
The garrison military court of the annexed Crimea stopped the proceedings on the complaint of the defense of the Euromaidan Alexander Kostenko on his beating by the FSB officers. This was announced on his Facebook page by the lawyer Kostenko Dmitry Sotnikov. The judge, according to him, stopped proceedings on the grounds that the arguments about the torture of Kostenko were considered mainly by the criminal case in the Kiev district court of Simferopol. “However, during the consideration in the main criminal case, these arguments by the judge of Jezheleansky were not checked, since he considered them going beyond the charges,” writes Sotnikov.
The lawyer noted that such a result is still better than a refusal to satisfy the complaint, since now there has been an argument for cassation appeal in the Supreme Court and the ECHR. "As for the cassation appeal to the Supreme Court of the Republic of Crimea, the deadline for consideration of the issue of its adoption has expired on November 23, 2015, but the results have not yet been reported due to the energy collapse," the lawyer added.
On May 15, the judge of the illegitimate Kiev district court of Simferopol Viktor Mozheleansky sentenced Kostenko to 4 years 2 months of the general regime under paragraph “b” of part 2 of article 115 (intentional infliction of mild to health or enmity against any social group) and part 1 of Article 222 of the Russian Criminal Code (illegal storage of weapons). On August 26, the College of the "Supreme Court" of the Crimea (Judge -Rosom -Plaster - Sergey Togrebnyak) reduced the Maidanovtsa for three months .
The courts of both instances considered proven that in February 2014, on Grushevsky Street in Kyiv, the activist threw a stone at the Crimean Berkutian Vitaly Polienko, from which a bruise was formed on his hand, and that Kostenko kept a home -made rifled trunk of Makarov’s pistol. Politzek himself refused to admit the guilt.
During the detention, Kostenko was beaten by FSB officers Arthur Shambazov and Andrei Tishenin. According to Sotnikov, Kostenko broke his hand in the elbow joint and inflicted several blows to the head and back.
Now Kostenko is located in IK-5 in Kirovo-Chepetsk, a suburb of Kirov. Sotnikov found out the whereabouts of his principal, calling on his own in IK-5.
The lawyer announced the disappearance of Kostenko on October 14 . Even earlier, on October 1, it became known that the mother of Politzeck, Elena Kostenko, who is a public defender of his son, stopped letting him in the Simferopol pre-trial detention center-1. Since then, it was not possible to resume the connection with Politzek. Unofficial data received that on October 6 it should be taken to the stage, however, neither relatives nor the defense received an official notification of Kostenko’s sending to the colony.
