The State Duma deputy from "United Russia" is opened by Nathho prepared a bill establishing criminal liability for abuse of the state anthem of Russia, Izvestia reports .

“This bill, in my opinion, will establish a single tools for effective legal protection of all official state symbols of Russia without exception, and this is very, very important, since abuse of them is essentially an insult to the honor of the nation and the state as a whole,” said Natho.

In order to establish the law enforcement of a new article, the deputy proposes to include a note that will determine specific actions that can be interpreted as an abuse of the anthem. Among such actions is a deliberate distortion of the musical edition or the text of the state anthem in its public execution or publication in the media, electronic or information and telecommunication networks.

In November 2013, Fair Russia proposed to give a colony for a year for abuse of the Russian anthem. The corresponding bill was developed by the Duma party faction.

In the explanatory note to the document, a gap in criminal legislation was noted. According to the Constitution, Russia has three state symbols: coat of arms, flag and anthem. However, if for insulting the coat of arms and flag Article 329 of the Criminal Code provides for up to the year of the colony, then there is no criminal liability for abuse of the anthem. There is only Article 17.10 of the Code of Administrative Offenses, which provides for fines from 2 thousand to 150 thousand rubles for the "violation of the order of official use" of all three state symbols.

On July 18, 2015, the Supreme Court gave a favorable review of the bill providing for criminal liability for abuse of the anthem. At the same time, the review contained a number of comments on the bill. In his text, the Sun indicates, the abuse of the anthem is defined as his "perversion, distortion or other change using swear words, obscene and insulting expressions."

Meanwhile, the abuse is also possible in a “non -verbal way,” says the Sun, citing “the performance of the anthem, accompanied by a video of obscene content” as an example. Thus, the document still needs clarifications, the review was said.
