
President Vladimir Putin signed the law on the transfer of elections to the lower house of parliament from December to September 2016. The law on the introduction of appropriate changes in Article 5 and 102 of the Federal Law "On the election of deputies of the State Duma" was published on the official Internet portal of legal information.
The election of deputies of the State Duma of the seventh convocation will be held on September 18, 2016. Subsequent parliamentary elections will also be held on the third Sunday of September. The State Duma will gather at the first meeting no later than on the 30th day after the election.
At the same time, the law provides for compensation in the form of social and financial guarantees for those deputies of the sixth convocation that will not be re -elected into the new Duma or to the state authorities of the constituent entities of the Federation or local authorities. Until December 4, 2016, they preserve the money, parliamentary inviolability, official housing and social insurance. For these purposes, according to financial and economic justification, maximum expenses from the federal budget in the amount of 713.7 million rubles are laid - at the rate of 1 million 586 thousand rubles for each of the 450 deputies.
The bill on the transfer of Duma elections from December 2016 on the third Sunday of September was submitted to the lower house on June 11 . The document was supported by representatives of the LDPR, United Russia and Just Russia. In the Communist Party, the transfer of elections was called "unconstitutional action and an absolutely illegal decision." The Communists promised to vote against the bill, and in case of adoption, appeal the decision in the Constitutional Court. On June 19, the State Duma adopted the bill in the first reading .
In the review of the bill from the Federation Council Committee on Constitutional Legislation, it was noted that the approval of the document to the upper house without the interpretation of the KS "is not possible." The interpretation by the Constitutional Court of the provisions of the Basic Law on the procedure for the formation of the State Duma "will eliminate the adoption of laws or their further application and interpretation in a meaning contrary to constitutional norms." At the same time, it is noted in the review of the Council, the Verkhskaya Chamber supports the concept of the bill itself.
On July 1, the Constitutional Court admitted the possibility of a single minor reduction in the term of office of the State Duma for the elections in September 2016. In this case, a number of conditions must be met. Firstly, such a measure can be extremely single. Secondly, the reduction in the term of powers of deputies "should be insignificant and not go beyond the limits of a few months." In addition, the transfer of the election date should be carried out in advance, in order not to limit the possibilities to prepare for the election campaign and political competition in the elections.
On July 3, the State Duma adopted in final reading the law on the postponement of elections. On July 8, the law approved the Federation Council.
