that during interrogations, all the information listed in the protocol played on his own, without any hint, because at that time he remembered literally all the details-the size of the square, where the incident was, the size of the funnel, which he allegedly observed there, and so on. It is worth noting that the witness at the preliminary investigation was questioned a year and a half after what happened, and for such a long period of time his memory retained all these details, but in the hearing, which took place four months after the interrogation, he could not reproduce the contents of the protocol in detail, because, according to him, he “forgot it” now. Even after the announcement of the interrogation protocol, the memory never returned to Soloviev.

The witness explained to the court that at the scene he saw a funnel with the burned edges, but indicated that these could be traces of a pyrotechnic. It should be noted that Sergey Ershov, questioned as a witness, who was understood during the inspection of the scene, did not remember any funnel at all.

From the little that Soloviev was able to recall, you can pay attention to the fact of the presence of the employees of the CPE and the FSB at the scene literally a few hours after the incident.

From the materials of the case it was possible to establish that Svetlana Volkova, who is a key witness to the prosecution, was indeed understood with an additional examination of the scene. However, as she found herself there, he is still a mystery - the protocol indicates that some police officers brought her, and the witness simply could not remember who found witnesses for the investigative action.

In general, the witness could not recall little: he did not remember who was present at the scene of the CPE employees, did not remember who interrogated the witnesses, did not even remember what the FSB investigator Kurkin spoke about with him during the repeated call. Summing up the interrogation of this witness, we can say that in the hearing a manifestation of memory loss was again observed among employees of the internal affairs and state security bodies-this has repeatedly occurred in this trial: during court interrogations of the inquiry officer Balakina-Kochchetkaya and the explosions of the FSB Kirsanov and Patrin.

After the interrogation of the witness, the defense side continued to announce the case file.

A record of the death of Sergei Vetoshko, who was hanging on November 13, 2013 in one of the police department of Nizhny Novgorod, was announced, less than a month after the incident with the undermining of the firecracker in the hands of the novels and the initiation of a criminal case against an anarchist. It was the Vetoshko that belonged to the system unit, on which a document with the text of the threats to the leadership of the city and the region and the Aryan Terror brochure was found. Creating and working with these files is attributed to Ilya Romanov, but the anarchist himself categorically denies all involvement in them.

The lawyer of the defendant Evgeny Gubin noted that for the investigation it is very convenient that the system unit belonged to a Vetoshko, because it is simply impossible to call the court and interrogate the dead person in order to establish the most important circumstances of the case.

Ilya Romanov himself explained that Vetoshko never knew. He noted that he generally has reason to assume that this computer did not belong to the specified citizen. When asked by the court, to whom the system unit could belong then, the anarchist explained that he has a hypothesis about this, that the head of the Nizhny Novgorod CPE himself worked on this computer with the help of remote access. The defendant made such a conclusion by viewing information about other materials stored on the seized system unit: videos, photographs, other documents. The anarchist noted that on Twitter there is an account under the nickname “Opera NN” ( https://twitter.com/opernn ), and there is an unsuitable opinion that this account belongs to Alexei Trifonov himself. So, as the defendant claims, the content of documents on the notorious system unit on topics is very similar to the content of the mysterious “operas NN” on Twitter.

Ilya Romanov’s repeated request to the UFSB Kurkin investigator to introduce the second set of keys to the rented apartment in which the anarchist lived a few days before the episode with the explosion of the pyrotechnic, and Kurkin’s resolution on recognition of keys as material evidence and introducing them to the materials lived as material evidence.

Lawyer Gubin explained that for a year and a half investigator Kurkin refused to introduce these keys, despite the fact that they were the most important material evidence, and introduced them only at the very end of the investigation. According to Gubin, the investigator really did not want to show that there was a second set of keys, since this fact would mean that, in the interval between the episode with the explosion of firecrackers and the official start of the search in the rented apartment, anyone could visit and, accordingly, to do it, which would like to work on a computer.

Ilya Romanov himself explained to the court that he had filed a motion to introduce the second set of keys twice, and the first time at the early stage of the investigation, which was refused. The police and FSB officers themselves knew about the keys themselves early in the morning of October 26, 2013, a couple of hours after the operation carried out by the anarchist after hospitalization due to injuries as a result of the operation of the firecracker. Employees of the CPE, the FSB, and then the interrogator of Balakina-Kochetkov, who he reported that pyrotechnic substances were stored and gave permission to use the keys at a certain address. However, the investigation authorities did not record the voluntary surrender of pyrotechnic substances, that is, simply put, the fact was ignored, which serves as a circumstance to stop criminal prosecution under the 222nd article of the Criminal Code “illegal acquisition, transfer, storage, transportation or wearing of ammunition”.

The interest in Ilya Romanov was a duplicate set of keys from this rented apartment. The defendant said that Svetlana Volkova called him very late in the evening of October 10, 2013 and asked for a meeting, saying that what would be discussed is not a telephone conversation. However, at the meeting that took place already late at night, the future main witness of the prosecution did not tell anything secret. It turns out that she was “just on the nerves”, because in the morning she had a trip to one of the district centers of the Nizhny Novgorod region for a trial on a property dispute with her own mother about the living space. Then she informed Romanov very dramatic details of the last few days: supposedly the mother expel her from the house, there is nowhere to live an unfortunate girl, so she will have to, apparently, agree to the option of living in the underground communications of the city of Dzerzhinsk near Nizhny Novgorod along with certain “Satanists”. Ilya Romanov was upset by the troubles of the unfortunate and offered her any feasible help. Then she said that there is another option, except for living in underground communications, but for this you need to pick up the keys to the apartment of her friend, who offered her to live there. The anarchist agreed. In the morning, October 11, he called this acquaintance, who turned out to be a realtor Oleg Chizhevsky, the future witness of the prosecution, and agreed on the meeting. In the evening they met, the realtor showed him an apartment and gave the keys, asked to make a second set, which was supposed to subsequently pick him up, Chizhevsky, “uncle”. Romanov did not even understand why he was shown this room, because he was not going to live there, even clarified Chizhevsky that he would not live there, but Sveta. However, the realtor seemed to have not noticed this phrase. The anarchist made a duplicate set of keys and suggested Svetlana to pick them up, but from that moment the girl began to avoid meetings with the future defendant.

In addition, a sheet of accounting for the time worked by Ilya Romanov was announced at the Sormovskaya confectionery factory for October 22, 23, 24 and 25. When comparing this document with the examinations of a system unit, withdrawn from a rented apartment, you can immediately notice that there were traces of working on the Internet on the computer while the anarchist was at work. But the investigation did not even make the slightest attempt to establish the face that led the work on the computer until the defendant was at home. “The investigator did not want to understand the case. He conducted an investigation with an obviously indictment. He did not accept any arguments, ”Ilya Romanov explained about the actions of the senior investigator of the Federal Security Service of Kurkin.

The next meeting is scheduled for Tuesday, July 14. Start - at 13.00 in the Nizhny Novgorod Regional Court. It is planned to interrogate the expert of the Ministry of Justice Krutov, who conducted an examination of the system unit, withdrawn during a search in a rented apartment.

Also on Tuesday, a consideration of the appeal of lawyer Yevgeny Gubin was appointed to extend the preventive measure against Ilya Romanov in the form of detention. The meeting will begin at 10.00 in the building of the Nizhny Novgorod Regional Court and will be held in a video conference with the Moscow District Military Court.
