
The case of the organizer of the march for the federalization of the Kuban Daria Polyudova, accused of calls for extremism and separatism, entered the Oktyabrsky district court of Krasnodar. The lawyer of the activist Andrei Sabinin said to the Franes about this. The case is entrusted to the judge Oleg Goncharov. The date of preliminary hearings has not yet been set.
There are three episodes in Polyudova. The first is qualified under part 1 of Article 280 of the Criminal Code (public calls for extremism), which provides for the four years of the colony. The activist was charged with the exit on April 4, 2014 on a single picket with a poster "Not a war with Ukraine, but a revolution in Russia! Not a war, but a revolution!" And the publication of your photo with this poster on a personal page on VKontakte.
Part 2 of Article 280 (public calls for extremism via the Internet), the sanction of which is up to five years of the colony, was imputed on the second episode of Polyudov. This accusation of the activist was charged with repost on July 16, 2014 on his VK page of someone else's text containing the following phrases: “Wake up, people! .. Why can't we remove Putin, and then make a socialist revolution? !!! It's time to go to the square and overthrow this regime!”
Finally, the third episode of the case is qualified under part 2 of Article 280.1 of the Criminal Code (public calls for separatism via the Internet), which also provides for up to five years. This is the first case of initiation of the case under article 280.1. Polyudova was imputed on August 5, 2014 - also on a personal page on VKontakte - the text under the heading "Cut with a guetler with his own weapons."
At the end of August 2014, Polyudov was arrested. She spent six months in a pre-trial detention center-5 in Krasnodar, unofficially controlled by the FSB. The activist was released in connection with the expiration of the maximum permissible period of pre -trial arrest of imputed charges.
The Polyudova case was led by the senior investigator for especially important cases of the Krasnodar UFSB, Lieutenant Colonel of Justice Dmitry Shapovalov. Over the past six months, he repeatedly stopped and resumed the investigation again. Shapovalov tried to add to the accusation to the activist of Article 282 (arousal of hatred or enmity) and 205.2 of the Criminal Code (public calls for terrorism or its public justification), however, the examination conducted by his request did not see the publications of the Polyudus features of these actions.
In addition, in June, Shapovalov ensured that the police initiate a case against the activist under Article 319 of the Criminal Code (insulting a representative of the authorities) for the repost from the VK group Putin - Huylo in a square. The case was referred to the FSB and combined into one production with other materials against activist. However, the next month, Shapovalov terminated the case. He was forced to this by a lawyer Sabinin, who indicated that the affairs of the 319th article must suggest the presence of the victim, which in this case was Vladimir Putin.
Polyudova herself does not admit her guilt. At the same time, she is confident in the conviction of the court and considers it very likely that she will be given a real term in the colony.
After the release from the pre -trial detention center, Polyudov was subjected to administrative arrest three times. In addition, the FSB achieved the dismissal of activist from work and further prevented her of employment.
On July 10, the ECHR registered Polyudova’s complaint about detention and further extensions of the arrest. The document states that Russia violated in relation to the activist of Article 5 (the right to freedom and personal integrity) and 10 (freedom of expression) of the European Convention.
