According to the author of the bill, a bankrupt deputy undermines the “authority of the authorities”

Member of the Federation Council (FC) Vladimir Poletaev proposes to deprive State Duma deputies, senators, heads of municipalities, deputies of legislative assemblies and local governments, as well as officials, including at the municipal level, declared bankrupt. Vladimir Poletaev, a member of the Federation Council Committee on Regulations and Organization of Parliamentary Activities, proposes early deprivation of the mandates of State Duma deputies, senators and deputies at the regional and municipal levels who have been declared bankrupt. Mr. Poletaev proposes to extend the same rules to officials at all levels and to the heads of municipalities.

In the explanatory note to the bill, the senator refers to Art. 57 of the Constitution of the Russian Federation, which states that “everyone is obliged to pay legally established taxes and fees.” They, according to the deputy, “act as one of the classic signs of the state, since only the state as a public legal entity has the right to establish such mandatory payments.” “At the same time, taxes and fees act as the most important source of financing the state’s obligations, including in the social sphere,” the senator adds.

According to Vladimir Poletaev, the fact that deputies and senators declared bankrupt will be in power “can undermine its authority”, “discredit it in the eyes of ordinary citizens of the Russian Federation”, and also “create obstacles to the effective implementation by state authorities and local authorities self-government of the functions and powers assigned to them.”

Let us recall that on October 1, a law on bankruptcy of individuals came into force in Russia, according to which citizens who are unable to repay their loans to banks will be able to relieve themselves of the debt burden by declaring themselves bankrupt. Previously, the law “On Insolvency and Bankruptcy” allowed only legal entities to declare bankruptcy.
