The next day, the Investigative Committee opened the case under part 2 of Article 109 of the Criminal Code (causing death by negligence due to improper performance of professional duties), which provides up to three years of colony.

On November 7, the media reported that, according to the conclusion of forensic experts, Umarali Nazarov died of a cytomegalovirus infection , which was complicated by the development of heart and legal failure. This infection leads to the defeat of all vital organs. It was alleged that about a dozen serious diagnoses were posthumously killed by the deceased child. From this it was concluded that the boy was sick for a long time; It was not excluded that the child could become infected with the virus in the womb.

Meanwhile, the lawyer of the spouses Yuri Serov noticed on November 10 that at that time, information about the cytomegalovirus infection was not documented. “Neither we, the defense, nor the parents wise, or even the investigator leading this case, did not see the official conclusion of the forensic medical examination,” the lawyer emphasized.

On Tuesday morning, the police forcibly delivered the baby’s parents to the hospital . They tried to force them to donate blood. In case of refusal, Nazarov and Yunusova threatened the initiation of a criminal case. Nevertheless, they did not succumb to threats and did not take blood.

On November 12, the St. Petersburg City Court rejected Yunusova's appeal to a decision on its expulsion . Lawyers insisted that the mother of the deceased baby should be allowed to stay, as the woman was recognized as the victim in the criminal case and has the right to know what happened to her son. However, the appeal instance demanded that Yunusova leave Russia on his own within five days. The decision has entered into force.

At the same time, the rights of the mother of the child were significantly violated: she was granted a translator from the Uzbek language, while Yunusova speaks only in Tajik.
