
Why is the investigation of the crimes to which Viktor Yanukovych may be involved, is faced with great obstacles

Viktor Yanukovych’s lawyer Valery Serdyuk spoke to journalists in Kyiv and said that he had already handed over to representatives of Ukrainian law enforcement agencies in Rostov, at which investigators from Kyiv could visit his former president. Serdyuk is not afraid that Ukrainians can call him the "devil's lawyer", and intends to defend his client to the end. Answering the question of journalists about why Yanukovych did not appear for the interrogation on August 11 to the Prosecutor General of Ukraine, Serdyuk demonstrated an interview with one of the Ukrainian television channels of the Verkhovna Rada deputy Leonid Emts . In this interview, the parliamentarian, in particular, said that if Yanukovych appears in Ukraine, then he will be "shot like a dog." “The specific date of the start of the trial was not scheduled,” Valery Serdyuk said in an interview with Radio Liberty. - I think that the court will take place when the investigation is collected by a sufficient amount of evidence. Since the evidence base is insufficient, this can negatively affect the reputation of the prosecutor’s office during the public process, so they do not transfer the case to the court in relation to my client.

- Viktor Yanukovych - defendant in the case on the Maidan, cases of privatization of Ukrtelecom . In these cases, my client is officially notified of suspicions put forward against him. He also takes place on the creation of a criminal organization, the illegal seizure of land and property of the Rest House "Mezhigorye ", on the territory of the Sukholuchye Forestry, on the adoption of laws by the Verkhovna Rada on January 16, 2014. In these cases, neither defense nor Yanukovych received suspicions of the existing presidentials in relation to the former president. All parties are interested in getting an answer to questions about who is still involved in the deaths of people in the winter of 2014 in the center of Kyiv. But today the Maidan case is suspended. Yanukovych turned to the Prosecutor General with a request to publish the investigation materials so that every citizen of Ukraine could get acquainted with the facts and conclude about the involvement or non -involvement of certain persons in tragic events.

In this regard, a new case was born - with an accusation of involvement in the predation of 220 million hryvnias during the privatization of Ukrtelecom. Yanukovych is accused of stolen funds by adopting the Verkhovna Rada of the Law, which is still valid. - Former Chairman of the Security Service of Ukraine Valentin Nalyvaichenko has repeatedly stated that there are undeniable evidence of Yanukovych’s involvement in the murders on the Maidan. How do you comment on such statements?
-I believe that there is no such evidence, since according to the requirements of the Code of Criminal Procedure of Ukraine, protection has the right to get acquainted with the relevant evidence. We have repeatedly submitted an appeal to the General Prosecutor's Office to provide evidence, but in addition to procedural documents on the activities of the investigation, these are various decisions on the formation of the investigation, the decision of the courts on the election of a preventive measure, announcing the wanted list - we were not provided to us. What exactly confirms Yanukovych's involvement in the crimes on the Maidan?
-I correctly understand that Yanukovych, fearing for his life, is afraid to come for an interrogation to Ukraine, but is ready to answer questions from the Ukrainian investigator in Rostov-on-Don?

The Prosecutor General of Ukraine Viktor Shokin , meanwhile, states that the investigation in all criminal cases against the former head of state continues, and in one of these cases, the procedure for the absentee condemnation of Yanukovych continues (obviously, we are talking about the case of Ukrtelecom). “The investigation in the Maidan affairs will never be stopped until everyone who is guilty is punished. After the sentence, the procedure on this issue will continue to go. And Yanukovych will be found guilty not only by our court, but maybe the court in Moscow,” Shokin suggested.

The lawyer of the relatives of the "Heavenly Hundred" Pavel Dikan, however, confirmed in an interview with Radio Liberty that the Yanukovych case "Maidan" was suspended:
-In the criminal procedure legislation there is a certain conflict that sets the investigation period after the suspicion is 12 months. Suspicions of Viktor Yanukovych were put forward at the end of February 2014. Due to the fact that neither Russia nor Yanukovych himself reported their place of residence - although everyone knows that he is in Russia, the Prosecutor General’s Office announced the former president on the wanted list. Therefore, the materials of the Yanukovych case were allocated into separate production, but it was suspended until the suspect was established. But we do not have an interstate agreement with Russia on the issuance of criminals and on the issuance of persons on the wanted list, so the situation remained in a limited state.
- How do you regard the statements of lawyer Yanukovych that all cases against the former president of Ukraine were sewn with white threads and Yanukovych have nothing to blame even in connection with dozens of dead on the Maidan?

- I would not be in a hurry to say so. At least we can talk about the totality of Yanukovych’s criminal actions, starting from November 2013, and by and large earlier. It all started with an illegal decision of the Constitutional Court, which returned the old Ukrainian constitution with great presidential powers. As far as I know, the facts of pressure on judges are now being investigated - respectively, on the subject of criminal actions. All this is drawn to a criminal conspiracy to seize power. As for the Maidan, apparently, the defense of the former president, by the absence of direct evidence, has in mind the following: no one proved that Personally, Yanukovych gave orders for the shooting of demonstrators. Everyone perfectly understands that if such orders were, then they were given orally. However, the events and chain of people involved in criminal activity indicates that crimes were committed with the knowledge or with the participation of the head of the state, ”said lawyer Pavel Dikan .
