— When can the process begin?
— There is no date yet. But, most likely, preliminary hearings will take place at the end of July. My lawyers filed an appeal with the Moscow City Court, challenging the extension of the arrest: the period of detention was extended until September. “Ukrainian pilot Nadezhda Savchenko, accused in the Russian Federation of murdering Russian journalists, was taken to one of the pre-trial detention centers in Rostov-on-Don, her lawyer says.

The trial of Oleg Sentsov and Alexander Kolchenko, accused of terrorism in Crimea, has begun
“ The trial in the “case of Crimean terrorists” begins in Rostov on Tuesday morning. Four residents of Crimea have been accused of preparing sabotage and terrorist attacks on the peninsula annexed by Russia, including film director Oleg Sentsov . He has been in custody for more than a year. Along with him in the dock is anarchist Alexander Kolchenko . Sentsov and Kolchenko categorically deny their guilt.
According to the FSB, the goal of the attackers was to commit acts of sabotage and terrorism in Simferopol, Sevastopol and Yalta in the spring of 2014 - explosions of homemade devices near the Eternal Flame Memorial and the Lenin Monument in Simferopol, as well as arson of the offices of the public organization "Russian Community of Crimea" and the office of the party " United Russia". The prosecution is based on the testimony of two other defendants - this information, as stated by the defense, was obtained from them under pressure or under torture. However, formally Gennady Afanasyev and Alexey Chirniy admitted their guilt, agreed to a special procedure for considering their cases and have already received 7 years of imprisonment in a maximum security colony. Chirniy's lawyer Alexey Novikov tried to get the sentence reviewed because, in his opinion, there were clear signs of self-incrimination in the case by the defendant. Chirniy himself, however, confirmed that he signed the agreement with the investigation voluntarily, after which Novikov was removed from participating in his defense.
According to human rights organizations, pressure and torture were also used against 41-year-old Sentsov himself. The report of the mission of the Office of the UN High Commissioner for Human Rights in Ukraine noted that - according to Sentsov's testimony - they put a plastic bag over his head, suffocated him until he fainted, beat him with hands and a baton, and threatened him with rape and murder. Sentsov does not hide his political views, as well as the fact that he was an activist of Automaidan and during the Crimean crisis supported the movement for a united Ukraine, bought and delivered food and basic necessities to Ukrainian military units.
His cousin, Moscow journalist Natalya Kaplan, is in constant contact with Sentsov:
– Natalya, why exactly did you undertake to represent Oleg’s interests? Did you have close contact with him?
– We didn’t communicate much as children; we began to communicate closely in adulthood. Why me? Firstly, I live in Moscow. Secondly, it’s easier for me to do these things than for Oleg’s mother, who is already retired, it’s all hard for her... I don’t even know why this happened... I simply wouldn’t be able to sleep if I did anything differently.
– What do you expect from the trial?
“I don’t expect anything good from this trial in principle.” Oleg understands perfectly well that he can be imprisoned. He is mentally prepared for the fact that he will receive a sentence of 25 years in prison. Nevertheless, he does not give up and does not intend to give up. Like the entire past year, he does not intend to do what investigators expect of him. This is his clear position.
– Are you sure of Oleg’s innocence?
- Yes, one hundred percent. I know him well enough, Oleg and violence are fundamentally incompatible things. Secondly, the case against him is fabricated. If there were no terrorist attacks, where did the terrorists come from? The prosecution is based on the testimony of two people who were also tortured, like Oleg. Everything is sewn with white thread.
– Do the lawyers hope that the defense’s arguments will somehow be taken into account?
– Oleg has two lawyers – Dmitry Dinze and Vladimir Samokhin, and also has a lawyer in Kyiv. Lawyers rely on the European Court of Human Rights, this is our main hope. There is no particular hope for the Russian court. The task of lawyers is to soften the fate, reduce the possible sentence as much as possible, and ideally reclassify the case to some other milder article. Of course, the ideal option is to get Oleg out and completely acquit him. But we must understand that we are faced with Russian justice, and the reality is that this is unlikely given the current political situation in Russia.
– Can the Ukrainian side provide Oleg with some kind of legal assistance?
– Human rights activists are doing what they can. A Ukrainian lawyer represents Oleg’s interests in another case initiated in Kyiv, as a victim. But in general, it is difficult for Ukrainians to participate in the process. The realities of Russian justice are such that in order to participate in the process, you need to pass a qualifying exam on your knowledge of Russian legislation.
– Sentsov is being tried as a Russian citizen, although he did not ask to change his citizenship?
– Yes, Oleg is being tried as a Russian citizen, although he still has a Ukrainian passport. He did not renounce Ukrainian citizenship and never asked for Russian citizenship, but nevertheless he is considered a Russian citizen. This is also a paradox, and we also defend this point legally, so that he is recognized as a Ukrainian citizen.
– When was the last time you saw Oleg?
– We see each other exclusively in the courtroom. He is cheerful, jokes a lot, and is very worried about his children (he has two - Alina and Vladislav). We communicate only by mail or through lawyers, sometimes we exchange a few words. In the courts - with gestures, until no one sees, until the guards prohibit it.
– You don’t know how the transfer to Rostov went?
– I don’t know yet, I’m waiting for a letter, we still haven’t really established a connection. But we were immediately warned that he would be transported for two weeks. This is the so-called “Stolypin train”, which first gathers everyone, then transports everyone, this is a long process. As far as I know, at least he was not tortured - unlike the situation with the long transfer to Moscow from Simferopol. Then they allegedly transported us, just waited for the beatings to subside. Now it seems that this was not the case.
– What caused the choice of Rostov as the venue for the trial?
– Since 2015, Russia has adopted an amendment to the legislation stating that cases of terrorism are considered by a tribunal, a military court. There are two such ships in Russia, one in Moscow, one in Rostov-on-Don. Choose a court closer to the place where the crime is alleged to have been committed. Crimea is closer to Rostov, so the trial will be in Rostov. Plus, you need to understand that they, of course, don’t need extra hype: naturally, there will be much fewer people in Rostov who can come and support Oleg. This plays into the hands of those who started this whole mess. I don't know the details of the trial yet, but we expect the verdict to be handed down in about three months.
– Does Oleg have any opportunity to contact the second accused, Alexander Kolchenko?
“They were kept in a pre-trial detention center separately, they did not have the opportunity to communicate. Until now, they had not even met in the conference room, because each hearing was held separately, only in Rostov they were united.
– Did they know each other well before they were charged in the same case?
- No, you can’t say that they were friends. You have to understand: in Crimea there were not many opponents of annexation and people ready to do something in this regard. They met at some rallies and protests; rather, they were casually acquainted.
– Natalya, you unexpectedly came under strong moral pressure. The story with Oleg changed your destiny too. How do you feel?
– I feel fine. The most pressing thing is not the surveillance of me and wiretapping of telephone conversations, but the deathly silence and fear of those people whom I considered close. They just pretended nothing was happening."
“On Tuesday morning, the North Caucasus District Military Court in Rostov-on-Don began considering the criminal case of Ukrainian film director Oleg Sentsov and anarchist Alexander Kolchenko.
Activists who opposed the annexation of Crimea are accused of committing terrorist acts in Simferopol, and Sentsov, in addition, of creating a branch of the Right Sector organization banned in Russia, and of storing weapons, ammunition and explosives. Sentsov was detained by FSB officers on May 11, 2014, and since then Krzysztof Zanussi, Pedro Almodovar, and other directors and film artists have come out in defense of his colleague. The Ukrainian side opened a case regarding the abduction of citizens of the country, while Sentsov announced the torture he suffered during the investigation.
Rostov-on-Don did not notice the loud process. Several local activists came to court, but did not hold any actions in support of Sentsov and Kolchenko. “Of course, we support them, but the news about the conflict in Ukraine has become so familiar that I want to return to local problems, we have enough of them,” Margos Tiratsuyan, an activist in the Rostov branch of PARNAS, said in a conversation with a Radio Liberty correspondent the day before. The only activist who tried to provide tangible support to the accused was Vladislav Ryazantsev, who offered Kolchenko the services of a civil defender. However, judge Sergei Mikhailyuk rejected the petition, as well as the request of his cousin Natalya Kochneva to participate as Sentsov’s defense lawyer.
Ukrainian activists of the Center for Civil Liberties and the Committee of Solidarity with Crimean Political Prisoners were also unable to come to the trial. Among several dozen media outlets, there were officially no Ukrainian ones; Sentsov drew attention to this when court press secretary Alena Katalko read out the list of accredited publications. “Have Ukrainian media applied for accreditation? Well, great...” Sentsov drawled with disappointment when he heard a negative answer. Already during the trial, it became clear that Ukrainian journalists were either present in the courtroom or received information directly from their Russian colleagues.
Before the hearing, Sentsov’s lawyer Dmitry Dinze from Agora expressed doubt that the trial would be fair and that one could hope for an acquittal: “We actually expect little from the trial. I think that the verdict is a foregone conclusion, and Sentsov understands this. We will fight more to [reduce] the sentence than to ensure that he is acquitted, because I don’t think anyone will listen to us during the consideration of this case. Maybe we will even focus more on changing the qualifications. , that Alexey Chirniy and Gennady Afanasyev were given seven years, then all the other defendants in the case will receive no less. Alexey Chirniy and Gennady Afanasyev, whom Dinze mentioned, according to the investigation, were members of a terrorist group allegedly created by Sentsov. After their arrest, both entered into an agreement with the investigation, their case was considered behind closed doors, and both received seven years in prison. Afanasyev and Chirniy should become the main witnesses in the Sentsov-Kolchenko case. Moreover, today both the prosecutor and the defense insisted on their personal presence in the courtroom, contrary to the opinion of the judge who wanted to interrogate the convicts via video conference. “We want to look them in the face, especially since they had no confrontations with Sentsov,” says lawyer Vladimir Samokhin. Essentially, all the charges are based on the testimony of Chirniy and Afanasyev; according to the lawyers, there are no operational photographs or any more significant evidence in the case. In addition to the fact that the defenders are bound by a non-disclosure agreement, already in the courtroom they were given documents to sign regarding the secrecy of the case. Dinze and his colleagues refused to sign the papers, saying that they considered it unnecessary. As a result, the judge decided not to force the lawyers, but immediately stated that part of the hearing could be held behind closed doors, when classified documents would be considered.
At the trial, Oleg Sentsov behaved very confidently, sometimes even aggressively. When, at the end of the hearing, the judge asked him whether it would be a violation of his rights if the lawyers were distracted by other matters and returned to Rostov only six days later, he replied: “My rights have been violated in such a way that no more can happen.” During a discussion of the procedure for studying evidence, he said: “I don’t consider this court to be a court at all, you can consider what you want.” Dmitry Dinze, explaining the behavior of his client, noted: “Make allowances for the fact that he has been in prison for quite a long time, was subjected to torture and considers the case politically motivated. How else should he feel about what is happening?”
Sentsov spoke about torture after his arrest, when he was in the Lefortovo pre-trial detention center. The lawyer reported his words that they put a plastic bag over his head, choked him, threatened him with rape and beat him. “I believe the words about torture, and I believe his lawyers,” says Consul General of the Consulate General of Ukraine in Rostov-on-Don Alexander Kovtun, who was present at today’s meeting. “The official position on this case is this: these are citizens of Ukraine, and they must be on the territory of Ukraine “There are no claims against them from Ukraine for the alleged acts. It is unclear which Constitution they violated, which authorities they allegedly destabilized.” The Ukrainian consul tried to meet with Sentsov and Kolchenko, but was not allowed to see the accused. The investigation argued that since Sentsov and Kolchenko are residents of Crimea, they do not fall under the jurisdiction of Ukraine, despite the fact that only their Ukrainian passports are kept on file. The judge granted the next request for a meeting with the consul, but it looked like a mockery: permission can only be granted after a court verdict. But the request for a meeting with relatives was granted.
Unlike Sentsov, anarchist Alexander Kolchenko looked downcast, just like his mother, who came to the trial. They quietly talked through the glass of the “aquarium” until the bailiffs forbade any conversations with the defendants. Kolchenko asked about his relatives and whether his friends had visited his parents. Sentsov also willingly communicated with journalists and relatives. “I read a lot, here in the pre-trial detention center there is a wonderful library,” said the film director. “I’m currently reading Remarque’s Arc de Triomphe. This is the only thing I haven’t read by him yet. I don’t write myself. There is an opportunity, but why write if there’s nothing in my head doesn’t come. If you don’t have to write, don’t write. Judging by today's hearing, the judge decided to complete the case as soon as possible. If at the beginning of the day the lawyers assumed that it would take at least two to three months, then at the end they could not even tentatively answer the question about the timing. One gets the impression that Mikhailyuk is in a hurry to complete everything by the beginning of the hearings in the case of Ukrainian serviceman Nadezhda Savchenko in the Donetsk City Court of the Rostov Region, that is, by June 30. The prosecutor managed to read out the text of the accusation, and both victims were interrogated - the head of the executive committee of the "Russian Community of Crimea" movement, Andrei Kozenko, and a member of the political council of "United Russia" in Crimea, Alexander Bochkarev, who led the combined regiment of the "People's Militia of Crimea" in the spring of 2014. The offices of both organizations were set on fire in April last year, for which Sentsov and Kolchenko are now accused.
According to investigators, in the spring of 2014, Sentsov created a Right Sector cell in Simferopol to commit terrorist acts. “Sentsov repeatedly attended meetings of supporters of Crimea being part of Ukraine and said there that peaceful protests do not bring results, it is necessary to organize a group that can commit terrorist acts,” the prosecutor read. The prosecution claims that the terrorist attacks were intended to influence the “authorities” of the republic and destabilize the situation in order to return Crimea to Ukraine. This, according to investigators, the young people wanted to achieve by setting fire to the Simferopol offices of the Russian Community of Crimea movement and the United Russia party, as well as by blowing up the monument to Lenin. However, the latter was never implemented.
Already during the hearing, lawyer Dinze pointed out the absurdity of the wording about the desire of Sentsov and Kolchenko to “influence the authorities” and “destabilize the situation.” “Tell me, how did your burnt window destabilize the situation in the republic?” – he asked Alexander Bochkarev. “This was not the first arson, and conversations began among people: “Today they set fire, and tomorrow they will start blowing up.” Damage was caused to the leadership of the republic. There was talk that it could not cope with the situation. Doesn’t this damage the authority of the authorities? In addition, , the police were a little demoralized at that time. The situation was nervous,” Bochkarev responded to this. “Didn’t the referendum destabilize the situation?” – the lawyer asked again. “He united the people of Crimea and showed that in Crimea there are normal people, unlike Dill,” said Bochkarev, who, however, could not say which government bodies suffered from the actions of the arsonists at the United Russia office. By the way, interesting details have emerged: the office building, previously owned by the Party of Regions, was transferred to United Russia along with its members and owners. “We are not even legal successors, but the same people, only in a different capacity,” Bochkarev said proudly.
The entire logic of the lawyers’ statements invariably broke down when faced with the victims’ fear of the Right Sector. Moreover, it turned out that no one saw the organization’s activists in Crimea, but everyone heard about them in the Russian media. “Name a number of people who, in your opinion, are members of the Right Sector and were active in Crimea,” lawyer Dinze asked Andrei Kozenko. “In Crimea, the Ukrainian nationalists of the Right Sector were not active because we did not give it to them. I do not know such persons,” the social activist answered. Dinze: “Have you heard that representatives of the Right Sector tried to destabilize the situation in some other way other than setting your door on fire?” Kozenko: “From media reports that nationalist elements were constantly trying to penetrate into the territory of Crimea. There were also statements by the leaders of the Right Sector that they were going to do this.”
Dinze asked Bochkarev about the same thing. “We met the train where these young men were traveling. They jumped like hares when they found out that we were waiting for them. You didn’t see this, but I did it. I detained the scoundrels with my own hands,” said the United Russia member. “How did you determine that these were members of the Right Sector?” - “If they come from Western Ukraine, then who else. Andrei Kozenko admitted that he could not determine whether Sentsov and Kolchenko were the arsonists.
The next hearing is scheduled for July 27, and the judge insists on almost daily further work. All attempts by the defense to ask for time to develop consolidated decisions and simply to consult with their clients were rejected by the judge.”

Об этом в субботу сообщил адвокат активистки Андрей Сабинин. "Потерпевшего на допросе мы не увидим", - заметил юрист. Поскольку статья 319 УК (оскорбление представителя власти), вмененная Полюдовой, обязательно предполагает наличие потерпевшего, Сабинин добивался очной ставки Полюдовой с Путиным.
О возбуждении против Полюдовой дела по 319-й статье стало известно 26 июня . Активистку преследовали за репост из ВК-группы "Путин – х<…>ло в квадрате" . Полюдова уточняла, что лишь один раз перепостила сообщение из этой группы - в начале августа 2014 года. Дата и время судебного заседания в Советском районном суде Краснодара по делу Юлии Усач пока не назначены. "Повестки я не получала, сегодня звонила в канцелярию суда, но и там мне не сообщили, когда будет рассмотрено мое дело", - сообщила сегодня корреспонденту "Кавказского узла" Юлия Усач.
По словам активистки, 1 июля к ней на работу пришел сотрудник отдела "Э" и сообщил, что "проводит проверку по поводу постов Юлии Усач в социальной сети "ВКонтакте" на предмет их экстремистского содержания".
Полицейский отметил, что на краснодарских активистов Юлию Усач, Дарью Полюдову и Виктора Чирикова "пришла жалоба в полицию от гражданки, которая жаловалась на содержание страниц активистов в сети Интернет", заявила активистка.
"Жалобу мне не показали. Я думаю, это вымышленный персонаж", - заявляет Усач. Она также отметила, что сотрудник отдела "Э" спрашивал ее о том, давно ли она знает краснодарскую активистку Дарью Полюдову и Виктора Чирикова.
"Я сообщила, что видела Дарью только один раз на "Марше миллионов" в Краснодаре в июне 2012 года, а потом мы общались только в Интернете", - сообщила Юлия Усач.

"Мне показалось, что мои объяснения сотрудника устроили. Но 15 июля меня вызвали в прокуратуру Карасунского округа Краснодара", - сообщила Усач.
По ее словам, дежурный следователь показал скриншот ее страницы "ВКонтакте" и сообщил, что против Юлии Усач возбуждено административное дело по статье 20.3 Кодекса об административных правонарушениях РФ (пропаганда или демонстрирование нацистской символики), которая предусматривает наказание в виде штрафа до двух тысяч рублей, либо 15 суток ареста.
"Разговаривали со мной некорректно, открыто обвиняя в экстремизме. Я сообщила, что на своей странице репостила карикатуры Кукрыниксов ( творческий коллектив советских художников-графиков и живописцев, - прим. "Кавказского узла" ). На что следователь мне сказал, что, если нужно, и их привлекут к ответственности", - сообщила Усач.
Активистка отметила, что с делом ей ознакомиться разрешили, но фотографировать его страницы не дали.

В прошлом году выступала против запрета абортов, высказывалась против преследования организаторов выставки "Тайны тела", против которой протестовали православные активисты.
По мнению Усач, "возможно, эти акции припомнили сейчас". При этом, по словам Усач, она "участвовала только в согласованных с властями акциях, поэтому ранее преследованиям не подвергалась".

«[Бывший следователь Павел Ясман:] Когда произошла акция Петра Павленского с покрышками (23 февраля 2014 года акционист и его соратники подожгли покрышки на мосту у храма Спас на Крови. — Прим. ред. ), я ещё не жил в Петербурге, только видел сюжет на телевидении. К моему переезду уже возбудили уголовное дело, но Павленский по нему проходил как свидетель. Расследование передали мне, и оно стало одним из моих первых дел в Петербурге. Кроме него, было ещё несколько расследований убийств.
Впервые с Павленским мы встретились при обыске. Я пришёл в составе следственной группы к нему на квартиру. Мы долго стучали в дверь. Нам никто не открывал. Потом, судя по всему, тот, кто был дома, позвонил в полицию. Сотрудники полиции пришли разбираться, кто мы такие и с какой целью ломимся в квартиру. Мы показали разрешение на обыск, полицейские ушли. Павленский дверь открыл, мы провели обыск. Так и познакомились.
Отношение к Павленскому у меня было самое обычное. Вы думаете, следователь обязательно чувствует ненависть к подследственному? Павленский, разумеется, показался мне очень интересным собеседником.
В конце июля прошлого года я написал заявление об увольнении по собственному желанию. Просто понял, что защищать людей от обвинений как-то порядочнее, честнее, чем выступать на стороне обвинения. Свою роль сыграла и ситуация с Павленским, но не то чтобы она была решающей. <…>
Как-то раз мне позвонила Светлана [Ратникова, адвокат Павленского] и спросила, могу ли я встретиться. Я подъехал — а там Павленский сидит без уха ( 19 октября 2014 года художник провёл в Москве очередную акцию: на глазах у десятков очевидцев он отрезал себе мочку уха, предварительно забравшись на крышу института имени Сербского. Таким образом Павленский протестовал против использования психиатрии для политических репрессий. — Прим. ред. ). Я спросил: «Как тебе без уха живётся?» Он говорит: «Нормально». Я говорю: «Молодец». Он рассказал о своей задумке: заявить меня в качестве собственного защитника. Я ответил: «Пойми, для меня как адвоката это, может быть, и было бы интересно, но в рамках Уголовно-процессуального кодекса я не могу ничем тебе помочь». Я не мог быть защитником, потому что сам расследовал это дело.
Но ходатайство в суд ( о привлечении Павла Ясмана как третьего защитника. — Прим. ред. ) всё равно заявили — возможно, это определённая линия защиты, я не знаю. Так что 15 июля 2015 года я пришёл на заседание, и судья обоснованно отказала в удовлетворении этого ходатайства. Как адвокат над делом Павленского я никогда не работал. По-человечески отношусь к нему нормально, точно без антипатии.
Наш суд, как известно, самый гуманный в мире. Думаю, судья вынесет справедливый приговор. А каким он будет — обвинительным или оправдательным — только судье и известно. А моя история и мне самому кажется необычной. Чем она завершится — я не знаю».
« Следователь Павел Ясман вел дело о поджоге покрышек на Мало-Конюшенном мосту. К акционисту Петру Павленскому он приходил с обыском, трижды пытался отправить его к психиатрам, оба долго разговаривали об искусстве. 8 августа Ясман уволился из Следственного комитета. 10 декабря он получил статус адвоката, а 15 июля 2015-го пришел на первое заседание по делу Павленского в полной готовности предоставить ему защиту. Метаморфоза обвинителя впечатлила публику. Говорили о "Стокгольмском синдроме наоборот", выдвигали Ясмана на премию "Поступок года", называли случай абсолютной победой искусства над карательной системой.
- Павел Александрович, после прихода в суд в качестве адвоката общественность уверена, что Павленский вас переубедил, и именно из-за него, готового на радикализм, вы перешли на другую сторону.
– Павленский в моем уходе из СК сыграл далеко не первую роль. Он, наверное, каким-то образом повлиял, но не генерально. Мне надоела работа. Я в органах прокуратуры и следствия с 2006-го, восемь лет провел. Надо было менять род деятельности.
– Адвокат Павленского Дмитрий Динзе – тоже бывший следователь.
– И это далеко не единственный пример.
- В чем ваша причина?
– Защищать правильнее, что ли, чем обвинять.
- Вы ушли сами или, может, вас попросили после публикации вольнодумных диалогов в интернете?
– Я написал заявление по собственному желанию. О мотивах меня не спрашивали. Подписали, и все. Может, руководство наши разговоры об искусстве и не видело.
- Вы не включали их в протоколы допроса?
- Certainly. Павленский фактически не давал показаний, мы просто беседовали.

- 15 июля Павленский попросил суд допустить вас к процессу в качестве своего адвоката. Это воспринималось как абсолютная победа акциониста над системой. Дескать, переманил на свою сторону.
– Это ходатайство было заведомо обречено. Статья 72 статья УПК запрещает следователю быть адвокатом. Но я знал, что оно будет заявлено, а Павленский – что его не удовлетворят. Перед судом он говорил мне: "Я хочу, чтобы ты был моим общественным защитником". Я ему ответил ровно то же самое – закон запрещает. 15-го пришел в суд на случай, если бы решили узнать мою точку зрения. Я бы не отказался защищать, но сослался на 72-ю и оставил решение на усмотрение суда.
- Значит, это очередной перфоманс Павленского?
– Лучше у него спросить. Мы знали, что меня не допустят.

- Как считаете, на Мало-Конюшенном мосту было совершено преступление?
- Hard to tell. Не знаю, какие доказательства представлены. Когда я оставил это дело, оно было не готово к передаче в суд.
- У следователя есть полномочия прекратить дело за отсутствием состава преступления. Вы пытались прекратить?
- No.

– Надо верить в то, что делаешь. Это действительно круто».
«Расследованием дела художника занимался сотрудник Следственного комитета Павел Ясман: стенограммы его допросов Павленского, больше похожих на беседы о природе искусства, бурно обсуждались в СМИ год назад. Недавно же стало известно, что Ясман уволился из органов и попытался стать адвокатом Павленского. <…>
– У многих людей, прочитавших вашу историю, сложилось впечатление, что вы благополучно работали следователем, потом познакомились с Павленским, он как-то изменил ваше мировоззрение, и вы не просто решили уволиться из органов, но еще и встали на его сторону. Is it so?
– Что вы подразумеваете под «решил встать на его сторону»?
– На мой взгляд, решение попытаться стать адвокатом человека, расследованием дела которого занимался ранее, в какой-то степени означает встать на его сторону.
– Я не решал стать его адвокатом. Петр Павленский спросил меня, могу ли я быть его защитником. Я ответил, что не против, но не могу в силу требований Уголовно-процессуального кодекса (статья 72 «Обстоятельства, исключающие участие в уголовном деле защитника»). That's all. Я приходил 15 июля на судебное заседание, на котором хотел об этом сказать. Но за меня это сказали другие участники уголовного судопроизводства. Я развернулся и пошел домой.
– Вы сказали, что были бы не против его защищать. Why? Согласитесь, что это все-таки не рядовая ситуация.
– Мне показалось это дело интересным с точки зрения юридической практики. Если бы я защищал Павленского, можно было бы оспорить квалификацию содеянного им.
– Расследуя это дело, вы к чему склонялись – что Павленский невиновен или что виновен, но ему инкриминируют более тяжкое преступление, чем он совершил?

– Дело в том, что возбудить как бы обезличенное уголовное дело по факту совершенного преступления – это одно. А кого-то привлекать к уголовной ответственности, предъявлять обвинение – это совершенно другое. На тот момент, когда я работал, основания для возбуждения уголовного дело, может, и были, но доказательств причастности или виновности Павленского не хватало. Вполне возможно, что сейчас органы следствия что-то нашли. Но для меня квалификация его действий осталась сомнительной.
– И эта история послужила для вас поводом уволиться из органов?
- To a certain degree. Просто я подумал, что вся эта история с психиатрической экспертизой – это перебор (Павленского трижды пытались отправить на психолого-психиатрическую экспертизу, но суд отклонял эти ходатайста. – «НИ»).
– То есть у вас лично не было сомнений в адекватности Павленского, но процедура требовала проведения этой экспертизы?
– Есть два вида психолого-психиатрических экспертиз. Первая – амбулаторная, когда в течение 20 минут решается, вменяем человек или нет. А есть стационарная психолого-психиатрическая экспертиза, когда человека примерно на месяц помещают в психиатрический стационар, то есть фактически ограничивают его конституционные права. Вот это мне показалось перебором. <…>
– В настоящее время вы работаете адвокатом по уголовным делам. Когда вы встали на сторону защиты, а не обвинения, у вас как-то поменялось отношение к своим доверителям, делам, которыми вы занимаетесь?
- Certainly. Стал очевиден большой обвинительный перегиб.
– То есть вы теперь по-другому на систему смотрите?
– Если честно, я и когда работал следователем, смотрел на нее по-другому.
– Как вы относились к перформансам Павленского до знакомства с ним?
– Нормально относился.
– То есть вас нисколько не смущала форма, в которой он осуществлял свои акции, вы не считали их странными?
– Есть понятие «странный» в каком-то негативном смысле, а есть в хорошем. Я относился к его поступкам скорее как к неординарным. Каждый такие поступки не пойдет совершать.
– И вы понимали смысл этих акций?
- Certainly. Мотивы мне не нужно было объяснять дополнительно.
– И после знакомства с Павленским у вас как-то поменялось отношение к его акциям?
– Не могу так сказать.
– А к самому Петру?
– Понимаете, он такой человек, который заслуживает определенного уважения за свою смелость, за то, что верит, что он делает, и никто не может его переубедить. Он выбрал свою линию и гнет ее, несмотря ни на что. Такое отношение к жизни, согласитесь, достойно уважения».
В Крыму слесарь-имам осужден за возбуждение ненависти в ходе спора о территориальной принадлежности полуострова
«17 июля 2015 года Бахчисарайский районный суд Республики Крым признал местного жителя Мустафу Ягъяева виновным по п. “а” ч. 2 ст. 282 УК (возбуждение ненависти с применением насилия или с угрозой его применения).
Ягъяев приговорен к двум годам лишения свободы условно с "лишением права заниматься деятельностью, связанной с передачей и распространением любой информации" . Что означает данная формулировка – только ли лишение права пользования интернетом или, скажем, запрет на телефонные звонки, переписку и разговоры – из сообщения прокуратуры о приговоре не ясно. Возможно, учитывая, что Ягъяев является имамом, речь идет о запрете на исполнение религиозных обязанностей.
Напомним, поводом для преследования Ягъяева послужил фактически бытовой конфликт. Ягъяев, слесарь ЖКХ села Железнодорожное Бахчисарайского района, находясь на рабочем месте не согласился с тем, как сотрудницы бухгалтерии охарактеризовали последствия присоединения Крыма к Российской Федерации. Слесарь стал кричать на коллег, употреблять по отношению к ним оскорбительные эпитеты – и, по версии следствия, заявил следующее: " Крым мы вернем в Украину, будет война, мы вас будем резать и жечь, и русские в этой войне захлебнутся кровью, но жалко, что погибнут мои братья-мусульмане " (сам подсудимый категорически отрицает, что говорил последнюю фразу). Сведения о ссоре были оперативно доведены до местного ЦПЭ, который и возбудил уголовное дело. Истинной причиной преследования Ягъяева вполне вероятно является его деятельность как имама мечети села Тургеневка и общественного активиста, в 90-е годы – члена крымскотатарского меджлиса».

В Москве пропал уроженец Чечни, просивший политического убежища в Польше
«В центре Москвы пропал 30-лений уроженец Чечни Заурбек Жамалдаев, осужденный несколько лет назад за участие в вооруженном формировании и безуспешно пытавшийся получить политическое убежище в Польше, сообщает правозащитная организация «Мемориал».
По словам его товарищей, за день до исчезновения Заурбека, они обратили внимание на установленную за ними слежку. 8 июля Жамалдаев исчез со спортивной площадки, расположенной недалеко от входа на станцию метро «Новокузнецкая».
Как отмечает «Мемориал», в 2007 году Жамалдаев в Чечне был приговорен к году лишения свободы по ч. 2 ст. 208 УК (участие в незаконном вооруженном формировании). Из-за болезни его освободили условно-досрочно, однако сотрудники полиции, по данным правозащитников, постоянно задерживали его и доставляли в полицию для допросов.
В апреле 2010 года Жамалдаев выехал в Польшу, где обратился за статусом беженца, однако власти Польши посчитали, что его условно-досрочное освобождение свидетельствует о том, что в России опасность ему не угрожает. В марте 2014 года чеченец был департирован в Россию.
Жамалдаев поселился в Москве и сначала находился на попечении комитета «Гражданское содействие», затем работал в торговых центрах охранником. В 2014 году он на месяц съездил в Чечню, где женился, однако потом вновь вернулся в столицу. «Мемориал» отмечает, что незадолго до исчезновения Жамалдаева его жену задерживали в Чечне и интересовались, где он находится. Женщина сказала, что ее муж работает в Москве».
Жанна Немцова о разных видах давления
«Увольнения журналистки Жанны Немцовой с российского телеканала РБК требовал Кремль. Об этом дочь российского оппозиционера Бориса Немцова рассказала в понедельник, 20 июля, в интервью газете Die Welt. По ее словам, удовлетворение вызывает тот факт, что владелец и менеджеры телеканала не пошли на такой шаг. Тем не менее, угроза увольнения оставалась, поэтому она сама решила уйти, отметила Немцова. На данный момент журналистка большую часть времени проводит в Германии и с августа начинает работу в медиакомпании Deutsche Welle.
Отвечая на вопрос о конкретных формах давления в России, Жанна Немцова сказала, что ее побуждали отказаться от услуг адвоката, который представляет ее интересы как потерпевшей по делу об убийстве отца. По словам журналистки, ее пытались склонить к смене юриста потому, что он потребовал допросить в качестве свидетеля главу Чечни Рамзана Кадырова. Еще одной причиной давления стал призыв адвоката установить международный контроль за ходом расследования убийства оппозиционера, так как этот процесс практически зашел в тупик».

Выступавший против воинского призыва активист попросил политического убежища в Швеции
«Тольяттинский правозащитник и ЛГБТ-активист Константин Голава покинул Россию. Об этом сообщил он сам на своей странице в социальной сети Facebook. Сейчас Константин находится в Швеции, где планирует просить политическое убежище в связи с преследованиями в России. Об официальной реакции шведского МИД не сообщается.
13 мая в Тольятти сотрудники правоохранительных органов провели обыск в квартире Константина Голавы. Поводом для обыска стало уголовное дело в отношении него по статье "возбуждение ненависти либо вражды". По данным управления Следственного комитета по Самарской области, в 2014 году правозащитник разместил в интернете материалы, которые, по оценкам экспертов, содержат признаки унижения человеческого достоинства к группе "русские граждане России".
По словам самого Голавы, причиной возбуждения против него уголовного дела стала его правозащитная деятельность. В начале мая он инициировал судебное разбирательство в отношении призывной комиссии Тольятти, требуя призвать его на альтернативную гражданскую службу вместо военной.

Интервью бизнесмена Алексея Шматко, попросившего политического убежища в Великобритании
«В декабре 2014 года в лондонском аэропорту Хитроу попросил политическое убежище бизнесмен из России Алексей Шматко. Вот уже семь месяцев он живет в Великобритании, в городе Кардифф, учится в колледже, ведет блог и ожидает, когда британские власти примут решение о его участи.
В России Алексей Шматко объявлен в розыск – его обвиняют в хищении 50 миллионов рублей. В многочисленных публикациях о его деле много путаницы. Сам Алексей Шматко говорит, что его преследование организовал заместитель начальника УФСБ по Пензенской области Николай Антонов, которого называют "Корлеоне". Имя Антонова упоминается и в написанном в тюрьме заявлении бывшего заместителя губернатора Пензенской области Александра Пашкова о коррупции в ФСБ. <…>
– До 2007 года я работал в компании "Газпром", после этого стал заниматься самостоятельным бизнесом. Мы проектировали и строили газовые объекты. Меня вызвал сотрудник ФСБ Антонов и потребовал, чтобы половина бизнеса принадлежала ему и он назначит мне своего зама. А мы как раз тогда получили очень крупный заказ на проектирование и строительство. Я отказал ему, и после этого начались мои проблемы. История о том, что якобы 50 миллионов похищено, – это полный бред. Я начал вести свое расследование потому, что эта группа во главе с сотрудниками ФСБ и налоговой наехала на мою фирму и пыталась ее отнять. Я начал копать ответный компромат на них. Я раскрыл группу, состоящую из сотрудников налоговой инспекции и сотрудников ФСБ, собственно, которые на меня и наехали. Подал заявление в милицию.
– И был арестован Пантюхин, глава областной налоговой инспекции…
– Да, посадили мелкую рыбу. Посадили Пантюхина и бизнесмена Машкова. А от ответственности ушли начальник областной налоговой инспекции, бывший сотрудник ФСБ, и замначальника Пензенского ФСБ, который участвовал в этом деле. Они вообще никак там не фигурировали. Когда дело попало в Следственный комитет, когда оно приобрело общественный резонанс, они решили выставить меня участником и организатором всех этих действий. Сотрудники ФСБ сфабриковали на меня уголовное дело, арестовали, держали два месяца в СИЗО, пытали, избивали. Я не хотел быть политическим активистом, хотел быть просто бизнесменом, работать на благо своей семьи и фирмы, а получилось так, что я стал сопротивляться и раскрыл коррупционную схему, раскрыл воров из бюджета России, за что меня и наказали.
– Вы вступили в конфликт с ФСБ, организацией, которая одновременно является и бизнес-структурой, и правоохранительным ведомством, и бандитской группировкой…
– Да, совершенно точно, точнее не скажешь. По моим наблюдениям роль ФСБ просто чудовищна, ФСБ контролирует буквально все. На каждом крупном предприятии есть куратор от ФСБ. Если ты переходишь в разряд крупного бизнеса по меркам Пензы, то к тебе обязательно приставляют куратора, ты должен этого куратора кормить и через него кормить взятками сотрудников ФСБ. Это ни для кого не секрет. Я работал в "Газпроме", даже в "Газпроме" был куратор от ФСБ. Бывший мэр города Пензы Роман Чернов – бывший майор ФСБ. То есть ФСБ контролирует буквально все, все крупные объекты, все банки, им платят дань все.
– И вы платили?
– Я не платил, я отказался, поэтому меня сразу арестовали и пытали, применяли насилие сотрудники ФСБ. Я написал заявление в Следственный комитет. Следственный комитет никак не прореагировал на мое заявление, то есть они меня даже не опросили в рамках проверки, что меня пытали и в СИЗО, и в здании ФСБ на Московской улице.
– Избивали на допросах?
– На допросах, конечно. Иногда на допросах присутствуют адвокаты, меня привозят на весь день, а адвокаты со мной находятся не весь день. У них есть специальные клетки в здании ФСБ, где они содержат заключенных, и адвокаты в это время со мной не находятся. Соответственно, идет психологическая и физическая обработка перед допросами. Я находился два месяца в следственном изоляторе. Сначала меня не пытали, сначала на меня оказывали психологическое воздействие, не давали видеться с родственниками, ни с женой, ни с матерью, ни с отцом, не было никаких допросов, ничего. Они думали: я бизнесмен, не вор в законе, для которых тюрьма – дом родной. Думали, что начнется психологическая ломка. После двух недель они поняли, что я психологически не сломаюсь, не буду клеветать на себя, тогда они начали применять регулярные пытки. То есть вывозили в ФСБ и избивали, угрожали, потом уже перешло на угрозы семье и так далее. Били, сломали нос, сломали челюсть, повредили ноги, руки. Не хочу сказать, что я был избит до полусмерти, но иногда было очень больно и морально, и физически, очень сильно больно было.
– ФСБ пытается взять под контроль весь бизнес в Пензе. А бизнес с этим мирится или есть какое-то сопротивление?
– Не я один отказался платить, многие оказывали сопротивление и оказывались в следственном изоляторе. Я знаю десятка два людей, которые по сфабрикованным делам оказывались в следственном изоляторе, а у них в это время пытались отнять бизнес.
– Все крупные предприятия в Пензе находятся под контролем ФСБ?
– Весь крупный бизнес контролируются ФСБ, а предприятиями поменьше занимается полиция.
– А обычные бандиты, которые в 1990-х годах все контролировали, они ФСБ и полицией выброшены из бизнеса или скооперировались?
– У нас была группировка "Олимпийцы" по названию спортивного комплекса, где они занимались. Все прекрасно знают, что они были под крышей ФСБ. В случае, если ты не будешь сотрудничать, сначала придут они и будут тебя прессовать.
– Алексей, вы не интересовались политикой, просто защищали свой бизнес и никаких выводов из своей частной ситуации поначалу не делали. Но потом стали понимать, что это не частная ситуация, а отражение общей картины в стране. Right?
– Да, совершенно точно. Я никогда не интересовался политикой, мне было фиолетово от того, кто у власти, есть свобода или нет свободы, я этого не понимал. А когда пришли за тобой, ты начинаешь сопротивляться, начинаешь понимать, что все несправедливо. Самое тяжелое в России то, что нет справедливости, что ты не можешь доказать свою невиновность. Я долго думал о бизнесменах, которые сидят в тюрьмах в России. Ведь их более ста тысяч человек, насколько мне известно. Все дело в том, что среди сотрудников ФСБ осталось много советскомыслящих людей. Для них бизнесмен был врагом советского народа. Если у тебя какой-то бизнес, ты открыл цех по пошиву сапог, тебя могли посадить. А если ты обменял доллары, тебя могли расстрелять. После развала Советского Союза они потеряли власть, но с приходом Путина они воспряли, начали с удвоенной энергией истреблять бизнесменов. Для сотрудников ФСБ бизнесмены классово чужды. Раньше при Советском Союзе они могли их законно сажать и расстреливать, а сейчас не могут. Я считаю, что это классовая ненависть.
– При этом они преспокойно себя чувствуют в атмосфере путинского капитализма и сами стали успешными бизнесменами…
– Они считают, что любого, кто не согласен, дозволено грабить. Подвигом считается бизнесмена нагнуть. То есть для них бизнесмен – это барыга, жулик. Они считают бизнесмена не элитой, а расходным материалом, овцой, которую нужно резать или стричь».
