Ruslan Mukhudinova, the driver of the commander of the Chechen battalion "North" Ruslan Geremeyev, was charged with an absentee case of organizing the murder of the co-chairman of the RPR-Parnas Boris Nemtsov. This was stated by lawyer Vadim Prokhorov, representing the interests of children in a politician, reports TASS.
"We are glad that we finally decided and we hope that in the near future a similar accusation will be brought by his childhood friend Ruslan Geremeyev," Prokhorov said. According to him, on November 6, a resolution was issued on the announcement of Mukhudinov on the wanted list. The lawyer expressed the hope that the investigation would not limit himself to the capacity of the crime performers, but will find both the organizers and customers of the murder of Nemtsov.
Now the case of the murder of Nemtsov is investigated by paragraphs "Z", "Z" of part 2 of Article 105 of the Criminal Code (murder committed by a group of employees). On September 9, Kommersant said thatthe investigation could not find evidence of the existence of a crime customer . The sources of the publication did not exclude that the case could be retrained to the item "L" of part 2 of Article 105 (murder on the motive of political, ideological, racial, national or religious enmity).
“I see three scenarios of the development of events so far,” Prokhorov commented on the situation then. “Customers can be established and detained at the rest of the time or allocate their criminal proceedings in a separate proceeding. The worst option - if already arrested executors are recognized simultaneously by the organizers and customers of the murder. We, of course, will dispute such a decision.”
On September 14, the victims filed a request for retraining of the case in the Investigative Committee. They insist on the qualifications of the murder under Article 277 (an encroachment on the life of a statesman), indicating that at the time of the death of Nemtsov he was a deputy of the Yaroslavl Regional Duma and co-chair of the RPR-Parnas, and previously held posts in the government, was the governor and deputy of the State Duma.
According to Prokhorov, the re -qualification of the case does not imply toughening the punishment for the accused of a crime. “Both the initial article and the one that we ask, provides for the jury, as well as the opportunity to receive life imprisonment,” the lawyer noted. However, Prokhorov added, he believes that Nemtsov was killed exclusively for political reasons and the crime should be qualified based on this. However, the TFR refused the retraining.
Nemtsov was shot dead late in the evening of February 27 on the Big Moskvoretsky Bridge. A week later, on suspicion of involvement in the murder , five natives of Chechnya were arrested . The sixth suspect, also a Chechen, is alleged, committed suicide during the detention. In the spring it was reported that the customer of the crime investigators consider a person who appears in the testimony of the accused under the name Rusik or Ruslik. He can be Geremeev or Mukhudinov. Neither one nor the other was interrogated. In October, Rosbalt reported that the investigation established that Ruslik is Mukhudinov .
The investigation is supposed to be completed until November 28, and by January 2016, the TFR intends to refer the case to the Moscow District Military Court. The jurisdiction is determined by the fact that the alleged murder executor Zaur Dadaev at the time of the crime was an officer of the North internal troops battalion. The defense of the accused intends to petition for the consideration of the jury.
