
The Oktyabrsky District Court of Krasnoyarsk ordered to compensate for moral damage in the amount of 200 thousand rubles to the therapist Alevtin Khorinyak for illegal criminal prosecution, TASS reports . The defendant in the case was the Ministry of Finance.
"The court partially satisfied the lawsuit. The plaintiff asked for compensation in the amount of two million rubles. Perhaps we will challenge today's court decision," said the plaintiff's lawyer Vyacheslav Bogdanov.
In 2009, the doctor wrote out two prescriptions for opioid analgesic tramadol for the inconceivated cancer patient Victor Sechin. The patient suffered from unbearable pain. Khorinyak prescribed the drug, despite the fact that the patient did not live in the territory of the service of her clinics. A friend of the patient Tabarintsev bought medicines in a pharmacy with his money.
In 2011, Gosnarkokontrol discovered recipes in a pharmacy. A criminal case was opened under part 2 of Article 234 of the Criminal Code (the illegal turnover of potent substances in a large scale by preliminary conspiracy for the purpose of sales committed by an organized group) and Article 327 (falsification of the document in order to facilitate the commission of another crime).
In May 2013, the judge of the Oktyabrsky District Court of Krasnoyarsk Nonna Markova found Khorinyak and Tabarintsev guilty and fined 15 thousand rubles each. At the trial, the facts of pressure on witnesses were recorded.
More than 1,500 representatives of the medical community signed a letter in support of Khorinyak. It was defended by international organizations of palliative medicine. The international organization Human Rights Watch demanded to remove the charges from Khorinyak and its handleys. “The accusations of illegal circulation of opioids and forgery of documents are a complete nonsense and absurd,” says Human Rights Watch. “Khorinyak and L.T. are subjected to criminal prosecution for not allowing a hopeless person to die in pain, which could be relieved.”
In July 2013, the Krasnoyarsk Regional Court abolished the verdict. The court found that the right of defendants to defense was violated. The case is sent for a new consideration to the district court. Khorinyak said she intends to achieve a complete excuse.
The repeated trial began in the Oktyabrsky District Court of Krasnoyarsk February 2014. During the hearing, the prosecutor demanded to find the doctor guilty and fined for 15 thousand rubles. However, the court fully justified the 72-year-old Khorinyak and removed all the charges from her.
