The verdict of the legal wing of Uralmash is being appealed in Yekaterinburg

The Sverdlovsk Regional Court began considering an appeal in the criminal case of six members of the so-called legal wing of the Uralmash OPS, which was headed by businessman Vladislav Kostarev, who is on the wanted list. According to investigators, they participated in the theft of assets of a number of machine-building enterprises in the region in the amount of about 600 million rubles. However, only two participants were convicted of theft - Andrei Tkachuk and Alexey Mishenin. In addition, the prosecutor's office dropped charges against the defendants of participating in an organized criminal group. Representatives of the victims categorically disagree with this.

Yesterday, the appeal panel of judges of the Sverdlovsk Regional Court, chaired by Dmitry Gerasimenko, began considering complaints against the verdict in the criminal case of Alexey Mishenin, Andrey Tkachuk, Alexander Kolyasnikov, Olga Rushitskaya, Olga Temlyakova and Tatyana Zhuravleva, accused of fraud (Article 159 of the Criminal Code of the Russian Federation) and participation in organized criminal community (Article 210 of the Criminal Code of the Russian Federation). Due to the absence of a number of defense lawyers for the defendants, the panel postponed the decision until October 19.

Let us recall that, according to the investigation, all the defendants were members of the legal wing of the Uralmash OPS in the early 2000s, which was headed by businessman Vladislav Kostarev, who had previously worked closely with the Ural raider Pavel Fedulev (in 2011 he was sentenced to 20 years for organizing murders and raiding grips). Now Vladislav Kostarev is on the international wanted list (presumably lives in the UAE). According to investigators, the defendants took part in more than ten raider takeovers of enterprises. In particular, their victims were OJSC Pervouralsk Plant of Complete Metal Structures, OJSC Melkombinat, OJSC Artemovsky Machine Plant Venkon, OJSC Saldinsky Metallurgical Plant, CJSC Bogdanovich Porcelain Factory and others. The amount of damage was estimated at 600 million rubles. When the case materials were transferred to the Kirovsky District Court of Yekaterinburg in 2013, a mini-truck was required to transport them.

The court of first instance sentenced only two defendants to actual punishment: Andrei Tkachuk (10 years in prison) and Alexei Mishenin (8 years in prison). They were found guilty of theft in 2005 of the assets of OJSC Artemovsky Machine-Building Plant Venkon in the amount of more than 108.5 million rubles. The criminal prosecution of Alexander Kolyasnikov and Olga Rushitskaya was terminated due to the expiration of the statute of limitations, and in relation to Tatyana Zhuravleva and Olga Temlyakova the case was suspended due to their maternity leave. In addition, at the request of the state prosecution, the most serious charges were dropped from all defendants - under Article 210 of the Criminal Code of the Russian Federation (“Participation in an organized criminal community”).

As representatives of the affected enterprises explained to Kommersant, they categorically disagree with this decision. “The facts of their participation in the organized crime were proven, but were unreasonably dismissed by representatives of the prosecutor’s office,” emphasized a representative of the Pervouralsk Plant of Complete Metal Structures OJSC.
