The State Duma adopted in the first reading a law providing for a criminal punishment for re -engaging in Diggerism - "repeated unauthorized penetration into underground or underwater structures protected in accordance with the legislation of the Russian Federation." It is reported by Slon.

The authors of the bill on the website of the Lower Chamber indicate 12 deputies, including Zhirinovets Andrei Lugovoi, Uneneros Dmitry Vyatkin and Dmitry Gorovtsov, Dream. The document was supported by 350 deputies; Nobody voted against.

The bill provides for the inclusion in the Criminal Code of the new Article 213.1, which, as follows from its number, should be placed between articles on hooliganism and vandalism. Part 1 of this article provides for a fine of up to 500 thousand rubles or in the amount of the convicted person for a period of one and a half years, or up to two years of restriction of freedom, or up to two years of the colony.

Part 2 of the same article involves one of two qualifying features - repeated digger should be "committed by a group of persons by prior conspiracy or organized group" or "create a threat to the spread of information constituting a state secret." This part of Article 213.1 provides for a fine of up to 700 thousand rubles or in the amount of the convicted person for up to two years or up to four years of the colony.

Along with this law, the State Duma adopted in the first reading and the other about amendments to Article 20.17 of the Code of Administrative Offenses (violation of the passage of the protected object). The authors of this document were 9 deputies - also led by Lugov, Vyatkin and Gorovtsov.

In the current edition, Article 20.17 provides for a fine of 300 to 500 rubles. Deputies proposed setting its value at the level of 3 thousand to 5 thousand rubles.

In addition, part 2 is included in the article, which provides for the punishment for diggishism, if it is not committed. The disposition of this part literally coincides with the disposition of the proposed article 213.1 of the Criminal Code, with the exception that the word "repeated" is absent in it. The deputies propose to set fines from 100 thousand to 300 thousand rubles or to 15 days of arrest. Along with a fine and with arrest, the involved can be subjected to additional punishment - the confiscation of the “offense” gun, including photo -or video equipment.

“Repeatedly”, as stated in the note to the project of Article 213.1 of the Criminal Code, “unauthorized penetration” is considered if the person to whom it is charged was brought to administrative responsibility for the same “offense” within two years.

At the same time, answering in the course of discussion of bills to the question whether cases are known when the actions of the diggers posed a danger to society, Lugova said that such incidents have not yet been recorded.
