Donetsk is a quiet border city. On the outskirts, its private sector adjoins the one -story houses of the settlement of Izvarino, located in Ukraine. There is also a large border checkpoint. According to investigators, it was in these places that Nadezhda Savchenko illegally crossed the Russian-Ukrainian border. True, with an unclear goal. Now she is brought to a local court with a motorcade of seven police cars and the Federal Penitentiary Service. Savchenko is contained in the pre -trial detention center of Novocherkassk, this is about 50 kilometers from Donetsk. The court is numbered by the police, and during the trials in the Savchenko case, it is closed to other visitors. True, there are only three judges - in civil cases, criminal cases and chairman Leonid Stepanenko. He heads the judicial collegium, which began on September 22, 2015 to consider the case of Nadezhda Savchenko on the merits.
The journalists at the first meeting did not see the other two judges from the college, as well as the three prosecutors representing the prosecution. Formally, the trial is open, but all places in the hall were taken by the Cossacks and representatives of the "people's liberation movement" who came here from Rostov. Only a few places were received by three foreign diplomats, the consul of Ukraine in Rostov Alexander Kovtun and sister Nadezhda Savchenko Vera. At first, they did not want to let the cousin Savchenko and her assistant from the Verkhovna Rada (the pilot became a deputy, being in Russia under arrest). It seemed to the police that they were defiantly dressed - in embroidered shirts and T -shirts demanding to free Savchenko. After the petition of the lawyer, they were still allowed to go back. The journalists got a neighboring court of court, where television was conducted.
Savchenko has three lawyers. These are Nikolai Polozov and Mark Feigin, known for defending the Pussy Riot group and the ideologist of the “combat organization of Russian nationalists” Ilya Goryachev convicted by life. As well as Ilya Novikov - Savchenko, his first serious client; However, viewers know him from the game “What? Where? When?" In the first minutes after the broadcast turned on, it seemed that Savchenko and her lawyers are engaged in what they can and love - they declare the discharge to the judge. “I do not trust any Russian court,” said Savchenko in Ukrainian, and a man sitting next to her glass cage translated in a blue suit. “However, I do not declare a challenge, because it is pointless,” she calmed down. “What cute grandfathers in the hall,” Savchenko paid attention to the Cossacks. “I hope they are pleased to hear their native language.”
Lawyers began with petitions - perhaps slightly premature. Novikov drew the attention of the court to the fact that the Investigative Committee and the prosecutor’s office were recorded in the victims of six residents of the Luhansk region, that is, citizens of Ukraine. Novikov insisted that Russia should protect only its citizens, and Ukrainians - “with all the sympathy for them” - recognize as mistaken by victims. After all, it is strange that the Russian court considers the crime of a citizen of Ukraine against other citizens of Ukraine, and even committed in the territory of this country. "We are restless here in Syria - what, soon the Syrians will judge?" - He supported the petition as usual ironic Polozov. Feigin said that according to the Geneva Convention on Prisoners of War, the court in theory can be held in Russia, but a military, and not ordinary criminal, as in our case.
Savchenko spoke with slogans. She called Russia a “two -faced Janus”, which captures Crimea and secretly fights in the Donbass. At the same time, they refuse to recognize her as a prisoner of war and do not recognize her status of the deputy of the Verkhovna Rada and deputy PACE (she was also elected there). “You will decide whether you are either smart or beautiful,” she insisted. “Either you respect the right, and I am free, or spit on everything as always.”
The prosecutors repelled the petition quite quickly, asking him to recognize him untimely, and the three judges supported the charge without even wasting time for a meeting.
In the second petition, lawyers asked to send the case back to the prosecutor's office, because there is nothing clear there with the victims. The prosecutor’s office is ready to recognize six citizens of Ukraine, but does not recognize the separatists allegedly affected by the actions of Savchenko. A video was preserved how, after a shot from the howitzer, which, according to the prosecution, Savchenko scored, one person in camouflage drags another of the same - wounded. The investigation, lawyers insisted, did not want to make these people to be victims so that they are not proof of Russia's presence in clashes in the Donbass.
The accusation demanded to reject the petition on the same grounds - as premature. And one of the prosecutors also made a remark to the lawyers: in his opinion, they are trying to attribute even more to their client even more than officially incriminated to her; And whether to tell them for such a way a discharge. This time it took the judges for about 40 minutes, they returned and the second time completely supported the position of the prosecution - it will still be investigated in the process.
The prosecutors read out the indictment, for the first time officially and publicly formulating what will be incriminated by the defendant Savchenko.

Kyivan Nadezhda Savchenko, the navigator of the Ukrainian Air Force, with the beginning of armed clashes in the Donbass came there as a volunteer and joined the Aydar battalion, which was deployed in the area of the village of the Happiness of the Luhansk region. Soon she began to take part in the battles, "knowingly knowing that there was a military equipment in the regiment, including howitzers." And the motive, according to the Russian investigation, was "her hatred and enmity to the social group" Residents of the Luhansk region "." Possessing combat experience, she allegedly adjusted the fire on the positions of the separatists. On June 14, 15 and 16, 2014, according to the prosecution, she looked at the traffic police on the exit from the village of Metalist. Around noon on June 17, acting as part of a criminal group, she discovered "evacuated persons who have no signs of participants in armed groups." In order to inflict death to them, she reported to the “Aidar” coordinates, which allowed to apply “at least six shots from three artillery guns”. During the shelling on the spot, the correspondent of the Rossiya television channel Igor Korneluk died, the sound engineer of the company Anton Voloshin died the same day in the Lugansk hospital, only the video operator Viktor Denisov survived. The rest recognized by the victims remained alive.
These are the first two episodes incriminated by Savchenko - the murder of journalists and the attempt on the life of civilians.
Then, as follows from the indictment, Savchenko was detained by the "militias" of the LPR and delivered to Lugansk. What happened next is not clear from the indictment. It is only clear that Savchenko, according to the prosecution, somehow freed herself and, without removing the Ukrainian military uniform, illegally crossed the border with the Russian Federation in the Donetsk region. By violating, respectively, the law for the third time.
“I do not admit it. Everything that is written here is a groove, ”Savchenko reacted. “Lieuting,” the translator translated. The judge, according to the procedure for conducting a judicial investigation, asked if Savchenko wanted to testify. “I will not only testify, I want to give them on a lie detector so that everyone can see that the indictment is a lie written by an incompetent person,” she snapped. - I have never seen these journalists, I never shot at unarmed people. I am aviation, not artillery. These are different things, believe me! I have never brought anything to anyone. I am a soldier. But I'm not a killer. "
The lawyer Novikov supplemented that, according to the defense, Aydar fired not by civilians, but by a working mortar brigade of separatists. Polozov complained that the indictment does not speak of Savchenko’s intent - it is not clear why she allegedly wanted to kill civilians. Feigin noticed that Savchenko was not close to Russia. According to him, it is obvious that the pilot was captivated and obscured by people of the current head of the LPR Igor Plotnitsky. They kept it under guard, and then transported to one of the Voronezh hotels and gave it to people from the FSB. Moreover, lawyers will insist that on June 17, on the day of shelling of the traffic police point at Metalist, Savchenko was already detained and kept in the Lugansk military commissariat. Accordingly, she could not commit the whole incriminated to her.
After a small break, the first victims were interrogated - the widow of the sound engineer Anton Voloshin Irina and his father Dmitry. They did not go to the court in Donetsk, they were interrogated by video from the court of Balashikha near Moscow, where they live. Irina Voloshina, a producer at VGTRK since the spring of this year, said that for her husband a business trip to Lugansk was the first trip to the combat zone. Before that, he worked only on Euromaidan in Kyiv. They corresponded and called up every day. The last time - on the night of June 16 to 17. At nine in the evening on June 17, they called her from the VGTRK and confirmed her husband's death. She said some rather banal words that Voloshin was responsible and caring, "my most beloved husband." At the same time, she could not say who exactly sent her husband on a business trip, and whether he went on some training before sending to the war zone. Savchenko asked her several questions, moving into Russian and bringing her her condolences. Irina Voloshina said that she did not want to participate in the debate and did not want to be related to this process at all - she is very difficult.
Dmitry Voloshin, the father of the deceased sound operator, refused to come and participate in the process. He called Savchenko by name-patronymic-Nadezhda Viktorovna, and did not give out his emotions. He said about his son that he loved to organize discos, worked in the House of Culture in Khimki, and dreamed of becoming a video operator over time. He was "very vulnerable, although he held a mask of a man." Father took Anton Voloshin to the office of VGTRK - on the very business trip. And then secretly hoped that the Ukrainian border guards would not let their son into the country-in May 2014, the Ukrainian side introduced an almost total ban on a visit to the country of male Russians and draft age. Voloshin was allowed because he has relatives in Lugansk.

Savchenko began to ask whether someone had given his son’s son, what exactly he had to shoot and show: the bias of Russian channels-one of the main claims of the Ukrainians to Russia. But Dmitry Voloshin said that his son was a simple sound operator. He loved his homeland, loved Kyiv and Lugansk relatives.
“I did not kill your son. I am very sorry that it happened. Our guys also died there, and I really feel very sorry, ”Savchenko told him.
The trial will resume next week. First, Savchenko herself wants to give the testimony, then the interrogation of the victims and their families will continue.
