
The Ministry of Justice of the Russian Federation proposes to make public electronic trading in the main way to sell the arrested property of debtors. Such a proposal, according to RBC , was discovered in the draft Federal Law "On Amendments to Certain Legislative Acts in terms of improving the procedure for the implementation of the property of debtors" that are developed in the Ministry of Justice.
In addition, now the bailiff service will be engaged in the sale of arrested property instead of the Federal Property Management Agency.
Now the bailiffs are only engaged in the arrest of the property of debtors. The organization of its sale is the obligation of the Federal Property Management Agency. The sale itself is carried out by specialized organizations that are selected by the territorial bodies of the Federal Property Management Agency at open auctions. For example, in Moscow in 2015, nine companies received the right to sell, four in the Moscow region.
At the end of 2014, the Federal Property Management Agency estimated the amount of property arrested by bailiffs in Russia at 90.5 billion rubles. There was no much demand: only 15% in the amount of 13.5 billion rubles was sold.
More than half of the property was returned to the bailiffs due to the low quality of the arrested property, the high probability of contesting the actions of the bailiffs and the risk for buyers not to register the right of ownership.
"It is planned to establish the dependence of the size of the reward of the attorney on the value of the sale of property," the representative of the Federal Property Management Agency told the agency. And "it is proposed to assign the payment of the reward of the attorney to the buyer, which the bidders must be notified in the notice of the auction."
The bill also provides for debtors to independently sell property, the value of which does not exceed 100 thousand rubles, in the absence of a dispute about the value of property.
